CONOY TOWNSHIP BOARD OF SUPERVISORS

MEETING MINUTES

FEBRUARY12, 2015

A meeting of the Conoy Township Board of Supervisors was held at 7:00 p.m. on Thursday, February 12, 2015, at 211 Falmouth Road. In attendance were Supervisors Stephen Mohr, Kevin McKain, John Shearer, Clyde Pickel, and Gina Mariani; and Assistant Secretary-Treasurer Kathy Hipple. Also in attendance was Solicitor Matthew J. Creme, Nikolaus and Hohenadel.

ORDER OF BUSINESS:

1. Meeting called to order by Chairman Mohr at 7 p.m. followed by the Pledge of Allegiance and a moment of silence.

2. Motion by Shearer to approve Minutes of January 5, 2015BOS Meeting; Second by Pickel; Motion carried.

3. Chairman – Announcements and additional agenda items:(i) Executive Session to discuss personnel to be held after adjournment of public session of meeting; (ii) there will be two periods for public comment during this meeting.

4. Secretary- Treasurer– (i) Areas of Responsibility forms to be filled out by Supervisors and returned to Shearer or Hipple; (ii) Motion by McKain to appoint Kathy Hipple as Right-to-Know Officer;Second by Mariani; Motion carried.

Correspondence: (i) DCNR accepting grant applications 1/14/15 – 4/16/15 for grant award to be made in 2016;

(ii) BOS approved Shearer investigating Zero Investment LED Lighting Retrofit;

5. Public Comment –No public comments were offered at this time.

6. Report of Committees / Officers:

a. Emergency Management–No report.

b.Bainbridge Fire Company–(i) 20 calls in January as follows: 11 in Conoy Township; 5 in Elizabethtown Borough; 1 in

West Donegal Township; 2 in East Donegal Township and 1 in Mount Joy Borough; (ii) Motion by Mariani to approve

request for Township to print (1400 – 1500 copies) and pay for postage to mail annual Bainbridge Fire Company fund-

raiser mailing; Second by Shearer; Motion carried. Pickel advised he will volunteer his time to complete this project.

(iii) Mariani to forward request to Fire Police from Officer Schmidt,PA Fish and Boat Commission

requesting fire police assistance on3/19/15 and 4/22/15.

c. NW Emergency Medical Services–(i) 10 calls in December 2014; total of 213 calls for 2014.

d. Police – Minutes from January 6, 2015 meeting are available.

e. TMI –No report.

f. Waste to Energy Plant (Incinerator)– (i) Host fee for December 2014 $62,589.71; 34,772.06 Tons processed;(ii) 2014 – 2015 Comparison is available; (iii) Effective 1/1/15 Host Fee increased to $1.82 / Ton (2014 Rate was $1.80 / Ton).

g. Roads– (i) handled nuisance snow storms by salting and spreading cinders; (ii) Traveling from Turnpike Road to Covered Bridge new sign installed asking truckers to not use brake retarders on behalf of residents woken by noise.

h. Sewage Enforcement Officer–(i) Prepared end of year report; (ii) Inspection of Permit #Z124670 – Greg Miller.

i. Sanitary Sewer– (i) Three delinquent account holders have set up payment plans.

j. Solicitor– (i) Draft Ordinance – Street Sweeping / Snow Emergency Routes. After on-going discussion Tony Heisey recommended sending out a survey to residents involved on Second and Race Streets, Bainbridge. BOS agreed.

(ii) Motion by Draft Ordinance for PSATS HealthInsurance Trust; Motion by Shearer to authorize review by Solicitor and advertise for consideration of adoption at March BOS Meeting; Second by Pickel; Motion carried.

k.Zoning Officer– (i) Report is available.

l. Buildings– (i) Mohr reported security lights were installed at 2419 River Road and 211 Falmouth Road municipal buildings.

m.Personnel –No report.

n. Parks and Recreation – (i) Mariani advised BOS of discussion at the NWLCRT Advisory Committee meeting of

potential use of parking at mobile home park for NWLCRT users. Shearer recommended the potential use of Band Hall parking lot; Mariani to take lead on contacting the Band. Mohr recommended along Front Street to widen car width that parking would be available from Race Street to Market. (ii) NWLCRT Signage Agreements for tourism signs on State and local roads and on the trail. Solicitor will review agreements for potential signing in March.

o.Planning, Subdivision and Development– (i) 1/13/15 Memorandum received from LCPC regarding Proposed Amendment to the Donegal Region Comprehensive Plan by removing approximately 46.33 acres situated at 508 Pinkerton Road from the Urban Growth Area (UGA) scheduled for LCPC meeting on 2/23/15; (ii) 1/26/15 Letter from R Steven Dellinger, Hanover Engineering Associates Inc re: One additional EDU for sewer capacity for Robert Gruber Subdivision, 32 Locust Grove Road is available. Solicitor confirmed for Pickel that Township will not need to extend sewer. (iii) Notice from LCPC – Township will need to adopt SALDO before 1/1/16. Solicitor recommended BOS approve his office to work with Hanover Engineering for development of the ordinance. MPC allows cost past through

to developers; fee schedule will need revised. Motion by Mariani to authorize Solicitor to work with Hanover Engineering

Associates to develop SALDO; Second by McKain; Motion carried.

7. Financial Reports – FYI – See General Fund Deposit Detail, General Check Detail and Payroll Summary reports and Sewer Fund Deposit and General Check Detail reports for January 2015.

8. Motion by Pickel topay bills (See Unpaid Bills Detail Reports for General Fundfor1/7/15 (3); 1/14/15; 1/15/15;

1/21/15; 1/22/15; 1/28/15; 1/19/15; 2/9/15; 2/10/1/5 and 2/12/15; andSewer Fundfor1/20/15; 1/22/15 and 2/12/15;

Second by Shearer; Motion carried.

9. Old Business:None

10. New Business: (i) Bidding for road materials – Motion by Mariani to authorize advertisement of road material bids

prior to March BOS Meeting with potential bid opening for April BOS Meeting; Second by Shearer; Motion carried. (ii)

Inquiries have been received for purchase of new road signs. Mohr recommended setting up committee. Profits to be

split between Bainbridge Fire Company and Conoy Township Summer Playground Program. Mariani recommended

taking cost for original signs out of sales. Mohr advised donors have offered to pay for the original signs. Motion by

Shearer for Mohr to set up committee; Second by McKain; Motion carried. Solicitor advised BOS to remember bid limits.

11. Other Items and Public Participation: (i) Wendy Ruhl-Flerx, 101 Kissel Road, questioned BOS regarding new road

signs, Falmouth Park and plowing Kissel-Barrick Road. Responses were the cost for signs will be between $500 and

$700 with funds coming from the general fund. Mohr and Pickel responded that Falmouth Park was discussed forseveral

meetings last year and that the pond isfor stormwater retention andwas used this winter recreation for ice skatingand a

dry hydrant has been installed for access by the fire company for fire protection. (i) Emily Styer raised concernsregarding

the foodbank. Solicitor advisedthis was not a Township issue and the Township has no authority over the foodbank.

(iii) Tony Heisey asked if people calling about the signs had an issue with the signs or the price. Mariani responded she

received six calls regarding the signs with two against signs and price and there were four against the price. Chairman

Mohr asked if Township was willing to accept an anonymous donation for signs. Motion by Mariani to acceptanonymous

donation for purchase of original 14 signs; Second by Pickel; Motion carried.

12. Motion by Mariani at 8:07 p.m. to adjourn; Second by Shearer; Motion carried.
