NOTIFICATION OF DRAFT MEASURE UNDER ARTICLE 57 OF LAW NUMBER 5/2004, OF FEBRUARY 10thas written by the Law number 51/2011, of september 13th

(CONSISTENT WITH ARTICLE 7, NUMBER 3 OF DIRECTIVE 2002/21/ECas written by the Directive n.º 2009/140/CE)

  1. On April 16th, 2015, ANACOM Board of Directors approved the draft measures concerning the relevant product and geographic market definitions, significant market power assessment and imposition, maintenance, amendment or withdrawal of regulatory obligations regarding themarket on wholesale voice call termination on individual mobile networks as well as the cost model developed in the framework of the price control obligation imposed on SMP operators on those markets.
  2. On the same date,it was approved torequest the opinion of the National Competition Authority (Autoridade da Concorrência), according to article 61 of Law number 5/2004, of February 10th, as written by the Law number 51/2011, of September 13th (from now on LCE). It was also approved the launch of a public consultationbefore final decision according to article 8 of the LCE, as well as the prior hearing of interested parties provided for in articles 100 and 101 of Código do Procedimento Administrativo.
  3. The public consultation and the prior hearing of interested parties took place between April17th and May 25th, 2015 and ANACOM received answers from six entities.
  4. On 28th May 2015 the National Competition Authority informed that it did not have any objections to the relevant product and geographic market definition and to the SMP assessment performed, considering that the analysis is suitable and consistent with the competition law. In what regards the obligations the Competition Authority considers that their necessity, appropriateness and proportionalitywas proven by ANACOM. In particular, regarding control price obligation it considers suitable to maintain the pure LRIC cost model.
  5. After analysing the comments received from the interested parties,
    ANACOM Board of Directors approved, on July1st,2015,the draft decisions as well as the reports on the prior hearing of interested parties and public consultation.
  6. On the same date, ANACOM, according to number 1 of article 57 of LCE and according to number 3 of ANACOM consultation procedures, approved by decision of February 12th, 2004, and within the context of number 3 of article 7 of Directive 2002/21/EC, of the European Parliament and of the Council, of March 7th, as amendedby Directive 2009/140/CE, approved the launch of the specific consultation procedure making the draft measure available to European Commission, BEREC (Body of European regulators for Electronic Communications) and the national regulatory authorities in other Member States, together with the reasoning on which the measure isbased.
  7. As required by the Commission Recommendation 2008/850/CE, of October 15th, regarding notifications, time limits and consultations provided for in article 7 of the Directive 2002/21/EC, of the European Parliament and of the Council, of March 7th, the main document is accompanied by a summary notification, which was drafted in accordance with Annex 1 of that Recommendation.
