Commission Proceedings with Potential Overlap with the Community DG – Low Income Collaborative

NOTE:I would just like to point out some of the important filings made in this proceeding (15-E-0082) that some stakeholders focusing only on the low income aspect of this proceeding may not be aware of. Mainly, I’d like to draw your attention to the utility filings made on 11/9/15 regarding Community DG procedural requirements that, among other things, address protocols for transferring data between utilities and sponsors.

1) 12-M-0476 -Proceeding on Motion of the Commission to Assess Certain Aspects of the Residential and Small Non-residential Retail Energy Markets in New York State.

  • Also referred to as the Retail Access proceeding
  • Overlap:
  • Development of a protocol by which an ESCO can verify a customer’s low income status with the utility at the point of sale using a secure utility portal.
  • EDI working group (dealing with data exchanges).

2)14-M-0101 -Proceeding on Motion of the Commission in Regard to Reforming the Energy Vision.

  • Referred to as the REV proceeding.
  • Overlap:
  • General customer data issues being addressed here. This is an endeavor to address the data issues that have arisen in several proceedings in a consistent manner.
  • Generally, given the wide-ranging scope of REV, there are likely other areas of overlap (i.e. pricing structures and incentives) that are being addressed broadly in that proceeding, but those issues will need to be addressed in this proceeding specifically as they relate to low income participation in a Community DG program.

  • Overlap:
  • Developing eligibility and reporting requirements for sponsors.
  • Development of consumer protections for customers who implement DER
  • Including: protection of customer data, marketing standards, dispute resolution, content of contracts, and other protections.
  • Potential for development of standardized disclosure statements and/or certain standardized contract terms.

5)15-E-0407 -Petition of Orange and Rockland Utilities, Inc. For Relief Regarding Its Obligation to Purchase Net Metered Generation Under Public Service Law §66-j

  • The Order in this proceeding gives reference to additional process regarding development of a successor tariff for net metering. A proceeding has not yet been initiated, but will be in the near future.
