Contract between ECQA®GmbHand Training Organisation

  1. Scope of the Contract

The scope of this contract refers to the certification of a training organisation to offer and perform courses for the ECQA® job role (skills set) <name of the job role>

The signend contract confirms that the applicant complies with ECQA® quality rules (see Annex 1_Rules and Process Steps for the Certfication of ECQA® Training Organisations)

  1. Duties of ECQA
  1. ECQA®GmbH audits the Training Organisation and confirms compliance/non-compliance with ECQA®Quality Standards and Rules – see Annex_1.
  2. ECQA®GmbH commissions independent, experienced auditors who don´t have any conflict of interest when auditing an applicant training organisation.
  3. ECQA®fosters and monitorsfair competition between ECQA® Certified Training Organisations and Applicants.
  4. ECQA® GmbH promotes ECQA® Certified training organisation on its web site as authorised and recommended to deliver ECQA® Certified courses for the specific job role<name of the job role>.
  5. ECQA® GmbH audits and certifies trainers who comply with ECQA® Quality Standards and Rules – see Annex 2_Rules and Process Steps for Certification of ECQA® Trainers.
  6. ECQA® GmbH grants certified training providers the right to use the ECQA® logo and the specific ECQA® job role logo forname of the job rolein their brochures and training announcements.
  7. A list of most successful ECQA® certified training bodies will be publishedon theECQA® GmbH Website, ranked by the numbers of ECQA® trainings performed and ECQA® exams derived from these trainings.
  8. ECQA® GmbH acts as independent certification body and determines the framework of re-certification of ECQA® certified trainers, training material, training organisations and exam organisations.
  9. ECQA® GmbH keeps all communications with the training organisation confidential.
  1. Duties of the Training Organisation
  1. The training organisation complies with all quality requirements for ECQA® Certified Training Organisations and their Trainers (see Annex 1_Rules and Process Steps for the Certfication of ECQA® Training Organisations and Annex 2_Rules and Process Steps for Certification of ECQA® Trainers.
  2. The training organisation agrees to pay fees (see below, Chapter 5) for regular audits by independent ECQA® auditors to get and maintain the status of an ECQA® Certified Training Organisation, including the certification of trainers working for or commissioned by the Training Organisation (see Annex 2).
  3. The training organisation only uses ECQA® Certified trainers when holding ECQA® Certified trainings and related courses.
  4. If the training organisation uses its own Training Material, the organisation must comply with ECQA® Training Organisation Rule 2: »The training organization can prove that the set of training amterials covers all performance criteria of the skill card« (see Annex 1).
  5. The training organisation uses the ECQA®logo in all promotional materials where ECQA® Certified courses related to job role <name of the job role>are announced.
  6. The training organisation is fully obliged to use the ECQA® exam servers and to explainall trainees who participate in ECQA®Certified Trainings for the job role <name of the job role>how to use and register for therespective ECQA®self-test, exam, capability adviser and (if applicable) learning platform.
  7. The training organisation is obliged to send to ECQA®:

a)date and hour of an exam 2-3 weeks prior to the exam;

b)a list of attendees who registered for the exam;

c)a copy of feedback from course participants to allow quality control of ECQA® Certified trainings and course.

  1. The training organisation keeps all data exchanged with ECQA®confidential.
  1. Certification and Re-Certification
  1. ECQA®GmbH will decide on the issue of the certificate based on the audit findings and conclusions of the ECQA®Auditor.
  2. ECQA®Auditors are formally trained auditors who have in-depth knowledge about ECQA®Quality Standards and the Rules and Process Steps for the Certfication of ECQA®Trainers and Training Organisations (Annex 1 and 2).
  3. The certificate is valid for a period of 3years subject that the conditions to maintain the certificate are met by the Training Organisation.
  4. To maintain the certificate, ECQA®GmbH will carry out surveillance audits (remote re-audits and, if necessary, also on-site audits) on a 1-year cycle.
  5. Withdrawal of certificates. The certificate becomes invalid immediately after termination of the contract by the certificate holder (the training organisation) or after withdrawal by the certification body ECQA®GmbH. The certificate is withdrawn by ECQA®GmbH when:

a)the conditions for issuing the certificate are no longer met,

b)the training organisation refuses to accept surveillance audits in due time,

c)the training organisation does not meet the requirements of corrective actions requested in the audit findings and conclusions,

d)the training organisation refuses to accept audits to check on corrective actions if required by ECQA®GmbH,

e)the training organisation uses the ECQA® certificate in an abusive manner,

f)the training organisation does not meet the General Terms and Conditions of ECQA®GmbH.

If the certificate is withdrawn, ECQA®GmbH informs the training organisation (certificate holder) thereof in writing. After withdrawal of an ECQA® Certificate any reference to the invalid certificate is not permitted.

  1. Finances
  1. The training organisation pays an annual certification fee + annual audit fee for the job role <name of the job role>commensurate to the size of the organisation. The fees are published at the ECQA Website and are valid for the current year (see Annex 3_Fees).
  1. Liability
  1. Each contracting party shall release the other from any civil liability in respect of damages resulting from the performance of this agreement, suffered by itself or by its personnel, to the extent that these damages are not due to the serious or intentional negligence of the other party or its personnel.
  2. If ECQA®s registered, protected name, logo or certificate has been intentionally been misused by a training organisation, ECQA® will take any necessary legal action to re-establish its reputation.
  1. Changes / Duration / Cancellation
  1. Changes to the contract require a written form, purely verbal agreements cannot be accepted.
  2. The contract is valid for 3 yearsfrom <start date to <end date>.
  3. The contract can be cancelled at any time from either side with a 3 moths notice. A cancellation requires a written form.
  1. Law
  1. Austrian law applies.
  2. The law court of Vienna, Austria, applies.
