Governance
  • Compliance with legislative obligations
  • Governance decision making support to Councillors and Officers
  • Cleaning and security management of Council’s service centres.

Municipal Laws
Administration and enforcement of legislation in the following areas:
  • Traffic control
  • Animal management
  • Local Law enforcement
  • School Crossing management
  • Prosecutions at the Magistrates Court

Position Objectives: /
  • Provide effective parking and traffic service through the enforcement, implementation and promotion of all Acts, Regulations and Local Laws as authorised by Council.
  • Provide advice and assistance to members of the community in regard to policies and legislation.

Key Responsibility Areas: /
  1. Parking and Traffic
  • Enforce parking regulations throughout the city by conducting patrols and issuing infringement notices.
  • Participate in programmed parking enforcement outside of normal working hours; including on-call and weekends on a rostered basis.
  • Inform and educate the community on issues relating to enforcement of parking regulations, local laws and other legislation relevant to the objectives and duties of the position.
  • Investigate complaints concerning alleged breaches of relevant Acts, Regulations and Local Laws and within broad Council policy and procedures, take action necessary to satisfactorily rectify identified problems.
  • Prosecute offenders, provide advice and education to ensure compliance with legislation and local laws relevant to the objectives and duties of the position.
  • Prepare evidence for prosecution, attend Court and give evidence, as necessary.
  • Promote a consistent and professional image on behalf of Council.
  • Ensure the appropriate administration and enforcement of the relevant acts, regulations and codes that are within the ambit of the role.
  • Deal with enquiries and complaints in respect to any of the above matters including alleged breaches of parking controls and rules.
  • Monitor in a methodical and consistent way, compliance with relevant Road Rules.
  • Appearas a witness representing Council at courts, tribunals and other hearings, as required.
  • Ensure all duties are performed in a manner that ensures personal health and safety of unit members and others in the workplace and the general public.
  • Provide support to the general operation of the Municipal Laws Unit and the efficient execution of the relevant functions.
  • Prepare relevant responses to issues raised in correspondence.
  • Keep up to date with changes to Acts and Legislation that affects all areas of the incumbent's responsibilities.
  • Attend training courses, seminars, conferences and meetings, as required to benefit the performance of the role.
  1. Animal Control (on-call after hours only)
  • Participate in animal management outside of normal working hours; including on-call and weekends on a rostered basis.
  • Administer and provide care of all impounded animals in compliance with the relevant legislation and Council policy.
  1. Customer Service
  • Ensure quality information, assistance and advice is given to other staff members and members of the public.
  • Respond to enquiries and complaints relating to parking breaches in a timely, effective and courteous manner under the direction of the Team Leader Traffic and Parking.
  1. Traffic Control
  • Ensure the safe effective movement of pedestrians and traffic and maximise the use of available parking spaces throughout the municipality by regular monitoring of restrictions and enforcing relevant legislationin regard to traffic and parking control and Council Local Laws.
  • Participate in programmed parking enforcement outside of normal working hours including weekend shifts as rostered by the Team Leader Traffic and Parking.
  1. Communication
  • Ensure, where possible, the timely and empathetic resolution of all breaches/disputes through effective communication, negotiation and mediation whilst adhering to relevant legal requirements.
  1. Administration
  2. Produce and maintain accurate records of all daily activities, investigations and inspections.
  3. Prepare reports and routine correspondence as required including CRM notes for administration input.
  4. Issue infringement notices in a timely, accurate and customer orientated manner and follow-up as required.
  5. Ensure all activities are completed in accordance with Municipal Laws established work practices and documented procedures.
  6. Legal Procedures
  7. Prepare summonses and investigation reports for the approval of the Team Leader Traffic and Parking prior to referral to courts.
  8. Attend Court as a witness, as required.

Accountability and Extent of Authority: /
  • Accountability and extent of authority is limited to own responsibilities and functions of members of the Municipal Laws Unit.
  • The position is responsible for providing accurate information to support management and external contractors.
  • Work generally falls within specific standards and procedures, but with scope to exercise discretion in the application of established standards, procedures and policies.
  • Effects of decisions and actions are usually limited to localised work group or function, individual jobs or clients, or to internal procedures and processes.
  • Adherence to the Council’s Working Together Working Better Policy.
The incumbent of the position is responsible for:
  • Setting daily priorities and organising workloads;
  • Maintaining a daily diary in which all work undertaken is recorded and signed by the Municipal Laws Team Leader;
  • Ensuring consistent enforcement of relevant Acts, Regulations and Local Laws in accordance with Council procedures and policies;
  • The care of items which have been impounded on behalf of Council whilst that item is under the control of Council;
  • Working in accordance with Council Patrol Plans or under the instructions of the Team Leader Traffic and Parking;
  • Commencing and finishing work at the Ivanhoe office in accordance with the shift rosters;
  • Ensuring that work practices undertaken are in accordance with occupational health and safety procedures and the reporting of matters which may affect health and safety issues;
  • Exercise of delegated powers for the issue of infringement notices under various Acts, Local Laws and Council Policies.
  • Representing Council in Court to prosecute or give evidence on behalf of Council, as required.

  • Is required to participate in the development of the Municipal Laws Unit.

Specialist Knowledge and Skill /
  • An understanding of Local Laws and relevant enforcement legislation and associated procedures and prosecution proceedings and relevant technology.
  • An understanding of the function of the position within its organisational context, including relevant regulations and precedents.
  • Proficiency in the application of standardised procedures, practices, Acts and Regulations, as well as an understanding of relevant prosecution procedures.
  • An understanding of the goals of the unit and an appreciation of the wider organisation goals and culture.

  • A working knowledge of relevant Acts, Regulations, Local Laws and Council Policy.

Qualifications and experience: /
  • Extensive experience in Municipal Law Enforcement or previous experience as an enforcement officer will be highly regarded.
  • Current Victorian Drivers Licence.
  • Commitment to the principles and practices of quality customer service.
  • Knowledge of statutory responsibilities,Acts and Regulations pertaining to the functions of the municipal laws department.
  • Basic level of computer literacy and personal computer experience with Microsoft Office software.
  • Sound numeracy and literacy skills.
  • Knowledge in the use of technology such as AutoCITE, digital cameras and mobile computing devices.
  • Ability to work effectively with supervision available.

Key Selection Criteria

  • Knowledge of, or ability to gain the knowledge of the Local Government Act, Road Safety Act, Road Rules – Victoria and Council's Local Laws.
  • Experience in, Traffic Enforcement, or related experience.
