TOWN OF COPPER CANYON

REGULAR TOWN COUNCIL MEETING

MONDAY, NOVEMBER 14, 2016

The Town Council of the Town of Copper Canyon will meet in regular session on Monday, November 14, 2016, at 7:00 p.m. in the Council Chambers at Copper Canyon Town Hall, 400 Woodland Drive, Copper Canyon, Texas, whereupon the following items will be considered:

I.  CALL TO ORDER

American Flag - “I pledge allegiance to the Flag of the United States of America and to the Republic for which it stands, one Nation, under God, indivisible, with liberty and justice for all.”


Texas Flag - “Honor the Texas Flag; I pledge allegiance to thee, Texas, one state under God, one and indivisible.”

II.  PUBLIC INPUT

Citizens can make comments to the Town Council during this section of the meeting agenda. We ask citizens who wish to speak on agenda items to sign in on the sheet provided on the table at the back of the Council Chambers. There is a 3-minute time limit for each citizen who wishes to make a presentation. Pursuant to State Open Meetings law, the Town Council cannot discuss or take action on items not posted on the Agenda. Therefore, the Council cannot take action on or discuss any issues or items brought up during public input.

III.  PUBLIC HEARING

The Town Council of the Town of Copper Canyon will conduct a public hearing to consider the following:

1.  Requested exception to Ordinance No. 16-002 to allow a third “major accessory building,” to wit: an approximate 312 square foot horse shelter with three sides, on the property located at 911 Bridle Path, more particularly described as A0758a J. Lockhart, Tr 16, 4.881 acres, Old Dcad Tr #3 (Denton Central Appraisal District Tract No. 19073).

IV.  MAYOR’S REMARKS

1.  Bidding for Reconstruction of Chinn Chapel Road and Woodland Drive and the construction of the interior residential streets of Ladera Senior Community - Three parties are coordinating a joint bid on their individual three projects. Chinn Chapel Road will be funded by Denton County and supervised by Copper Canyon Town Engineers – Halff Associates. Woodland Drive will be funded by the Town of Copper Canyon and supervised by Copper Canyon Town Engineers – Halff Associates. Ladera’s interior streets will be funded by Integrity Group and supervised by Bobby Dollak with G&A Consultants. The joint project is on target to be publicized for bids this month.

2.  Flag Lots – Proposed ‘Flag Lot’ draft ordinance by Town Attorney requires the following:

i.  Flag lot is minimum two acres

ii.  No other flag lots allowed on property

iii.  Underlying lot must meet current zoning requirements for that area

iv.  Must be adequate accessibility for emergency responders

v. Must be adequate accessibility for required utilities

vi.  Must comply with requirements of driveway ordinances

vii.  Must be a public hearing before the Planning & Zoning Commission and Town Council, which may be on the same night, with prior notice to every land owner within 200 feet of the proposed flag lot. However, the Council by majority vote has the final decision on any allowance of a flag lot.

Note: Our Town Attorney Welch noted that flag lots will only be considered on minimum three acre properties. The original lot remains at least one acre; plus, the flag lot is a minimum of two additional acres. Therefore, this ordinance should have minimal effect on residential lots in the Town.

3.  Flexibility of Roof Pitch – The proposed draft ordinance by Terry Welch includes the following requirements;

i.  Hipped roofs shall have a pitch of 6 to 12

ii.  Gabled roofs shall have a pitch of 9 to 12

iii.  Shallower roof pitches will require a public hearing before P&Z, with notice to land owners within 200 feet, and a public hearing before the Council with standard newspaper notice. However, the Council by majority vote, has the final decision on any allowance of any shallower roof pitch other than 6 to 12 or 9 to 12.

NOTE: Attorney Welch noted that shallower roofs are less visually intrusive on neighbors.

4.  Accessory Building Exceptions – Town Attorney Terry Welch noted that up to two accessory buildings are a ‘right’. Any third accessory building is subject to approval of majority vote of council, after a public hearing, with notice to all land owners within 200 feet.

5.  Clarification of Executive Session – According to State Statue, a retained outside legal counsel can be present at Executive Session by telephone. Our Town Attorney Terry Welch will be available Monday night by telephone from Anchorage, Alaska from 7-9 p.m. for any necessary Town Executive Session. Terry is in Anchorage, because he is a featured speaker at a legal seminar every year.

V.  STAFF MAYOR AND COUNCIL REPORTS ON ITEMS OF COMMUNITY INTEREST (Pursuant to Texas Government Code Section 551.0415 the Town Council may report on the following items: (1) expression of thanks, congratulations or condolences; (2) information about holiday schedules, (3) recognition of individuals; (4) reminders about upcoming Town Council events; (5) information about community events; and (6) announcements involving imminent threat to public health and safety.)

VII.  CONSENT AGENDA

Items on the Consent Agenda are routine and administrative in nature. As such, these items are considered for approval by a single motion and vote without discussion. Council Members can remove an item or items from the agenda so it can be considered separately and/or add any item to be considered as part of the Consent Agenda.

5.  Approve Ordinance 16-012 granting a franchise to Cross Timbers Water Supply Corporation to be effective January 1, 2017 through December 31, 2017.

VIII.  ACTION & DISCUSSION ITEMS

1.  Discuss, consider and take action on a requested exception to Ordinance No. 16-002 to allow a third “major accessory building,” to wit: an approximate 312 square foot horse shelter with three sides, on the property located at 911 Bridle Path, more particularly described as A0758a J. Lockhart, Tr 16, 4.881 acres, Old Dcad Tr #3 (Denton Central Appraisal District Tract No. 19073).

2.  Discuss and consider whether to request and direct the Planning and Zoning Commission to undertake a review of the Town’s zoning and related regulations and provide possible recommendations to the Town Council relative to (1) a roof pitch exception process and (2) a requirement of a garage for new residential construction in residential zoning districts and (3) conditional approval of a residential flag lot by Council.

3.  Discuss, consider and recommend action regarding the need for a December 2016 Council Meeting.

IX.  DISCUSSION OF FUTURE AGENDA ITEMS (A Councilmember may request that an item be placed on a subsequent agenda for consideration. Any deliberation shall be limited to the proposal to place the subject on a subsequent agenda.)

X.  ADJOURN
