Application for Accreditation or Renewal

Acknowledgements, Releases and Indemnities

I apply for Accreditation in accordance with the Policy and Rules of Contractor Accreditation Ltd.

I declare that the information supplied is true and correct.

I enclose the appropriate Application fee. I understand that further fees will be payable if this application is successful and that Accreditation will not be granted until these fees are paid.

I acknowledge that I am required to understand and adhere to the NT Procurement Code, a copy of which was provided to me with my original application, and undertake to do so.

I further acknowledge that I am required to understand and adhere to the requirements of the Northern Territory Government relating to employment and training of apprentices on Government construction and maintenance contracts.

I undertake to comply therewith.

I understand that non-compliance with either of the above may result in my losing Accreditation, in part or wholly.

Acknowledgement and Release

I acknowledge that CAL, its Directors, Registrar and staff, members of its Assessment Panel and engaged consultants accept no responsibility whatsoever, howsoever arising, in respect of the administration and determination of this Application for Accreditation.

In consideration of CAL and the persons referred to above agreeing to consider my Application for Accreditation, I hereby forever release and discharge them and each of them from any liability whatsoever, civil or criminal, howsoever arising, for or in respect of any act or thing done or omitted to be done, or statement made, in good faith by them or any of them in the performance or purported performance of a function or the exercise or purported exercise of a power in the administration of CAL’s system of accreditation of contractors pursuant to which this Application for Accreditation is made.

I hereby acknowledge that this release may be pleaded as a bar to any proceedings instituted by me against CAL or any of the persons referred to above.

The above Acknowledgements and Release are given:

a) Where the Applicant is an individual or a corporation – by the Applicant.

b) Where the Applicant is a partnership – by all partners jointly and severally as witness their signature to this application.

c) Where the applicant is a corporation and unless CAL shall have dispensed with this requirement – by all directors of the Applicant corporation, jointly and severally, as witness their signatures to this application.

Indemnity by Corporate Applicant and its Directors

In consideration of CAL, its Directors, Registrar and staff, members of its Assessment Panel and engaged consultants agreeing to consider this Application for Accreditation, the Applicant and the Directors of the Applicant (where the Applicant is a company) jointly and severally hereby agree to indemnify them and each of them in respect of any claim action or proceedings whatsoever, civil or criminal, howsoever arising, made by any employee of the Applicant against any of them including the costs of litigation and other legal costs on a solicitor and own client basis and the amount of any damages or penalties that may be recovered against or ordered to be paid by any of them.

Important Notice to Applicants

Please Read Carefully: CAL may seek information about you or your company from a credit reporting agency, your bank, your accountant, debtors and creditors (named by you in your application), past and present clients, Northern Territory Government personnel and other persons at its discretion.

I agree to CAL, through its Registrar and staff, making enquiries of the persons indicated above to gather information about me and/or my Company for the purpose of assessing this Application for Accreditation, my subsequent performance as a contractor and any future Applications for Accreditation and hereby authorize those persons to supply the information sought.

I understand that, if any adverse reports appear likely to lead to my application for accreditation being refused or granted at a lower rating than that sought, then the Registrar will advise me of those reports and request my written comment on them for consideration by the Assessment Sub Panel. I acknowledge that the Registrar shall use his best endeavors to preserve the confidentiality of the source of the adverse report and I will not request such information from the Registrar or his staff.

I agree to this information, including, if the Registrar deems it appropriate, any credit reference reports or other information brought to his attention that may be relevant to my adherence to the NT Procurement Code, but not including any other information relating to financial capacity, being used by an Assessment Sub Panel and an Assessment Review Panel, for the purpose only of considering my application for accreditation, and I understand original copies of all information will be kept at the offices of CAL during the currency of my Accreditation.

I agree to information relating to my financial capacity being considered only by independent financial consultants appointed by CAL for the purpose of providing an opinion as to my financial capacity to undertake works at the level for which accreditation is sought to the Assessment Sub Panel or Assessment Review Panel considering my application.

Release

In consideration of their supplying any information or opinions sought by CAL for the purpose of my application for accreditation, I hereby forever release and discharge all persons supplying any information or opinions to CAL from all liability whatsoever, civil or criminal, for any loss or damage in respect of which I may otherwise claim to be entitled to claim damages or seek other relief as a result of any person supplying that information or opinion.

I acknowledge that this release may be pleaded as a bar to any proceedings instituted by me against any such person.
