AGRICULTURAL PRODUCTION PERMIT

This permit, contract number GELR – 2,3,4,5,5a,6 - 0 – 08 , is made and entered into this 1st day of January , 2008 between the Kansas Department of Wildlife and Parks, herein after called the “Department”, and , herein after called the “Permittee”, WITNESSETH:

The Kansas Department of Wildlife and Parks by virtue of authority conferred by Kansas law and in consideration of the benefits issuing to the general public from the management of the wildlife resources of Kansas, hereby lets to the Permittee for specified agricultural activities for the term of One (1) Year beginning January 1 , 20 08 and ending December 31 , 20 08, in the following described property situated in the county of Mitchell , in the State of Kansas:

Tracts #2 – Trestle, #3 – County Line, # 4 - Oak Creek, # 5 – Airport, #5a – Cawker City, and #6 – Granite Creek; on Glen Elder Wildlife Area - as shown on the attached Tract maps

This permit shall be renewable for a maximum of two consecutive terms only by consent of both parties. The maximum term of any permit shall be for five years. Obligations imposed upon permittee are binding and may be enforced by the Department not withstanding termination of this agreement.

THIS PERMIT is granted subject to the following provisions and conditions:

PERMITTEE SHARE RATE

The Permittee agrees to complete the terms of this permit and to compensate the Department for use of this property as follows:

B. AGRICULTURAL ACTIVITIES
(1) / The agricultural activities for each year will be agreed upon annually on the Annual Permit which when
signed by the permittee, then becomes part of this agreement.
(2) / It is understood that the Department is using agricultural agreements solely to further wildlife benefits
on the project lands and that specified agricultural practices and conditions may differ from those common
in the private sector.
C. DEPARTMENT
(1) / The Department agrees to furnish the property previously described only for such agricultural uses as
provided in this permit.
(2) / The Department reserves the right for itself and the United States Government, their representative,
officers, agents, or employees to enter upon permitted property at any time and for any purpose.
(3) / The Department and the United States shall not be responsible for damages to property or injuries to
persons which may arise from or be incident to the use, cultivation, or occupation, of the permitted
property, nor for damages to the property of the Permittee, nor for injuries to the person of the Permittee
or Permittee's officers, agents, or employees, or others who may be on the permitted property at their
invitation or the invitation of any one of them for injury or damage arising from or incident to flooding or
State and/or Federal activities; and the Permittee shall hold the Department and/or the United States
harmless from any and all such claims.
(4) / The Department reserves the right to take any field out of production that it deems necessary to meet
Area management objectives.
(5) / The Department reserves the right to contract agricultural activities with persons other than the
permittee if required to assure performance of conditions under this permit.
D. PERMITTEE
The Permittee agrees to:
(1) / Furnish all supplies, machinery, equipment and labor necessary to achieve the purposes specified in the
Agriculture Production Permit and the Annual Permit
(2) / Control noxious weeds on leased cropland acreage unless otherwise designated on the Annual Permit.
Control methods shall be approved by the manager and comply with State Noxious Weed Division
guidelines.
(3) / Use standard soil testing methods prior to any fertilizer application.
(4) / Pay all expense of other work hired or done by the permittee on the area.
(5) / The State's crop share to be harvested will be delivered to market without any expense whatsoever to the
Department.
(6) / State crop shares not to be harvested will be designated on the tract maps and/or the manager prior to
harvest.
(7) / Notify the manager of any crop harvest on the permitted property including the total quantity harvested
Within two weeks after harvest on the agency harvest report form.
(8) / Meet planting and harvesting dates as specified.
(9) / Keep agency fences and other improvements in good repair and conditions during the term of the
agreement, and keep access gates closed when not in regular use.
(10) / Failure to establish or harvest any crop due to permittee negligence shall result in an acre/acre reduction
for the state's share of the crop in the permittees share of the crop in the permittees share of another
crop unless failure is related to factors beyond the permittees control.
(11) / Obtain prior written permission from the manager on Department lands to:
a. / damage or remove any vegetation
b. / burn, hay, bale, harvest or otherwise remove any crop residue or vegetation
c. / till any land not specified for tillage
d. / Graze or place any livestock
e. / Apply any chemical
f. / Make any change in crops and/or permit conditions
(12) / Control soil erosion as completely as possible by cooperating fully with conservation practices
that the Department may direct and maintain certification on all cropland acres with the appropriate
consolidated farm service agency office.
(13) / Agricultural Activity reports will be updated after each practice and an annual summary will be delivered
to the manager by November 30.
(14) / The permittee shall not, transfer, assign or sublet this permit, nor grant any interest privilege, or license
whatever in connection with this permit.
(15) / Cooperate fully in programs for the enhancement of fish and wildlife and understand the permitted area
is open to the public unless otherwise posted by the Department.
(16) / Farm the land himself or with employees.
(17) / Be monetarily liable for any damage or loss cause to permitted property by Permittee's activities or
negligence of activities outlined under this Permit and will exercise due diligence in the protection of
all resources and/or improvements on or part of such property.
(18) / Do all in his power to prevent and suppress wild fires on permitted property and immediately report any,
which he cannot suppress.
(19) / If it is determined by the Department or the United States that the land covered by this Permit or any
portion thereof, is needed for any purpose, the Permit may be terminated by the United States or the
Department upon thirty (30) days written notice to the Permittee.
(20) / The Permittee shall not do or omit to do, or knowingly suffer, or permit to be done by others, anything by
which act or omission, any person may be endangered or injured by the use of the wildlife areas and
shall save the United States, and the State of Kansas, harmless from any claim on account of an
personal injury or property damage by reason of anything done, or knowingly suffered or omitted to be
done by the Permittee, in its exercise of the rights and privileges granted by this Permit.
E. FORFEITURE OF PERMIT
Failure of the Permittee to comply with the terms and conditions of this Permit, or conviction of the
Permittee of a wildlife law violation shall be cause for revocation of this Permit.
F. HEIRS ARE BOUND
This Permit shall extend to and be binding upon the heirs, executors and administrators, and agents of
the parties of this Permit, except as herein provided.
G. MODIFICATION
This Permit may be modified by mutual agreement of the parties in writing. IN WITNESS THEREOF

SPECIAL CONDITIONS

CROP SPECIFICATIONS:

These specifications are to be followed unless specified otherwise under the Special Conditions section or modified with an approved crop change form.

Cropland:

Small Grain

Wheat:

  1. Field tillage will be performed as needed to prepare a good seed bed and control noxious weeds. Wheat acreage may be planted with conventional methods.
  2. Soil fertility tests will be made and fertilizer applied accordingly.
  3. Planting in refuge areas must be complete before September 10 (these areas will be noted on tract maps) other fields must be planted by October 15.
  4. Chemical weed control in wheat/fallow fields will only be allowed with manager approval and will be restricted to only special circumstances when significant crop loss is eminent. In continuous crop fields agency approved chemicals can be used for weed control.
  5. Unless designated otherwise on the tract map, 3 % of the agency’s share will be left unharvested in the margin of each field.

Row Crops:

  1. Field preparation for sunflowers shall be complete by March 20; April 15 for corn; May 15 for cane and milo but tillage will be initiated prior to April 1. A good seedbed must be prepared prior to planting.
  2. Corn acreage will require no-till farming practices in combination with chemical weed control in production fields and in fallow fields planned for production. Contact the Glen Elder Wildlife Area manager for an approved chemical list.
  3. Soil fertility tests will be made and fertilizer applied accordingly.
  4. Sunflowers will be planted by April 1; Corn by May 1, Cane, Soybeans and Milo by June 1.
  5. Harvest of sunflowers will not occur until after the second week of Dove Season (Sept. 14) unless approved by the Manager. Unless noted otherwise, 20% of the agency’s share will be left unharvested as designated by manager The agency may mow it’s share for dove management
  6. Harvest of other row crops will be complete before the second week in November unless designated otherwise on the tract maps. Unless noted otherwise, 20 % of the agency’s share will be left unharvested in the margin of each field or as designated by manager.
  7. Food plots may be designated on the tract maps, planted by KDWP, and 100% of the crop will be left unharvested.
