AGREEMENT FOR THE GRANTING AND ACCEPTANCE OF THE SCHOLARSHIP

BETWEEN THE CHILEAN AGENCY FOR INTERNATIONAL COOPERATION AND DEVELOPMENT

The CHILEAN AGENCY FOR INTERNATIONAL COOPERATION AND DEVELOPMENT, a legal agency governed by public Law No. 18,989, Tax Payer No. 60.108.000-1, hereinafter also denominated "AGCID" or “the Agency”, represented by the Director of Formation and Scholarships Department, Mr. Pablo Garcia Aguirre, both domiciled at Teatinos No. 180, 8th floor, Santiago, and Mr.(s.) ………………………………………………………………., hereinafter also called the "scholarship recipient”, nationality ………………………..….., profession ………………………………..…....., Passport No. ………………………….., whose address in his(her) country is ……………………………………………………………………….., have agreed upon the following:

ONE: IDENTIFICATION OF THE PARTIES

The scholarship recipient has been selected by AGCID for a scholarship in the framework of the Technical Cooperation activities among developing countries performed by the Agency. The characteristics and objectives of the scholarship are contained in the document denominated "Chilean Agency for International Cooperation and Development. Republic of Chile – Nelson Mandela Scholarship Program. 2019 Call for Applications" approved by Exempt Resolution No. ______dated ______.

TWO: ACCEPTANCE OF THE SCHOLARSHIP.

By means of this agreement, the scholarship recipient, who has been accepted by the ______to study in the Masters Program ______,as of the date_________until______,hereby accepts the scholarship referred to in the above clause and, as beneficiary of the latter, is obliged to fully comply with everything established herein.

THREE: AGCID’s OBLIGATIONS.

The Chilean Agency for International Cooperation and Development has a Horizontal Cooperation Scholarship Program. On the occasion of the 2019 Call for Applications to thisProgram, AGCID assumes the following obligations for the benefit of the scholarship recipient:

  1. Payment of the round trip air tickets, from the capital of the country of origin to the city of final destination in Chile (the applicant will have to consider personal financing of the stay in Santiago de Chile to carry out the paper work processes at AGCID) and back, to the capital of his/her country of origin, at the end of their studies. In case the city where the scholar will study does not have an airport, he/she will receive a Ch$ 20,000 subsidy for bus travel.
  1. To pay the cost of the enrollment fee, tuition, and the costs of the degree charged by the respective institution of higher education, for the duration of the postgraduate program, with a limit of four academic semesters, or six academic quarters, depending on the schedule used by the respective institution. In any case, these costs must correspond exclusively to the academic curriculum of the study program for which the scholarship was awarded.
  1. To pay the scholarship recipient a monthly allowance of five hundred thousand Chilean pesos ($500,000). Said allowance will be paid for the duration of the Spanish Immersion course and the program or term for which the scholarship was applied for, and in any case subject to a maximum of thirty (30) months. Payment will be effective as of the month in which the scholarship recipient begins his/her studies in Chile.
  1. Taking into account that each Study Program annually incudes a period of academic holiday, AGCID will pay the scholarship recipient 100% of the monthly allowance during the months of December, January, or February and only if he/she stays in Chile more than half of the respective month. In all other cases, and provided that it does not imply the breach of the obligations of the scholarship recipient described in the fourth clause, AGCID will pay only 50% of the amount of said allowance.
  1. To provide life, health and accident insurance for the benefit of the scholarship recipient for events that occur within the territory of Chile and while the scholarship is in force. Additionally, based on an agreement with the Public Health Care System insurance (FONASA), the scholarship recipient shall be entitled to receive care through the Chilean Public Health System and Services, as long as they have the national identity card granted by the Civil Registry Service of Chile.
  1. Provision to the scholarship recipient of a single allocation for textbooks and study materials in his(her) first term of the study program. This allocation is for a total of ninety thousand Chilean pesos (Ch$ 90,000).
  1. Provision to the scholarship recipient of an allocation for an amount equivalent to Ch$230,000 (two hundred and thirty thousand pesos), for thesis expenses or compliance with similar requirements of the institution of higher education to grant the respective degree. This allocation shall be paid one single time provided that the scholarship recipient’s grade point average in the respective study program is equal to or higher than 5.5 (five point five) or its equivalent level. For this purpose, the scholarship recipient, before expiry of the nineteenth month in which AGCI has been paying the monthly allowance referred to in point II of this clause, must accredit:
  2. The timetable for the development of the thesis work (or similar requirement), signed by the professor and by the scholarship recipient.
  3. The approval of the thesis project or similar requirement (certificate).
  4. The academic performance (certificate of grades, with grade point average).
  1. To Pay a Spanish Immersion Course for the scholarship recipient for one (1) semester, if necessary for the applicant, which must be completed prior to the Master’s Program.
  1. To pay for transport of the scholarship recipient, upon arrival, from the airport to the place they indicate within Santiago.

All of the aforementioned benefits are exclusively for the scholarship recipient.

AGCID shall not assume any other obligation nor shall pay any expense that is not included in the above clause. It is therefore the responsibility of the scholarship recipient to finance any other expenses to be incurred for visa costs, application fees to Chilean institutions of higher education, airport taxes or other similar taxes, costs for travel to his/her country during the period of the scholarship, or other expenses not covered by this agreement.

FOUR: SCHOLARSHIP RECIPIENT’S OBLIGATIONS.

In the framework of this agreement, the scholarship recipient shall have the following obligations:

1.To hold the academic degrees or certificates and other curriculum requirements required by the higher education institution to which he/she has been accepted.

2.To accredit, by competent medical certificate, whenever so requested by AGCID, good physical and mental health, compatible with the academic demands of the studies for which the scholarship has been granted.

3.To comply with immigration regulations in force in Chile.

4.To set his/her domicile in the city in which the study program will be carried out, for which the scholarship has been granted, within three business days following the date of signing this agreement. The scholarship recipient should inform this address to AGCI immediately, as well as any changes that may take place in this regard. He/she must also keep AGCI informed about his/her phone numbers in Chile as well as his/her current email address.

5.To reside in the city in which the courses of the study program are held, for which the scholarship has been awarded, while the scholarship is in effect.

6.To not leave Chile, without the consent of AGCID, while the scholarship is in effect. In order to accredit the due fulfilment of the obligations established in the beginning of this section, AGCID is hereby authorized to request the display of the scholarship recipient’s passport and to request certifications regarding the entries and exits of the scholarship recipient from the Chilean territory from the relevant Chilean immigration authority.

The scholarship recipient may only leave the country, with AGCI’s prior authorization, in the following cases:

I) During the months of December, January, and February each year and only for the academic vacation period contemplated in the Study Program. For these purposes, the scholarship recipient must submithis/her application along with the document issued by the University, which establishes the precise holiday period of the respective academic program.

II) For a brief period, which should not exceed five (5) working days. Only in qualified cases, and duly justified by the scholarship recipient, AGCI may grant a longer period.

For this purpose, the scholarship recipient must submit a written application to AGCID no later than five (5) business days prior to the scheduled date for the trip. In an event of force majeure, understood as those described in paragraph 1 of the sixth clause of this Agreement, AGCID may allow the submittal of such application with less anticipation. Once the scholarship holder returns to Chile, he/she must immediately report this fact to AGCID, by attaching a letter that includes photos of the exit and entry stamps from the country in the passport.

7.To display irreproachable behaviour in full compliance with Chilean laws. Notwithstanding any other facts or events that may involve a breach of this obligation, it will be understood as unfulfilled whenever the scholarship recipient is charged for a crime or offense.

8.To provide all the necessary information required by AGCID, within the time set by the latter.

9.To comply with the academic requirements established by the institution of higher education in which the studies are carried out.

10.To pass the mandatory Spanish Immersion course which the scholarship recipient must take in accordance with the respective Call for Applications.

11.To pass all the courses or subjects which, under the respective program of study, the applicant is required to take during each term and accredit the latter with a certificate issued by the authority of the corresponding academic entity.

12.To display, in each term, good academic performance defined as a grade point average equal to or higher than 5.0, or its equivalent grading system.

13.To meet the academic and administrative requirements requested by the respective institution of higher education to obtain the academic degree for the study program for which the scholarship has been granted. To accredit compliance with this obligation, the scholarship recipient shall submit to AGCID the certificates issued by the competent academic authority of the respective institution of higher education, with regard to:

  1. The fulfillment of the aforementioned requirements, by means of a certificate issued at the end of the semester of study or at the administrative closing carried out by the respective University, which accounts for the scholarship holder’s standing asa regular student; and
  2. The score or final grades (expressed on a scale of 1 to 7, in which the latter is the maximum) obtained in the respective study program.

14.To exclusively dedicate himself/herself to the studies for which the scholarship has been awarded, while it is in effect. The fulfilment of this obligation includes the prohibition to perform paid work in Chile or outside the country.

15.To comply, in a timely manner, with any written requests formulated by AGCID, including responding to questionnaires sent by the Agency, and to attend any assembly or meeting summoned in writing by the Agency during the period of the scholarship.

16.To deliver to AGCID, at the end of the studies, in a compact disc (CD), a copy of the final text of the thesis or a similar document prepared by the scholarship recipient in the framework of the study program.

17.To leave record of his/her standing as an AGCI scholarship recipient for every research and dissemination activity with an academic profile in which he/she participates.

18.Do not apply for scholarships from the State of Chile while you are a scholarship recipient from the Agency, except for the continuity of your studies, as long as you have the status as a scholarship recipient from the Agency.

19.Return to his/her country after having completed the entire Study Program for which the scholarship was awarded or in the case of the early termination of the scholarship referred to in this agreement in its Sixth Clause, unless the scholar obtains another scholarship in Chile for the continuity of his/herstudies. In the event that the scholar does not comply with this obligation, in a timely manner the AGCID will inform the relevant Chilean immigration authority so that it may adopt the necessary measures.

20. If the scholarship holder does not pass the Spanish Language Immersion Course, he/she will have to return to his/her country.

21.The scholar must bring money necessary for his/her personal expenses the first week in Chile, until the first allowance payment is received.

For purposes of facilitating AGCID to be able to ensure compliance with these obligations, the scholarship recipient hereby accepts and authorizes, as of this day, for AGCID to request and access information to which it is entitled, including his/her personal or sensitive information, in Chile or abroad.

FIVE: GROUNDS FOR RESTRICTION OF THE SCHOLARSHIP BENEFITS.

AGCID may restrict the benefits indicated in the third clause, in the following cases:

1)Through the suspension of the benefits included in numbers III, V, and VI of the third clause of this agreement:

a)If the scholarship recipient fails one or more courses or subjects within the corresponding term of the academic program.

b)If the scholarship recipient does not comply with any of the obligations established in Numbers 5, 6, 7, 9, 13, 14, and 15 of the above clause.

The suspension measure signifies the permanent loss of the benefits referred to in numbers III, V, and VI of the third clause, during the period in which this measure is in effect. If the scholarship recipient should incur more than once in any of the listed reasons, it will constitute grounds for early termination of the scholarship.

2) Through retaining the monthly allowance referred to in number III of the third clause, in the event that the scholarship recipient does not fulfil any of the obligations regarding accrediting good health, setting domicile, providing information and complying with AGCID’s requirements and summons, listed in number 2, 4, 8, and 16 of the fourth clause.

The aforementioned retention shall come to an end as soon as the scholarship recipient has complied with the respective pending obligation.

AGCI shall carefully evaluate the circumstances leading to the grounds for restricting the scholarship benefits.

SIX: GROUNDS FOR EARLY TERMINATION OF THE SCHOLARSHIP.

The following constitute grounds for early termination of the scholarship, to be evaluated by AGCID:

  1. Supervening events constituting force majeure, which must be duly accredited to AGCID by the scholarship recipient. For these purposes, the term "force majeure" shall be understood as:

I.The occurrence of events that seriously affect the health of the scholarship recipient, his/her spouse or children. In any case, the activation of a pre-existing condition does not constitute force majeure, whether or not it was declared by the scholar;

II.Disasters in the place of origin of the scholarship recipient;

III. Requirement established by the competent authority of the State of which the scholarship is a citizen, sent to AGCID by the respective focal point; and,

IV. Other facts equivalent in magnitude to the above.

  1. The change of the academic program by the scholarship recipient without the prior authorization of AGCID.
  1. The scholarship holder does not pass the Spanish language Immersion Course, an obligation established in No. 10 of the fourth clause of this agreement;
  1. The non-compliance by the scholarship holder of any of his/her obligations which AGCID qualifies as serious.
  1. The scholarship holder has been subject to a serious sanction for breaches of the bylaws or internal regulations of the respective educational institution, including the suspension or expulsion of the scholar.

AGCID shall carefully evaluate the circumstances leading to the grounds for early termination of the scholarship.

The scholarship recipient, who is subject to early termination of the scholarship for the reasons included in numbers 2, 3, 4, and/or 5 of this clause, may not apply for a scholarship from AGCI again.

Notwithstanding the foregoing, AGCID will, in any case, pay the return air tickets to the scholarship's home city.

SEVEN: OBLIGATION TO RESTORE TO AGCID THE AMOUNT PAID FOR THE SCHOLARSHIP, IN CASE OF EARLY TERMINATION DUE TO EVENTS IMPUTABLE TO THE SCHOLARSHIP RECIPIENT.

Should AGCID determine the early termination of the scholarship due to the application of the grounds indicated in numbers 2, 3, 4, and/or 5 of the sixth clause of this agreement, the scholarship recipient shall reimburse to AGCID the full amount it has paid with respect to said scholarship for the benefits referred to in the third clause of the agreement, at the date on which these were verified, except for amounts paid for life, health, and accident insurance.

To this effect, AGCID will notify, in writing, to the scholarship recipient and to the focal point of the Agency in the country of his/her nationality, indicating the amount to be returned as well as the breakdown of expenses corresponding to each area.

For the purposes stated in this clause, the scholarship recipient hereby accepts, as of this date, the determination by AGCID of the amount to be reimbursed and recognizes it as a debt for all legal purposes, and authorizes the administrative and judicial proceedings in this regard to be made before the authorities of Chile and in his/her country of origin, for the full payment of the amounts due.

EIGHT: REQUEST FOR RECONSIDERATION.

The scholarship recipient shall have the right to request, in writing, to the Executive Director of AGCID, the reconsideration of the following measures:

a) The suspension of benefits under the terms of number 1) of the fifth clause;

b) The early termination of the scholarship due to events attributable to the scholarship recipient, under the terms indicated in numbers 2, 3, and 4 of the sixth clause;

c) The rejection of a request made for the application of the grounds of Force Majeure in paragraph IV, No. 1 of the aforementioned sixth clause.

The scholarship recipient must make his/her request for reconsideration within three (3) working days following the date on which he/she was notified of any of the above measures, providing new information. The review will be resolved reasonably without the right to further appeal.
