Important information

Please read this section before completing the Consent to electronic service of notices and other documents.

  • You can use this form to give consent to notices and other documents being served to your nominated email address. You do not need to use this form if you have already given this consent:
  • as part of a written tenancy agreement, or
  • separately in writing (for example, in a letter or email).
  • You should only consent to electronic service if you check your emails regularly.
  • If there is more than one tenant on the lease, all tenants should agree on a single email address for electronic service. This will help ensure co-tenants receive notices and other documents at the same time.
  • The landlord and tenant/s should keep signed copies of this form for future reference.
  • Tenants/landlords must notify the other party immediately if their email address changes.
  • You can withdraw your consent to the electronic service of notices and other documents at any time, by notifying the other party in writing.
  • The Electronic Transactions (Victoria) Act 2000 applies to notices and other documents you send or receive electronically. For legal purposes, the time when a notice is received is when it can be retrieved fromthe email address the recipientnominated.
  • If you need advice on your rights and responsibilities, call the Consumer Affairs Victoria Helpline on 1300 55 81 81 before you sign this form.

2.Inferred consent

If the TENANT or the LANDLORD (as the case may be) have not consented to electronic service under clause (1), the TENANT
or the LANDLORD must not infer consent to electronic service merely from the receipt or response to emails or other electronic communications.

3.Change of electronic address

The TENANT or the LANDLORD must immediately give notice in writing to the other party if the email address for electronic service under clause (1) changes.

4.Withdrawal of consent

(1)The TENANT or the LANDLORD may withdraw their consent under clause (1) to electronic service of notices and other documents only by giving notice in writing to the other party.

(2)Following the giving of notice under paragraph (a), no further notices or other documents are to be served by electronic communication.
