“Allegany County Economic Development Incentive Program”

“AN ACT TO ESTABLISH AN ALLEGANY COUNTY ECONOMIC DEVELOPMENT INCENTIVE PROGRAM, CHAPTER 300, OF THE

CODE OF PUBLIC LOCAL LAWS OF ALLEGANY COUNTY, MARYLAND (2011 EDITION AS AMENDED), ENTITLED “ALLEGANY COUNTY ECONOMIC DEVELOPMENT INCENTIVE PROGRAM”

BE IT ENACTED BY COUNTY COMMISSIONERS OF ALLEGANY COUNTY:

Section I.

WHEREAS, the Board of County Commissioners of Allegany County, Maryland, wish to establish an Incentive Program to encourage economic development in the technology sector and to encourage new employment in Allegany County.

NOW, THEREFORE, Chapter 300 of the Code of Public Local Laws of Allegany County, Maryland (2011 Edition, as amended), is hereby enacted to read as follows:

SECTION II.

Chapter 300

Allegany County Economic Development Incentive Program

§ 300-1. Applicability of Program.

A company wishing to locate in Allegany County may apply for an Allegany County Economic Development Incentive as provided for herein.

§ 300-2. Qualification.

A.To qualify, a company must be a new company to Allegany County providing new employment. Provided, however, that the incentive shall not apply to the following businesses or industries:

1. Tourist or Convention Services;

2. Retail;

3. Warehousing;

4. Restaurants; and

5. Financial and Insurance Institutions (except for Information Technology or

Data Processing Operations).

B.To qualify for the tax credit, the company must employ at least three new full time employees, which cannot include owners of the company or principals of the company. Employees must reside in Allegany County within one year of their hire and must be residents of Allegany County at the time the credit is received by the company.

§ 300-3. Employment Incentive.

A.The Employer shall be entitled to the following incentives:

1.For three to ten new full time employees, $3,000 per employee

2.For each full time employee in excess of ten, $2,000 per employeeup to 25 employees.

B.The company must apply for the credit and prove that the employee is full time (working in excess of 35 hours per week), has been on the payroll for at least one year, and is residing in Allegany County at the time the credit is to be paid. Minimum salary for incentive award to be $45,000 per year.

§ 300-4. Additional Terms and Conditions.

Companies, to be eligible, must be new companies to Allegany County.

§ 300-5. Enforceability and Regulations.

The Allegany County Commissioners, from time to time, shall promulgate regulations to carry out the terms and conditions of this Incentive Program.

§ 300-6. Effective Date.

This Incentive Program shall become effective October 1, 2016.

SECTION III.

All other provisions of the Code of Public Local Laws of Allegany County, Maryland (2011 Edition, as amended), ordinances, regulations, and orders, or parts thereof, inconsistent with the terms and provisions of this Bill, are hereby repealed.

SECTION IV.

AND BE IT FURTHER ENACTED BY THE BOARD OF COUNTY COMMISSIONERS OF ALLEGANY COUNTY, MARYLAND, that this Act shall become effective October 1, 2016.
