2017 SEASONAL LICENSE

This Seasonal License is between Copake Camping Resort (“CCR”) and the Campers (“Seasonals”) listed below to lease a campsite for recreational purposes.

·  Site: This License is for the right to use site ______as a recreational campsite for the self-contained RV referenced below and Seasonals automobile(s).

·  Term: for the season starting on May 12th 2017 to October 15th 2017.

·  Renewal: This License is renewed at the sole discretion of CCR for subsequent seasons if site deposit is paid by August 31st and accepted by CCR. This License may not be transferred or assumed by another party.

·  Seasonal Rate: Site rental fee is ______payable as a minimum of $500 dollars initial deposit by August 31st , 2016. Then seven equal monthly payments starting October 1st. The site deposit and payments are non-refundable.

·  SERVICES: CCR shall provide water, sewerage, metered electric service, Expanded Basic Cable TV, Wi-Fi and household garbage removal, public restrooms, public grounds and road maintenance, general supervision and security throughout the term of this License agreement.

·  RULES : This License is subject to the CCR “Campground Rules and Policies” and “Seasonal Summary Information” and subsequent updates or revisions. By signing this License, I/We acknowledge I/We have a copy of these rules and that my family and I, guests and visitors, agree to abide by them.

·  TERMINATION (1): The Seasonal may terminate this License prior to its expiration during the season but the rental fee and any outstanding additional charges must be paid in full before removal of lessee’s property.

·  TERMINATION (2): CCR may terminate this License for just cause with no refunds. Reasons to terminate may be as follows or as amended by CCR; failure to pay rent by due date; failure to pay any fees for services rendered by CCR; failure to pay electric bill within one month of billed date; non-compliance of Campground Rules and Policies; non-compliance of Seasonals Rules; conduct by Seasonal, family member, pet(s), visitor(s) or guest(s) which constitutes a substantial annoyance, nuisance or danger to other occupants of CCR and their property.

·  In the event of termination - Seasonal is responsible for all charges involved in the removal of their camper and personal belongings from CCR.

·  I/WE HAVE RECEIVED AND UNDERSTAND THIS LICENSE, THE SEASONALS SUMMARY INFORMATION, CAMPGROUND RULES AND RATE INFORMATION.

2017 SEASONAL SUMMARY INFORMATION AND RULES

“Campground Rules & Policies” Also Apply to Seasonals

SEASONAL DATES

·  May 12th to October 15th.

·  We will have scheduled clean up/ close up dates prior to and after the season where you may camp for Friday and Saturday nights ONLY. If you are not renewing you must have your rv out by the end of the camping season.

PAYMENT SCHEDULE/CANCELLATION POLICY

·  August 31st – $ 500 site deposit (non-refundable).

Balance will be Monthly payments starting October 1st divided equally thru April 1th. Payments are due the first of each month and late after the tenth. Seasonal site is to be paid in full by APRIL 1st.

·  Checks, Cash or Credit Card accepted payable to Copake Camping Resort. A $50 late fee per month will be assessed if payments are not made on time. You will not be permitted in the park until all fees and payments are paid. You will also not be permitted to camp if you do not have valid insurance. If monthly payments are not made on time we reserve the right to make the site available to others, to move you to another site, to cancel your seasonal license and/or not renew your license. Site deposits and subsequent payments are non-refundable.

·  Late payments are grounds for Non Renewal of seasonal license and any discounts are permanently forfeited.

INSURANCE

·  Seasonal Camper is responsible for appropriate insurance on selves, RV’s, golf carts, pets, autos, equipment, etc., and must provide office with copy of declaration page and verification of insurance. 100K Liability Minimum.

·  Campground Owners and Staff are not responsible for loss or damage to RV, auto, boats, camping equipment, money, valuables or personal property or for injury or accident to any camper, guest, visitor or pet. You are required to carry a minimum of 100K in liability insurance.

ELECTRIC Is read monthly by CCR. Seasonal is to pay electric monthly or $15 per month late fee will apply. There is a $5 dollar minimum monthly demand meter charge. Theft of services will result in immediate removal with no refund.

MAINTENANCE: SITE, RV, VEHICLES

·  Site upkeep and mowing of campsite is the Seasonal’s responsibility. You have the option of paying$ extra for full season site maintenance, spring clean up, winterization or occasional mowing. If site becomes unsightly we will at our discretion maintain it and bill you on a per cut basis. Continual lack of site maintenance is grounds for non-renewal. You may borrow a lawn mower for a $5 charge per use.

·  Site, RV, awning, deck, screen house, shed and vehicles are to be clean and in good repair. Any damage to be promptly repaired.

·  RV washing is required and permitted once at beginning and once again at end of season (May and Oct.) Not during season without specific permission.

·  Decorations are to be reasonable and tasteful. For clarification check with Management. No fences except split rail.

·  Auto vehicle repair, maintenance or washing is not permitted in campground.

·  A three foot road clearance must be maintained if at all possible. This means no fences no bushes etc right at the road edge. In some cases we know of large trees that are not possible to remove but we need to widen the roadways as much as possible.

·  No power tool use on weekends, construction projects. No exceptions. No lawn mowing after 7pm on Friday or before Sunday at 12pm. Holiday weekends not before Monday at 12pm.

·  Sheds Must be constructed of T111 or Smart Siding and be no larger than 8x10. Flooring must be pressured treated lumber. One shed per site. They need to be painted Back Pack Tan (Sherman Williams color name) with white trim. Or the lighter tan color that comes from A to Z sheds. No other colors. Prior approval of CCR required before installing. No Rubbermaid sheds of any size permitted.

·  Outside refrigerators are not permitted.

·  Only one free standing commercial grade gazebo or screen room. No solid walls screen only. It should be in good condition and removed at end of season. Permanent Screen Rooms attached to a trailer are no longer permitted.

·  Outside furniture, decking, awnings, wood piles and coverings etc. should be neat, safe, clean and in good repair.

·  Storage of items not associated with camping is not permitted. No boats or Utility trailers. Use storage area.

Decks require prior approval. Decks must be constructed of pressure treated lumber and may be no longer than

The trailer they are next to. Each section must not be bigger than 4x8 and must be anchored to the ground.

·  The deck must be sitting on floating blocks. Decks should not be constructed so close to trailer that we could not move it in case of an emergency. We do not provide picnic tables to seasonals.

·  No TV antennas. Park has Cable TV. Satellite Dishes by permission only.

SEASONAL VISITORS AND GUESTS

·  Hours: Day: 9am to 7 pm Overnight: 7 pm onwards

·  Published Weekend Day Visitor Rate - Adults: $10 Children $7 Overnight:: Adults $12 Children $8

·  Special Events: Day Only $12 Adults - Children $8 - Children under five $5

·  Ten day visitor passes are issued free of charge to each seasonal campsite. Additional passes are $30 for ten. These passes may not be used for holidays or special events. For Holiday weekends and special events if you have guests, they or you will be paying the regular rate and you will be limited to four visitors.

·  All Visitors and Guests must first register at office before entering campground.

·  Visitors/guests stay in Seasonals camping unit, no extra tents.

·  It is responsibility of Seasonals to ensure visitors and guests follow campground rules and policies.

·  Visitors just “popping in” must register; fee will be refunded if they stay less than 30 minutes.

·  Minor-aged children are not permitted use of your RV in your absence.

·  In your absence, overnight guests are not permitted to use your RV without prior Management notification. They will pay a regular site fee if you are not present.

·  Advise management prior to contractors arriving on site to perform work etc. on your RV or vehicle. All contractors must have valid liability insurance.

VEHICLES, PARKING & DRIVING

·  One RV and up to 2 vehicles per site. Extra vehicles to be parked in overflow parking area.

·  Commercial vehicles are not permitted on site without prior permission from Management.

·  Overflow parking provided for visitors, guests or extra vehicles at no additional charge.

·  Only persons with current driver’s license may operate a motor vehicle or golf cart on campground premises and must have working headlights if driven at night. There shall be no children sitting on laps to drive vehicles. Passengers may not exceed seating capacity. Your guests may not drive your golf cart. Golf carts must be marked with site number in three inch numbers on both sides.

STORAGE

·  Winter Storage of RV, deck, awning, shed, is permitted on campsite and included in rate provided you have renewed for the following season. All other equipment is to be stored inside shed, RV or dissembled and removed from campground. Storage is available year around in storage field for additional RV’s or equipment.

MAIL AND MESSAGES

·  Urgent messages will be delivered as soon as practical. All other messages will be kept at the office. Do not have mail or packages sent here. Post Office boxes are available in town at a reasonable fee.

CAMPGROUND OFF-SEASON

·  Campground is closed from October 15th to May 12th.

·  Off-season visits to campground are permitted only with prior Management approval at a time convenient to campground owners. This means you must speak to us and ask if it is convenient. Not just leave a message on the machine and show up. If you violate this policy you will be refused off season admittance.

MISCELLANEOUS

·  Removal/use of wood, equipment, property, electricity, etc. from other RV’s/sites and/or campground property is considered stealing and may be grounds for termination of seasonal license without refund.

·  Selling, Soliciting, hunting, collecting, religious preaching, drunken behavior, nudity or any unlawful behavior is not permitted in campground. Terminated Seasonals or Seasonals relocating to a different site may not remove gravel or plants without permission, and are solely responsible for removing their trailer, shed, deck and any other personal belongings.

·  New Seasonal applications will not be accepted with camping units more than 10 years old at time of first seasonal camping season without prior inspection by management. Twelve Wide Park Models of any age are no longer accepted. If your camping unit is more than 10 years old and becomes an eye sore, as determined by management, we reserve the right to require you replace it with a newer unit if you wish to remain a seasonal.

·  Gate Cards require a $20 deposit per card and are only to be used by the seasonal camper. If you stop being a seasonal with us your gate card deposit will be refunded when your card is turned in undamaged during the current camping season and provided you are current with your payments. Past Due campers or late card returns will have their gate card locked out and will not have their deposit refunded. Damaged cards receive $10.
