Commissioner Hayashi welcomed everyone.

Business Items:

R6616-2-3 Safety Codes and Rules for Boilers and Pressure Vessels.

Rick Sturm explained that the proposed amendment adopts the most recent revisions to national boiler and pressure vessel standards established by the American Society of Mechanical Engineers (ASME) and the National Board of Boiler and Pressure Vessel Inspectors (National Board). He explained that these revisions are minor in nature.

No public comments have been received.

The Commission will go forward with this rule change.

R616-3-3 Safety Codes for Elevators.

Mike Pedersen explained that this rule change adopts the recent revisions to national elevator engineering and safety standards established by the American Society of Mechanical Engineers (ASME). He explained that by adopting these revisions, Utah will remain competitive with other states. All new elevators are being manufactured to these new standards. He also explained that it may appear that we are behind in adopting these codes, however, the codes are updated every three years. (i.e. 2010 revisions are published in about April 2011 and are open for public comment for 6 months, before states are able to adopt them. The next revision will be published in 2013.) The Division has received one comment from an elevator company in support of this rule change.

The Commission will move forward with this rule change.

R616-2-15 Deputy Boiler/Pressure Vessel Inspectors

Ami Windham explained that the current rule makes it mandatory to hold a hearing when it has been determined that a Deputy Inspector is unqualified, has violated inspection standards, or should be subjected to corrective action. This rule change makes a hearing mandatory only when there is a dispute between the Deputy Inspector and the Chief Inspector’s findings.

Public comments have been received in support of this rule change. The deputy inspectors approve of the change to make hearings only necessary when there is a dispute.

The Commission will move forward with this rule change.

Discussion was held regarding the cost of providing copies of the material adopted by reference to the Division of Administrative Rules. Sara will check with Administrative Rules regarding the filing of such material in an electronic format. Once Administrative Rules has answered the question, that answer will be distributed to all Divisions of the Commission.
