CONSENT TO APPOINTMENT AS

PRIVATE JUDGE

Comes now the undersigned, ______, and pursuant to Section 2(b)(1) of Alabama Legislature Act No. 2012-266 (the “Private Judge Act”) consents to being appointed as a private judge for the above-referenced action as requested in the contemporaneously filed Joint Motion for Appointment of Private Judge. In support of my appointment, I confirm the following:

1.  I am qualified to serve as a private judge pursuant to the Private Judge Act.

a.  I served as a circuit court judge for ______County, Alabama from ______through ______and have since retired from the bench.

b.  I am admitted to the practice of law in Alabama.

c.  I am an active member in good standing of the Alabama State Bar Association.

d.  I am a resident of Alabama.

e.  I have registered with the Director of the Alabama Center for Alternative Dispute Resolution and the Director has verified that I am qualified to serve as a private judge.

f.  I affirm that I am not covered by the State of Alabama UJS general liability insurance policy and that the Administrative Office of Courts is under no obligation to provide me insurance coverage.

2.  I have entered into a written contract with all parties to this action and their attorneys designating me as a private judge in this action.

3.  I have taken and subscribe to the oath of office of a retired judge as prescribed in Section 12-18-7, Code of Alabama.

4.  I am aware of and will comply with the applicable provisions of the Canons of Judicial Ethics and the Alabama Rules of Court.

5.  I will maintain jurisdiction over all proceedings until the case is concluded.
