In accordance with ARS 13-3885, let it be known that ______, a licensed Bail Bondsman from ______, hereinafter referred to as “out-of-state bondsman”, has agreed to work with Arizona Licensed Bail Bondsman John A. Burns, hereinafter referred to as “Arizona Bondsman” in order to contract the assistance of the following Arizona Bail Enforcement Agents: John A. Burns, Joshua Dumond, Jesus Valadez, Michael Wolfe, and Phil Whitaker.

In explicit authority to surrender to custody one ______, hereinafter referred to as “the principal”.

This agreement holds harmless the “Arizona Bondsman” from any and all liability which results from the outcome of the bond of “the principal” as a result of surrendering or failing to surrender “the principal” to custody. At no time is the “Arizona Bondsman” to be liable for any damages, monies, collateral, or anything held or assessed at the time of the original bond application of “the principal”. In addition, this agreement holds harmless the “Arizona Bondsman” from the actions of the Bail Enforcement Agents contracted to conduct the surrender of custody of “the principal”.

Bail Fugitive Recovery Contract

This agreement made and entered into this ______day of ______, 20___, by and between ______, hereinafter referred to as “Bondsman”, and Strike Force Fugitive Recovery, hereinafter referred to as “Recovery Agent”. Whereas Bondsman seeks the apprehension and arrest of a bail fugitive, namely ______, on appearance bond(s) number(s) ______, in the total amount of $______, which he has written on behalf of ______surety company, and Bondsman is desirous of engaging the professional services of Strike Force Fugitive Recovery to effectuate this end, now therefore, Bondsman agrees to pay Recovery Agent $500.00 or 10% of the total of said bond(s), whichever is greater, and $50.00 (fifty dollars) an hour for guarding fugitive after the first two hours of the capture, for his services in effectuating capture of the fugitive or bailee. Bondsman warrants that aforementioned bail bond(s) are all the outstanding bail bond(s) he has written on the named bail fugitive. Methods of capture include:

  1. Locating, arresting, and transporting the bail fugitive to the appropriate facility;
  2. Discovering that the bail fugitive is dead and the production of evidence to support that;
  3. Causing the arrest of the bail fugitive by an law enforcement agency (passive arrest);
  4. Surrender by Recovery Agent, or by Bondsman, of the bail fugitive to a law enforcement agency; or,
  5. Any other method, including legal maneuvers to be done by Bondsman’s attorney, which Recovery Agent may devise or discover whereby Bondsman may be exonerated.

In the event that the bail fugitive is arrested by a law enforcement agency prior to surrender or forfeiture of said bond(s), and such arrest was caused by the Recovery Agent, Bondsman agrees to pay Recovery Agent $100.00 or 5% of said bond(s), whichever is greater, and transportation of $50.00 (fifty dollars) an hour and $.55 per mile after first 75 miles.

Bondsman shall forthwith supply Recovery Agent with:

  1. A Certified Copy of the Bail Bond(s);
  2. A proper Arrest Authorization;
  3. A clear photograph of the bail fugitive; and,
  4. A copy of the original bail bond(s) application(s), indemnitor application(s) and agreement(s), and any other available information on the bail fugitive.

Bondsman does hereby agree to assume full financial responsibility for all medical costs incurred by the named bail fugitive, which may occur as the direct result of any lawful action taken by Recovery Agent during the lawful apprehension and/or arrest of named bail fugitive.

This agreement will terminate fully upon the lawful surrender of named bail fugitive, either by Recovery Agent, or by Bondsman, to any law enforcement agency in the United States, upon legal surrender or forfeiture of named appearance bond(s), or bail fugitive is turned over to Bondsman.
