REQUIREMENTS/SPECIFICATIONS
Section1:Intent
Thepurposeofthisinvitationtobidistoestablishatermcontractfor AsphaltConcrete,other BituminousMixes,Laborrates, MaterialHauling,andEquipmentrental.Allmaterialsandservices shallbeprovidedinaccordancewiththecurrentODOT ConstructionMaterialSpecificationBook (C&MS) attime ofaward.
Section2:MultipleAward
ODOT willacceptallresponsivebidssubmittedonorbeforethespecifiedbidopeningdateand make an award toall responsive bidders pursuant toO.R.C.5513.02.
Section3:PlantLocations
Bidders may submit unit bid pricing formultiple plant locations in the same sealed bid package.
Bidders should complete an Excel pricing page forEACH plant location bid.
A separatepricing(excel)fileshouldbesubmittedforEACHplantlocationandallmustbeincluded on the required media device (i.e.CD, DVD, or Flash drive).
Section4:Contract Duration

TheDistrictTestingEngineerofthepurchasingDistrictwillprovidetheJMF forany301as referencedinthecurrentC&MSattimeofaward. TolerancesfromtheJMFof+/-0.50%forPG binderand+/-6.0%passingtheNo.4sievewillbeusedforacceptance. Districtsamplingwillbe atthedirectionof, andusingproceduresprovided,bytheDistrictTestingEngineer. Aminimumof onesampleper500tonsisrequired. Fororderslessthan500tons,onesampleisrequiredper purchase order.
TheContractor/ProducerwillprovidetheJMFforany448items. TheJMFwillbeapprovedby currentODOT procedures. Thecurrentrequirementsof403,441and448(qualitycontroland acceptancetestingincluded)willapplyfor purchaseordersofover3000tonsof448material. The Contractor/Producerwillbegiven48hoursnoticefromtheDistrictsohecanprepareforQC testing. Thecurrentsmallquantitiesguideline(SmallQuantityBituminousConcreteTestingand Acceptance)canbeused,ifapplicable,for purchaseordersover3000tons. Forpurchaseorders under3000tons,onlyanapprovedJMFfor448isrequired. Districtsamplingwillbeatthe directionof, andusingproceduresprovidedby, theDistrictTestingEngineer. Samplingfrequency will be atleast every 750 tons.

5.1Asphalt mixtures may be produced using the warm mix asphaltmethod according to402.09 except as restricted by specification.
5.2VendorNotes: Thiswillallowthevendortoprovideproductspecificinformationonanyitem(s)bid onthematerialpricingtab.Vendorwillnotusethissectiontoincludeadditionalconditionstoanyof the materials being supplied.
Section6:Non-ConformingMaterials andPrice Adjustments.
TheDistrictshallsavethesample(ifapplicable)andprepareareportforallmaterialsthat failto meet the applicable requirements ofspecifications.
Acopyofthetest report,priceadjustment,anddocumentationontheuseofthematerialshallbe sentbytheDistrictHighwayManagementAdministratorto theVendorwithin14calendardaysof the test.
WrittennoticemustbegiventotheVendor,whomayappealthepriceadjustmentwithin10 calendar days ofreceipt ofthe testreport and price adjustment.
IftheVendorappealsthepriceadjustment,theappealshallbesentbytheVendorto theDistrict HighwayManagementAdministrator. If thevendorandtheDistrictcannotresolvethedispute,the mattershall be forwarded tothe OfficeofContracts forfinal resolution.
FailuretofileanappealwithintheallottedtimeshallresultinawaiveroftheVendor’srightto appeal the price adjustment.
After theVendor’sappealtimehaselapsedandnoappealhasbeensubmitted,theDistrictshall processthepaymentforthematerialreflectingtheuseofmaterialthat hasfailedtomeetthe Department’s specifications.
Aminimumnon-conformancefeeof$300.00shallbeappliedtoalldeficientmaterialstest reports, unlessahigherappropriatedeductionisestablished. Ifthetotalbidpriceforthequantityisless than $300.00, then the minimum non-conformance fee shall be the total bid price.
The District shall include the appropriate adjustment in the material price as follows:
6.1LowBitumen Content
Ifa sample ofasphalt concrete or asphalt concrete base has a bitumen content below the specification limits, then the following formula applies:

6.2HighBitumen Content
The District Highway Management Administrator may accept, without a price deduction or administrativefee, asphaltconcretebasematerialproducedwithahighbitumencontent,provided the Contractor immediately brought the subsequent production into the specification limits and continued tocontrol the mix within reasonably close conformity tothe specifications.
If thematerialcontinuestobeproducedoutsidethespecificationlimitsorinconsistentcontrolofthe materialfollowingtheaboveallowancepersists,thentheDCEshallreviewtheperformanceof the materialtodetermineifthematerialcanremaininplace.Ifthematerialisallowedtoremainin place, then the pay adjustment shall be 5 percent ofthe purchase price ofthe in-place material.
6.3Bitumen Contentor 4.75 mm (No.4) Sieve OutsideRange
Limitation
Ifasampleof asphaltconcreteorasphaltconcretebaseisoutsidetherangelimitationspecifiedfor bitumen content or the 4.75 mm (No. 4) sieve, then the following formula applies:

Section7:Equipment
ODOTwilldirectthetimeandplaceoftheuseofthevendor’sequipment. Thevendor’soperators and other employees will be under the direction and supervision ofODOT.
Thevendorshallnotparkequipmentontheright-of-waywithoutapprovaloftheprojectsupervisor. All staging areas in the right-of-way mustbe approved by the project supervisor.
7.1EquipmentMobilization(F.O.B.Jobsite)
Theinitialmobilizationandfinalmobilizationareincludedineachpayitemforeachcontractunless the price page provides a lump sum mobilization pay item.
Onsite mobilization, transporting by tractorand low boy will be included in the initial mobilization forsite mobilizations oftwo (2) miles or less.Onsite mobilization, transporting by tractorand low boy, forsite mobilizations exceeding two (2) miles will be a per hour costbased upon bid prices.
Moving equipment - self-propelled moving ofequipment will be charged as operating time.
7.2Traffic Control
ODOT maychoosetoprovidetrafficcontrolorpaythevendortodosopervendorbiditems MiscellaneousTraffic ControlEquipment(PavingRelated),Flagger,FlaggerwithPickupTruck, or Maintaining ofTraffic.

Reasonably Available Control Measures (RACM), pursuant toOACrule 3745-17-
08(B), forfugitive dust emissions are tobe followed when performing:
1.Structural abrasive blasting
2.Surface cleaning ofconcrete and other highway surfaces
3.Concrete cutting
4.Asphalt cutting
5.Bridge deck preparation forresurfacing. Refer toSection 14 forGuide #57.
Section8:Payment
The“operatinghourlyrate”willbetheratethatthevendorwillbepaidfortheactualoperating hoursfor eachpieceofequipment. At thecompletionofworkattheendofeachday,thevendor andtheprojectsupervisorwillcometoanagreementonthenumberofhoursofworkperformed thatare tobe submitted forpayment.
8.1AsphaltPlacement
Per ton payment shall be based on the project quantity not the daily production. Per ton bid rate will applyto projectswhereapavementcourseisplaced.Projectsinvolvingrepairsonlyortherepair portionofanyprojectshallusethehourlyratesbid.(i.e., fullorpartialdepthrepairs) WhenODOT trucking is used, payment will be based on the hourly rates bid.
8.2Pavement Planing
Payment will be based on the Square-yard-inch milled for the project, not the daily accomplishment.Paymentformillingorpavementplanningusedtoperformbuttjoints,fullor partialdepthrepairs,orthelikewillbebasedonthehourlyratebid. WhenODOTtruckingisused, payment will be based on the hourly rates bid.
8.3AsphaltGrinding/Planing
Thisworkshallconsistofcold-planningasphaltmaterialfromvariouslocationsasdirectedby
ODOT.
Theworkcoveredbythesenotesconsistsof furnishingtheequipment,operatorsandnecessary supportfor removingasphalticconcretepavementtoadepthandcrosssectiondesignatedbythe Ohio Department of Transportation. In addition, removal may include butt joints at various locationsand/orportionsofintersectingstreetsasdirectedbyODOT.Paymentforthisworkwillbe paid atthe unit price bid forthe Square yard, one inch thick (Square-yard-inch).
Aftergrinding has been completed, the contractor will sweep the entire streetor roadway toremove allloosematerial. Anyequipment/laborrequiredfor trimworkaroundmanholes,valveboxes,etc. willbepaidfor bythehourlyratebid. Thestreet/roadwaywillbereadyfor asphaltplacementafter grinding is complete.
All grindings become the property ofthe contractor.
ODOT.andthecontractorwillmeasureandrecordthenumberofsquareyardsandthethickness
(depth) ofthe ground area.
Minimum milling depth will be 1" forbilling purposes.
Thecontractorwillbepaidattheunitpriceofonesquareyardoneinchthick (Square-yard- inch)
8.3.1 Example:
Bid price= $5.00 per square-yard-inch
Area milled= 3000 square yards
Depth milled =1-1/2"
Square-yard-inches= 3000 x 1-1/2 =4500 square-yard-inches
Payment =4500 x $5.00 =$22,500.00
Section9:Crack Sealing,Hot Applied
Thisworkshallconsistof thepreparationandapplicationof hotappliedcracksealantto transverse andlongitudinalconstructionjointsandcracks.Workshallbeperformedinaccordancewiththe current C&MS book attime ofaward.
Section10:PrevailingWages
ThiscontractissubjecttoOhioPrevailingWageLaws,Chapter4115oftheOhioRevisedCode andthevendershallcomplywithallprovisionscontainedtherein.By signingthisbid,thebidder guaranteesthat theprevailingwagescaletobepaidtoalllaboremployedonthiscontractshallbe inaccordancewiththepublishedscheduleof theprevailinghourlywageandfringebenefits ascertainedanddeterminedbyOhioBureauofEmploymentServicesfor thecountyinwhichthe workisbeingperformed. Thecurrentprevailingwageschedulecanbefoundat thefollowingweb site and is incorporated herein.
The vendor shall compensate the employees on this contract ata pay rate not less than the hourly wage and fringe rate listed in the above link. Job classifications or labor rates may be modified by the Ohio Bureau ofEmployment Services when new prevailing rates are established.Overtime shall be paid atone and one-half times the basic hourly rate and the hourly fringe rate forany hours worked beyond fortyhours during a pay week. The vendor shall pay all compensation by company check tothe worker and fringe benefit program.
Thevendorshallpostormakeavailableto theemployeesonthecontracttheprevailingwages applicabletothisinvitationormaybelatermodified. Onthefirstpaydateofcontractworkthe vendor shall furnish each employee covered by prevailing wage a completed form whpw1512 in accordance with section 4115.05 Ohio Revised Code, showing the classification, hourly pay rate, fringes,andidentifyingtheDistrictPrevailingWageCoordinator(DPWC),ifsuchemployeesare not covered by a collective bargaining agreement or understanding between employers and bona fideorganizationsof labor. Theseformsshallbesignedbythevendorandemployeeandkeptin the vendor’s payroll files.
Thevendorshallsubmitto theDPWCorotherdesignatedDepartmentrepresentative,certified payrollsinaccordancewithsections4115.07and 4115.071(C)oftheOhioRevisedCode,three weeksafterthestartofworkandeverysubsequentweekuntilthecompletionofthecontract. Uponcompletionofthecontractandbeforethefinalpayment,thevendorshallsubmittothe DPWCafinalwageaffidavitinaccordancewithsection4115.07of theOhioRevisedCodestating thatwages have been paid in conformance with the minimum rates setforthin the contract.
PayrollsrecordsshallbemaintainedbytheContractorfortwoyearsafterthecompletionofthe contractandtheserecordsshallbeopento inspectionbytheOhioDepartmentof Transportation and the Ohio Bureau ofEmployment Services, Wage and Hour Division.
Truckdriverswhoareemployedto delivermaterialsto theprojectsiteareexemptfromprevailing wage except when the work performed is on the “site ofwork”.Site ofWork includes the following:
Thephysicalplaceorplaceswherethebuildingorworkcalledforinthecontractwill remain afterthe work is completed.
Job headquarters, tool yards, batch plants, borrow pits,etc.,provided they:
1.Arelocatedadjacent or virtually adjacent(withinaonemileradius)tothe site ofthe work described above.
**AND**
2.Arededicatedexclusively,ornearlyso,toperformanceofthe contractorproject;80%of thematerialstakenfromthesitemust be used forthe project.
Truck drivers who are Owner-operators are also exempt from prevailing wage. Owner-operators must haveapurchaseorbonafideleaseagreementcontractanddemonstratefinancial commitment,suchaspurchasingvehicleinsurance,gasoline,etc. AnOwner-operatorincludesa lessee of equipment, but there must exist a bona fide lease with evidence of independent contractorstatus. Aleasecallingforashareofrevenueswhilebeingused,orshorttermin duration (3-5 years), will not qualify forOwner-operator status.
Section11:LiquidatedDamages for LoadLimitViolations
Bysigning this bid, the bidder will be deemed tohave stipulated as follows:
I.Anyvehiclebeingusedtohaulmaterialsunderthiscontractshallbeloadedsoasnotto exceed the maximum weight limitations contained in Ohio Revised Code Section 5577.04 and Specification 105.12.
II.Anyvehicledeterminedtobeoverloadedshallbecausefortheassessmentofliquidated damagesto thevendor.Forthepurposeof assessingliquidateddamagesunderthis contract, thefollowingscheduleofmaximumgrossvehicleweightswillbeusedto determinetheextentof "overload"to whichdamageswillapply. Thisschedulewillapplyin all cases except where paragraphs (c) or (d) below apply;

Section12:Sub-Vendors
Anyuseof sub-vendorswillrequirewrittenpre-approvalfromtheDepartment. In addition,allsub- vendorinvoicesmustbesubmittedtotheDepartmentwiththevendor’sinvoice. TheDepartment will not pay any additional fees above those charged by the sub-vendor.

Whatarethereasonablyavailablecontrolmeasures(RACM),pursuanttoOACrule3745-17-
08(B),forfugitivedustemissionsfromthefollowingoperationsathighwayconstructionand maintenance projects:
1.Structural abrasive blasting,
2.Surface cleaning ofconcrete and other highway surfaces,
3.Concrete cutting,
4.Asphalt cutting, and
5.Bridge deck preparation forresurfacing.
Answer:
1) Structural Abrasive Blasting:
Structuralabrasiveblastinginvolvestheremovalofrust,scale,andoldpaintfrommetalsurfaces onbridgespriortorepainting.ThefollowingmeasureswillbeconsideredRACMfor these operations.
Anenclosureshallbeerectedto completelysurroundtheblastingoperation.Thisincludesthe areaaroundandunderneaththeoperation.Thegroundcannotbeusedasthebottomof the enclosure unless completely covered with plastic sheeting or a tarpaulin.
Theenclosureshallbeconstructedof flexiblematerialsuchastarpaulinsorcontainmentscreens which are specifically designed for this purpose, or of rigid materials such as plywood. All materialsshallbemaintainedfreeoftears, cuts,orholes.However,flexiblematerialusedforthe sidesof theenclosuremaybewovento containamaximumof 15%holesandaminimumof 85% material.Allseamsshallbeoverlappedaminimumof 6"andfastenedtogetherat leastat 12" intervals.Theverticalsidesof theenclosureshallextendcompletelyupto thebottomof thedeck onasteelbeambridgeanduptoatleasttheelevationoftheblastingoperationonatruss bridge. Bulkheads shall be used between beams toenclose the blasting area.
Alldebriswhichhasbeencollectedbythisoperationorwhichhasfallento thegroundshallbe' collectedandstoredatthebridgesitefor testing,evaluationanddisposal.Collectionandstorage servicesof anapprovedtestinglaboratoryshallbeobtainedto evaluatearepresentativesampleof theabrasiveblastingdebris(fromeachbridge)for theToxicCharacteristicLeachingProcedure (TCLP) Test.Sampling shall be done within the firstweek ofthe abrasive blasting.
AllsamplingandtestingshallbedoneinaccordancewithU.S. EPA PublicationSW8 846.Thetest resultsofexceedancesshallimmediatelybeforwardedtothelocalairagencyorOhioEPA District Officein whose jurisdiction the blasting project is taking place.
2) Surface CleaningofConcrete andOtherHighwaySurfaces:
A) Smooth highway surfaces:
Thesurfacecleaningoperationsonroughorsmoothhighwaysurfacesareperformedto prepare the surface prior tothe laying ofasphalt or concrete or as general cleanup ofthe work area.
Forsmoothhighwaysurfaces,thevacuumtruck hasbeenusedinthehighwayconstruction industryforthepastfewyearswithgreatsuccessbecauseoftheeffectivecleaningandthe speed thatthe surface areas can be cleaned.
Thevacuumtruckusesasweepingandvacuumingmethodofcleaningwithafiltercollectorand aninternalstoragebinto holdthecapturedparticulates.Thefiltersinthevacuumhaveto be cleanedandmaintainedat frequentintervals.Also,thevacuumandsweepingequipmenthaveto be in good repair forproper operation ofthe equipment.
Therefore,theuseofavacuumtruckingoodworkingorderandwithproperlycleanedfilters shall be the RACM forsmooth highway surface cleaning.
B) Rough highway surfaces:
Thecleaningof roughconstructionsurfacescanbeaccomplishedbydifferentmethods.In one method,avacuumtruck hasaflexiblevacuumhoseattachmentmountedontherearofthetruck. Thisvacuumhosecanbeusedfor removalofsurfacedustfromtheroughsurfacesanddeep crevices.Analternativemethodwouldbeto wetdowntheareaandhandsweepthesurfacedust. Either control method shall be used as the RACM forrough highway surface cleaning.
Theuseoftheairlance(blowingofcompressedair)shouldbeusedonlyafter thevacuumtruck and/orwettinghasbeenusedtocleanthesurfaceofasubstantialamountofthesurfacedirt. If not used in this manner, an excessive amount offugitive dust will be blown into the air.
For the general cleanup ofthe streetor highway, a streetsweeper has been used effectively. The street sweeperincludesawaterspraybarwhichwetsdownthestreet surfaceareaanda sweeper/vacuumwhichremovestheroadwaydirtto acontainmentbininthevehicle.Similarto thevacuumtruck,theuseofastreetsweeperingoodworkingorderandwiththewaterspraybar and sweeper/vacuum shall be considered the RACM forthis general purpose cleanup.
3) Concrete Cutting:
Concretecuttingoperationsperformedat highwayprojectsusediamondorabrasivediscsfor hand-cuttingoperationsandaVermeergrinderwheelmountedonaconstructionvehicleforlarge cutting or trenching operations.
Operatingexperiencehasshownthatahigh-speeddiamonddiscmust usewaterasalubricant, while an abrasive disc can be used in dry cutting. However, the abrasive disc using water results ineasiercuts. TheVermeergrinderwheelcanbeusedindryorwetcuts. Adrycutonthe Vermeer grinder wheel is also hard on the cutting teeth.
Theuseofwaterasacoolantlubricantforthecutterandasameanstokeepdowntheemission offugitivedustfromthecuttingoperationisnotonlyeffective, butalsoveryreasonableincost. Water isreadilyavailablefromnearbycitywaterlinefirehydrantsandalsofromwatertanktrucks that arecommonlyusedonhighwayconstructionprojects.Awaterstoragetankalsoisusually available on the Vermeer grinder vehicle.
Therefore,theuseofwaterinsufficientquantitiestowetthecutter, theimmediatesurrounding workarea,andthefugitivedustimmediatelyemanatingfromthecut shallbeconsideredasthe RACMfor concretecutting.As anoptionalcontrolmethod,ahoodorshroudsurroundingthework areawhichcontainstheemissionof fugitivedustmayalsobeconsideredastheRACMfor concretecutting.In thiscase,thesurfacedustcreatedbytheconcretecuttingshouldbepromptly cleaned from the surface as outlined in item 2.
4) AsphaltCutting:
Wetsawing,asusedinconcretecutting,hasproveneffectiveinthecuttingofasphaltaswellas inthesuppressionofdust.TheuseofwetsawingshallbeconsideredtheRACMforasphalt cutting.
A vacuum/filterdustcontroloptioniscurrentlybeingexaminedbytheOhioContractors Association.ShouldOEPAdeterminethisoptiontobeaneffectivedustsuppressiontechnique,it will be included in this Engineering Guide.
5) BridgeDeck Preparation for Resurfacing:
Thefirstphase,millingorscarification,involvesgrindingdowntheupperlayersoftheconcrete surface.Thewastes,ormillings,arethenremoved.Thesecondphaseof therehabinvolvesthe majorbreakingout(jackhammering)andminorbreakingoutof theareasof delamination. (Delaminationisatermusedfortheconcretethat has,throughdeterioration,lostcontactwiththe metalreinforcementrods(rebar)inthebridgeroadbed.)After themajorbreakingoutofthe delaminated areas, the waste materials are removed. Major breaking out is followed by minor, breakingout. Minorbreakingoutinvolvessmallerareasofdelamination,isusuallydonemanually, andgenerateslesswastematerial.After minorbreakingout,thewastematerialsarecleanedup. Thefinalphaseinthepreparationfor resurfacingisthebridgedeckandrebarcleaning.The purpose ofthe cleaning is toremove all grit and debris from the deck, and any scale from the rebar.
A) Deck milling or scarification:
The vacuum truckhas been shown tobe an effective means ofcleaning milled surfaces. Therefore, theuseofavacuumtruckingoodworkingorderandwithproperlycleanedfiltersshallbethe RACM forthe milling or scarification process.
B) Major and minor breaking out ofdelaminated areas:
Thecleaningofdelaminatedareascanbeaccomplishedwiththeuseofavacuumtruck.The flexiblehoseattachmentontherearofthetruck canbeusedtocleanuplargepiecesofdebris, andthebellysweepingandvacuumingcanbeusedto cleanthedecksurface.Therefore,theuse ofavacuumtruck ingoodworkingorderandwithproperlycleanedfiltersshallbetheRACMfor major and minor breaking out ofdelaminated areas.
C) Final deck cleaning in preparation forresurfacing:
Originally,OEPA hadrecommendedthattheRACMforthisprocessshouldbetotalenclosure withtarps.However,variouscontractors,aswellasODOT, havecriticizedthismethodof control,citingthecost-effectivenessasaproblem.Theuseoftarpscanvastlyraisethecost of anoperationdueto theincreasedman-hours,aswellaslengthenthetimeinwhichtrafficlanes are closed.
Ina1994lettertoTomKalmanofOEPA, DonConawayofODOT hadproposedtheuseof "dustless"abrasivesasanalternativetototalenclosure.Thelettersuggestedtheseabrasives could be used effectively without causing a significant amount ofdust.OnOctober 18, 1995, ODOT demonstratedfor RAPCAtheuseoftheseabrasivesonaClarkCountybridge.RAPCAfoundthat the"dustless"abrasivesactuallycausedexcessiveamountsof dust(inviolationof the20%opacity limitsetinOAC 3745-17-07(B))and,therefore,determinedthatbeforethisdemonstration,OEPA hadalsorecommendedthat highpressurewaterblastingbeusedtocleantheexposedrebar. ODOT deniedthefeasibilityofthisprocess,claimingthatthewaterdidnotcleaneffectively.When askedabouttheuseofwaterwithabrasives,ODOTstatedthatthewaterwouldcausecorrosionon themetal,whichwouldtheninterferewiththeconcretebond.After thedemonstration,RAPCA asked ODOTfortechnical data supporting these claims.
Inresponse,ODOT discoveredthatsomeresearchhadshownthataslightcorrosionleftby moistureonacleanbarhadactuallyimprovedtheconcretetometalbond.ODOThassince decidedto changetheircontractorspecificationsto includewaterblastingsupplementedby abrasives.Allowingthecontractorsto usethisprocesswillenablethemto achievecompliancewith the applicable air pollution control regulations.
AsaresultofthesecommunicationswithODOT,thefollowingmeasureswillbe considered the RACM forthis cleaning operation:
Sandblastingfollowedbyairlancinghasbeenshownto effectivelyremovescaleandcorrosion fromrebar,andiscapableofthoroughlycleaningallareasofthedeck.RACMfor thismethod shallbetotalenclosureof thebridgedeck.Thebridgedeckenclosureshallmeetthe performance specifications outlined under structural abrasive blasting.
Alternatively, high pressure water blasting or water blasting supplemented by abrasives (includingsand)willalsoeffectivelycleanthebridgedeckandexposedrebar.Thesemethods donotproduceexcessivefugitivedust, providedasufficientamountofwaterisutilizedwhen abrasivesareemployed.Therefore,theuseofhighpressurewaterblastingorwaterblasting supplemented by abrasives shall be the RACM forfinal deck cleaning.
Equivalent alternative control methods may be used in all cases, where appropriate. The equivalencyofalternativecontrolmethodsfor fugitivedustshallbeevaluatedbythelocalair agencyorDistrictOffice oftheOhioEPAuponappropriateconsultationwiththeDivisionofAir Pollution Control. Adetermination ofequivalency forRACM should be made in writing.
It should be noted thatOACrule 3745-17-07 (B) (1) is applicable to the fugitive dust generated by the above-mentioned highway construction and maintenance projects. This paragraphestablishesanallowablevisibleemissionlimitationof 20%opacity,asa3-minute average. Any RACM employed mustbe capable ofmeeting this visible emission limitation.

Theintentofthissectionistoobtainloadedandunloaded(deadhead)permilepricingfor various sizesoftruckstohaulroadsaltorgritsfromasaltstockpile,saltmine,oraggregateplantlocation toODOTlocationsaroundOhio.Thissectionmayalsobeappliedforthetransportationofroadsalt from one ODOTfacility (stockpile) toanother ODOTfacility (stockpile).
Alongwithitsbidfor theabovepermilerates,avendorshouldalsosubmitapriceperhourfor wait timethat shallbeusedtocompensatethevendorfortimespentinqueueatastockpile,saltmine, or ODOTlocation waiting tobe loaded.
ODOTacknowledgesthatthissectionisbeingbidbythevendoronan“asavailable”basisand shallnotholdthevendorresponsibleifunavailableto performrequestedtruckingservicesdueto the unavailability oftrucksand/or trucking hours.
