CLARK COUNTY COMMISSIONER PROCEEDINGS

August 20, 2013

The Clark County Commissioners met in regular session on August 20, 2013 in the Commissioners’ meeting room of the Clark County Courthouse. Chairman Hass called the meeting to order at 8:00 a.m. with the following Commissioners present: Bjerke, Reints, Wicks and Loomis. Also present Auditor Tarbox, Robert Saur.

MINUTES: Motion by Wicks, second by Reints, to approve the minutes from the August 6, 2013 regular meeting. All members voting aye. Motion carried.

HIGHWAY: HS Eggleston updated the board on road work being done and road conditions. He informed the board that decision for the grant applied for will not be made until November. This grant was for County Road # 7 west of the Industrial Park. He also informed the board that County Roads #3,4, 29 and 36 are out of water but will only receive minimal repairs at this time due to lack of funds. The complaint that had been made regarding farming in the right of way has been acted on.

AMBULANCE: Ambulance Administrator Grensberg met with the board with an update on status of hardship request and training session that staff will be attending.

BOARD OF ADJUSTMENT: Motion by Bjerke, second by Loomis to move into Board of Adjustment. All members voting aye. Motion carried.

HEARING: At 9:00 a.m. the time specified hearing was held for Conditional Use 10-13. Also present ZO Paulson. Donette Dunlavy and Fred Obermeier appeared. Motion by Wicks, second by Loomis, to approve Conditional Use 10-13 which will allow Donette Dunlavy to use Lots 4,5,6, & 7 Block 2, Ways Addn Crocker to place three (3) signs and livestock equipment for sale. All voting aye. Motion carried.

SET HEARING: Motion by Reints, second by Loomis to set public hearing September 3, 2013 at 9:00 a.m. for Conditional Use permit 11-13 for Drew Edleman of 43102 192nd St, Willow Lake, SD. This request, if granted, will permit the applicant to have an extended home occupation: to trade and sell firearms to the general public. All voting aye. Motion carried.

ADJOURN: Motion by Loomis, second by Bjerke, to adjourn from Board of Adjustment and return to Board of County Commissioners. All voting aye. Motion carried.

SAGE REQUEST: DOE Paulson, SA Fjelland met with the board to discuss the request for information from the Director of Equalization office from the “SAGE” company. No action taken.

AIR CONDITIONER: Custodian Elsen updated the board on the air conditioning unit.

WEED: Motion by Loomis, second by Wicks to allow Weed Supervisor Lynch to purchase a 2002 International truck for the weed department, purchase price $12,900.00. All voting aye. Motion carried.

TRAVEL REQUEST: Weed Supervisor Lynch requested permission for Paul Orris and Lynch to attend the South Dakota Weed and Pest meeting on September 11 and 12, 2013 in Sioux Falls. Travel request approved.

AUTO SUPPLEMENT: Motion by Loomis, second by Reints to approve auto supplement from state funds received to cover the expense of chemical for the weed department. $6300 from 101-0-334.1 to 101-615-426.20. Motion carried with all voting aye.

TAX DEED AUCTION: At 10:00 am the time specified. A public auction was held in the Courthouse for the following property.

Parcel #1: Lot 15, Block 4, Original to the Town of Bradley. Motion by Bjerke, second by Loomis to accept bid of Eric Caulfield in the amount of $800.00. All voting aye. Motion carried.

Parcel #2: Lot 11, Block 4, Original to the Town of Bradley- Motion by Wicks, second by Loomis to accept bid of Eric Caulfield in the amount of $875.00. All voting aye. Motion carried.

Parcel #3: Lots 13 & 14 Block 4, Harts Addition to the Town of Bradley. Motion by Reints, second by Bjerke to accept bid of Connie Merkel in the amount of $75.00. All voting aye. Motion carried.

Parcel #4: E8’ of Lot 4 Block 3 Scanlon’s Addition to the Town of Bradley. Motion by Bjerke, second by Loomis to accept the bid of Cassie Altfillisch in the amount of $48.00. All ayes. Motion carried.

Parcel #5: Lots 3 & 4 Block 2 Original to the town of Raymond. Motion by Loomis, second by Wicks to accept the bid of Ted Mehlberg in the amount of $3000.00. All ayes. Motion carried.

Parcel #6: Lots 14 & Except SW 18’ of Lot 15 Block 2 Johnsons Addition to the Town of Vienna. Motion by Wicks, second by Reints to accept the bid of Marvin Virchow in the amount of $150.00. Motion carried with all voting aye.

Parcel #7: W ½ of Lot 14 & All of Lots 15 & 16 Block 1 Haywards Addition to the Town of Garden City. Motion by Reints, second by Bjerke to accept the bid of Farm Country Coop in the amount of $100.00. Motion carried with all voting aye.

Parcel #8: W25’ of Lot 3 All of 4 Block 2 Original to the Town of Garden City. Motion by Bjerke, second by Hass to accept the bid of Farm Country Coop in the amount of $300.00. All voting aye. Motion carried.

Parcel #9: Lots 12 & 13 & E ½ of lot 14 Block 1 Hayward’s Addition to the Town of Garden City. Motion by Reints, second by Loomis to accept the bid of $100.00 from Farm Country Coop. All voting aye. Motion carried.

Parcel #10: Lot 11 Except E 3’ & E3’ of Lot 10 Block 2 Original to the Town of Garden City. Motion by Loomis, second by Reints to accept the bid of $60.00 from Farm Country Coop. All voting aye. Motion carried.

Parcel #11: Lot 7 Block 1 Hayward’s Addition to the Town of Garden City. Motion by Wicks, second by Bjerke to accept the bid of $100.00 from Lucas Randall. All voting aye. Motion carried.

Parcel #12: Lot6 Block 1 Hayward’s Addition to the Town of Garden City. Motion by Reints, second by Wicks to accept the bid of Lucas Randall in the amount of $100.00. All voting aye. Motion carried.

Parcel #13: Lot 8 Co Auditors Plat to the Town of Garden City. Motion by Wicks, second by Loomis to accept bid of Anna Liebke in the amount of $100.00. All voting aye. Motion carried.

Parcel #14: Lots 3 & 4 Block 1 Original to the Town of Garden City. Motion by Wicks, second by Loomis to accept bid from Farm Country Coop for $1000.00. All voting aye. Motion carried.

Parcel #15: Lots 5 & 6 Block 1 Original to the Town of Garden City. Motion by Bjerke, second by Reints to accept bid of $125 from Farm Country Coop. All voting aye. Motion carried.

Parcel #16: E3’ of Lot 11 & West 22’ of Lot 12 Block 2 Original to the Town of Garden City. Motion by Wicks, second by Loomis to accept bid of $65.00 from Farm Country Coop. All ayes. Motion carried.

Parcel #17: Lots 5&6 Block 3 Baileys Addition to the Town of Garden City. Motion by Loomis, second by Wicks to accept the bid of $1250.00 from Jack Hansen, Jr. All ayes. Motion carried.

FIRST DISTRICT: Todd Kays from First District met with the board to continue with updates to the Planning and Zoning Manual.

WELFARE: WD Brandlee presented notifications of hospitalization.

2014 WAGE: Motion by Reints, second by Bjerke to allow the auditor to apply a 2% increase for the 2014 salary of all eligible department heads, deputies, clerks and highway department employees. Those excluded from the 2% increase are the Commissioners and the two employees whose wages were frozen in 2007. Voting aye Bjerke, Reints, Wicks, Hass. Abstain: Loomis. Motion carried.

HEARING: Motion by Wicks, second by Loomis, to schedule hearing for provisional budget for September 3, 2013 at 10:00 a.m. Motion carried with all voting aye.
