1 Purpose

1.1 The purpose of this procedure is to describe how to notify the Texas Department of Licensing and Regulation when a violation has been identified.

2 Scope

2.1 Violations are to be documented on the repair requirements form when a boiler is found to be in violation of the Boiler Law or Rules.

2.2 The repair requirements form is also used to report when repairs have been completed.

2.3 A repair requirement may be written during a certificate or non-certificate inspection.

3 General

3.1 The form to be used when violations are found or cleared, is known as TDLR FORM 007BLR (EXHIBIT 1). Use black or blue ink to complete this form.

4 Description

4.1 The procedure to follow when a violation is found, at the time a certificate inspection is being performed, is described below:

4.1.1 Complete the first or subsequent inspection form as described in AIA Procedure 2, 3, 5, or 11 whichever is appropriate.

4.1.2 Complete the Repair Requirements Form as described below:

(1)  Enter the Texas Boiler Number. Only use one boiler number per repair requirements form.

(2)  Check the block for Certificate Inspection.

(3)  Check the block for the type of inspection report being submitted (electronic or hard copy).

(4)  Enter the location name.

(5) Enter the location address.

(6)  Enter the location city/state/zip code.

(7)  Enter the location phone number.

(8)  Enter the location e-mail address.

(9)  Enter your name.

(10)  Enter the inspection date.

(11)  Enter the paragraph in the Boiler Law or Rules that governs the violation(s) you have identified.

(12)  Check the appropriate block for the item in violation.

(13)  Check the appropriate block recommended to rectify the violation.

(14)  Check the appropriate block(s) and complete the blanks necessary to give the owner/operator the specifications required for the repair.

(15)  Use this area to list requirements other than those in blocks 11-14 or to explain, clarify, or give directions on these areas.

(16)  Enter your name.

(17)  Enter your phone number.

(18)  Enter the number of days the owner/operator is given to correct the violation and notify the Inspector. (When required, a revisit must be scheduled to verify the corrective action.)

(19)  Enter the date you write the repair requirements form.

(20)  Have the owner/operator sign and date the form.

(21)  Sign your name and show your Texas Commission number.

4.1.3 Do not complete the balance of the form.

4.1.4 Attach the pink copy to the inspection report and submit it to TDLR for processing.

4.1.5 Give the yellow copy to the owner/operator.

4.1.6 Retain the white copy for follow-up.

4.2 If a boiler is found to be in violation and a certificate inspection is not being performed, take the following steps.

4.2.1 Complete the repair requirements form as described in 4.1.2 of this procedure, except in block (2), check non-certificate inspection.

4.2.2 Give the yellow copy to the owner/operator.

4.2.3 Send the pink copy to TDLR for processing.

4.2.4 Retain the white copy for follow-up.

4.3 When the time frame for the repairs has been met, revisit the location, if required, to verify the corrective action.

4.3.1 On the white copy of the repair requirements form you retained, check the appropriate blocks in the COMPLETED section (22) to report whether the requirements were corrected. If the repair was done with pressures, capacities, types, etc., other than recommended, show the information for the newly installed item.

4.3.2 In section (23), give the disposition of the repair by checking the appropriate block. If the repair is in progress, i.e. a safety valve is on order, etc., check the block to extend the time for the repairs by checking that block, enter a new completion date and sign in the block immediately below the extended date. Do not complete the next two steps.

4.3.3 In section (24), have the owner/operator sign and date the form.

4.3.4 In section (25), put your signature, Texas Commission number and the date you verified the repairs.

4.4 If the time was extended, send a copy of the white repair requirements form to TDLR to update the records. Perform the steps in section 4.3 again to recheck the repairs when the extended time frame has been reached.

4.5 Send the completed white (original) repair requirements form to TDLR for processing. Should you need additional information, contact TDLR at (800) 722-7843 or (800) 803-9202.
