CONTRACTORS SUMMARY AND INDEMNITY

Construction Contractors

The access for persons involved in construction at Longlands is controlled by the Architectural Guidelines, the Contractor’s Rules and the procedures described here.

A SIGNED COPY OF THIS DOCUMENT, SUBMITTED TO THE HOA, IS A PRE-REQUISITE BEFORE CONSTRUCTION WILL BE ALLOWED TO COMMENCE AT LONGLANDS.

Each homeowner, when commencing construction at Longlands must appoint Professional Service Providers, including a Principal Agent, an Architect, Engineers, Quantity Surveyors, Land Surveyors and a Construction Contractor. All these persons must be identified in their individual capacity and must be enrolled as such.

Professional Service Providers

Professional Service Providers refer to the individuals described above.

Special conditions:

  • All appointed Professional Service Providers may enrol themselves and one other representative for the duration of the construction period.
  • Should the Professional Service Provider and the other representative visit Longlands together, one is allowed to access Longlands in the vehicle while the other has to exit the vehicle and access Longlands via the turnstile.
  • Any other persons accompanying the Professional Service Providers onto Longlands, must be enrolled and must access the estate in the same way a person accompanying a delivery vehicle is enrolled (biometric) and accesses the estate (turnstile).
  • It is the responsibility of the security guards at the gate to ensure that not more than one person enters the estate in a vehicle, while all other persons must enter via the turnstile.
  • Any Professional Service Providers wanting to be on the estate outside the allowed time must make special arrangements with the Estate Manager.
  • Any Professional Service Providers not adhering to the above procedures will immediately be precluded from entering Longlands again until a written explanation has been received by the HOA, from the Principal Agent and the access of the Professional Service Providers has been re-allowed by the Board of Trustees of the Longlands HOA.

Site Foreman and Sub-Contractor Foreman

Site Foreman refers to an individual appointed by the Construction Contractor to act as a Site Foreman on his or her behalf and Sub-Contractor Foreman refers to a person appointed by a Sub-Contractor to act on his or her behalf.

The Site Foreman and Sub-Contractor Foreman have the same access rights as Professional Service Providers and all restrictions applicable to Professional Service Providers are applicable to Site Foremen and Sub-Contractor Foremen.

The only exception is that Site Foremen and Sub-Contractor Foremen cannot enrol an additional representative.

Contractor and Sub-contractor Employees

Contractor and Sub-contractor Employees refer to all employees of the Construction Contractor and all Sub-contractors working on a construction site, excluding Professional Service Providers and Foremen.

Special conditions:

  • All employees must arrive at Longlands with transport organized by the Contractor. Employees arriving by foot and loitering in the entrance area of the estate will be precluded from entering Longlands again.
  • The responsibility to ensure that no employees arrive by foot, in other vehicles or loiter around in the entrance area lies fully with the Contractor or Sub-contractor who employs them.
  • No provision is made for employees arriving at Longlands in their own vehicles and no employee vehicles will be allowed onto the estate or in the estate parking areas, at any time.
  • The transport vehicle may only be driven by the Contractor, the Sub-Contractor or a Site Foreman.
  • No access will be allowed for employees in private vehicles or arriving on foot.
  • The transport vehicle has to stop in the Contractors Lane slipway and all employees should disembark the vehicle.
  • The vehicle with its driver may then proceed through the vehicle entrance while the employees enter through the turnstile.
  • The employees must then get back into the transport vehicle and proceed to the construction site in this manner.
  • No employee may go to a site on foot or return from the site to the entrance by foot.
  • Exactly the same procedure must be followed on exit.
  • It is the responsibility of the Contractor to ensure that all employees are aware of the security procedures at Longlands.
  • Employees are not allowed to leave the construction site at all during the working day.
  • Should any of these rules be broken, the Contractor and all Sub-contractors, with their employees, will not be allowed back onto Longlands until special permission has been granted by the Board of Trustees.

Deliveries

All deliveries to construction sites must adhere to the regulations stated in the Contractors Rules and Regulations.

Deliveries refer to any deliveries made to a construction site.

Special conditions:

  • All deliveries should be reported to the duty manager, by the Principal Agent, on the morning of the expected delivery. This report could be made in person or telephonically.
  • It is the responsibility of the duty manager to ensure that an Enrolment Officer is available at the time of the expected delivery.
  • Deliveries, regardless of the kind of delivery, may only be made to a construction site on Longlands if the Principal Agent, the Construction Contractor or the Construction Site Foreman is on site.
  • Deliveries, regardless of the kind of the delivery, may only be made by vehicle.
  • The delivery must be met at the entrance by the Principal Agent, the Construction Contractor or the Construction Site Foreman.
  • Unless one of the above 3 persons is at the entrance, no delivery vehicles will be allowed onto the estate.
  • The delivery vehicle has to stop in the Contractors Lane slipway and the driver and any other persons in the vehicle must be enrolled following the normal enrolment procedures. Documentary proof of the delivery must be captured in addition to the ID documents and driver’s licences.
  • The driver and the vehicle must access the estate via the vehicle entrance and all other persons in the delivery vehicle must assess the estate via the turnstile.
  • The same procedure must be followed during exit.
  • The Principal Agent, the Construction Contractor or the Construction Site Foreman must escort the delivery vehicle between the entrance and the construction site – both during the entrance and exit of the delivery vehicle.
  • Failure to follow the prescribed procedure will preclude the company responsible for the delivery and its employees from ever accessing Longlands again.
  • By signing the security control documents, the driver of the delivery vehicle accepts this responsibility on behalf of his or her employer.

By signing this document, I accept on behalf of myself, the company or legal entity I represent and all sub-contractors we might appoint, full responsibility to ensure that all agents and employees of the company or legal entity I represent, and all sub-contractors we might appoint, will be trained in and will adhere to the security and all other regulations of the Longlands Estate and its Homeowners Association as published and amended from time to time.

I agree on behalf of the company or legal entity I represent, and all sub-contractors we might appoint, to accept all sanctions imposed by the Longlands HOA, its agents or employees in the execution of these security procedures and hereby indemnify Longlands Holdings Pty Ltd and the Longlands HOA and all their directors, trustees, agents and employees against any legal procedures, costs or losses incurred due to the failure of any of the agents or employees of the company or legal entity I represent,and all sub-contractors we might appoint, to adhere to these security procedures.

I further warrant that I am duly authorized to sign this document on behalf of the company or legal entity I represent.
