HAMPTON FESTIVAL STALLHOLDER

CONDITIONS AND REGULATIONS

  1. PAYMENT

The Exhibitor (person or business named on the Expression of Interest and/or Site Contract) shall pay to the Organiser (High Country Festivals Inc), such amounts as nominated in the Site Contract on or before the dates specified. The Organiser reserves the right to refuse the booking and access to the site should full payment not be made by the due date.

  1. CHANGES TO THE FESTIVAL

The Exhibitor acknowledges that from the date of booking to the event, circumstances may arise which make it necessary for the Organiser to effect changes to the Festival. In the event of any such action, the Organiser shall have no liability for any amounts expended or expenses incurred by the Exhibitor and the Exhibitor shall take no action against the Organiser for damages as a result of any change.

  1. FESTIVAL HOURS

All sites must be operational for the entire duration of the Festival, 9.30am-4pm. The Organiser shall determine and may amend operating hours and set up times if deemed necessary.

  1. DISPLAYS SUBJECT TO THE APPROVAL OF THE ORGANISER

All sites and displays are subject to the approval of the Organiser. Displays are to be in keeping with the character, atmosphere and creative direction of the Festival and the Organiser reserves the right to reject any display deemed unsuitable. The Organiser is permitted to take photographs of the Festivaland reproduce these for future promotional purposes without prior permission.

  1. CLEANING

The Exhibitor shall be responsible to ensure the cleanliness and tidiness of its site at all times during the Festival. The Exhibitor shall be responsible for removing all rubbish from its site at the end of the Festival and leaving its site as found. If sites are not left clean, a cleaning fee may be applied.

  1. ENTRY

Exhibitors will be given an exhibitor pack prior to the Festival. The pack will contain entry passes (2 for restaurants/wineries/coffee vendors, 1 for market stalls), a site map, details of opening hours and set up times.

  1. STATUTORY REQUIREMENTS

The Exhibitor shall comply with all rules, regulations and requirements of the Organiser, or any government or semi-government authority or department concerning, relating to or affecting all regulations or directions issued by the Fire Department, Public Health Authorities (particularly in relation to food items) and Liquor Administration.

  1. INSURANCE

The Organiser shall not be under any responsibility or liability whatsoever for damages to stands or displays by loss, damage, theft, fire, flood, water, storms, wind, riots or acts of terror. The Exhibitor shall take out Public Liability Insurance for an amount not less than $10,000,000 for the duration of set up, during the Festival and pull down periods. A Certificate of Currency must be returned with full payment of site rental by the due date specified in the Site Contract.

  1. FOOD & LIQUOR LICENCE REQUIREMENTS (This applies to Restaurants/Wineries/Coffee Vendors only).

All food and beverage operators will need to have a Temporary Food Licence, unless exempt, and where alcohol will be served (by a Winery or other accepted business), a Mobile Liquor Licence. The Organiser reserves the right to request a copy of these permits at any time. It remains the Exhibitor’s responsibility to determine its permit obligations with Toowoomba Regional Council and Liquor Licensing.

  1. TASTING PLATES (Applies to restaurants only)

ALL Restaurants will be required to provide at least one (1) TASTING PLATTER to be sold for $5.00 each as part of their menu offering to patrons at the Hampton Festival.

  1. PRIVACY ACT

The Exhibitor authorises the Organiser to useits details (contact details, website) and photographs taken at the Festival for promotionaland other purposes as the Organiser deems reasonably appropriate.

  1. SIGNAGE

The display of advertising signs of any description is restricted to the area occupied by the Exhibitor. No selling or distribution of printed or other matter will be permitted outside the allocated exhibitor site. The Organiser reserves the right to remove any signage that has not been pre-approved, is outside the allocated area and/or attached to the marquee structure or that may conflict with existing sponsorship obligations.

  1. CANCELLATION BY EXHIBITOR

If the Exhibitor chooses to cancel the agreement more than 30 days prior to the date of the event, 70% of the paid fee will be refunded to the Exhibitor. There will be no refund of any fee when a cancellation is made by the Exhibitor within 30 days of the date of the event.

  1. CANCELLATION BY ORGANISER

The Exhibitor will not be entitled to any refund of fees or costs if the event is cancelled by the Organiser. Cancellation may occur from weather conditions, site conditions or external factors that would cause the event or site to become unsafe, inaccessible or unusable.

  1. ANIMALS

Animals other than registered Assistance Dogs are not permitted at the event at any time.
