Please keep in mind that this delegation requires that you carry out this procurement according to requirements of Section 518 of the Commonwealth Procurement Code (62 Pa. C. S. 518) and to the policies and procedures outlined by DGS in the Procurement Handbook.

Services:

This sole source is for maintenance of PETRL laboratory equipment required for reporting of equine drug testing for the Pennsylvania Horse Racing Commission. This maintenance agreement allows the supplier to keep the equipment maintained so that the equipment is proficient for future audits and testing needed. This also allows the equipment to maintain its accreditation status for timely drug testing.

Agency Summary:

The instrumentation at PETRL to be covered by this service contract is unique and proprietary to SCIEX. only manufacturer-certified technicians are able to meet the accreditation requirements for ISO 17025 item 5.5.1.2, which states: “Test and calibration equipment, including both hardware and software, shall be safeguarded from adjustments which would invalidate the test and/or calibration results.” SCIEX is the only company that sells this equipment and is the sole authorized provider of software updates, maintenance and repair services for these instruments and has no authorized third-party service providers.

Procurement Summary:

The following sole source will be approved because only SCIEX manufacturer-certified technicians are able to meet the accreditation requirements necessary to test and calibrate both the software and hardware and make any repairs necessary to the laboratory equipment. SCIEX does not have any authorized third-party service providers. SCIEX certified technicians must maintain this equipment so that it may maintain its accreditation status for timely equine drug testing. The Department of Agriculture has obtained a waiver from The Remi Group, LLC allowing them to procure maintenance services from the SCIEX who is the manufacturer of this equipment. This maintenance agreement will began on January 1, 2017 – December 31, 2020. The total cost will be $570,893.00. By entering into a four year maintenance quote The Department of Agriculture is receiving a 41% multi-year discount for the cores mass specs

and a 20% multi-year discount for the Shimadzu HPLC's.
