POLICY:4.20 PAIDFAMILYLEAVE
Full-timeemployeeswhoareeligible (baseduponsixmonths ofcontinuousservice) maybegrantedup tothirty(30) workdaysofleave,designatedasPaidFamilyLeave, forthefollowingpurposes:
i.the birthofyour childand in order to careforthechild;
ii.the placement ofa childwithyoufor adoption:
iii.to carefor yourspouse, son,daughter,orparentwhohasa serioushealthcondition
PaidFamilyLeavewill be administeredpursuanttothe MetroFMLA PolicyHandbookwith thefollowingspecificdirection:
a.The leave maynotbetakenforthe employee’sownserioushealthcondition.
b.For the purposes ofthis policy,“spouse” meansahusbandorwifeasdefined or recognizedinthe stateor placewherethe individualwasmarried and includesindividualsin alawfullyrecognizedsame-sexmarriage.
c.Inthe caseofbirthoradoption,MetroPaidFamilyLeavewill be availablestartingwith thedateofbirth, date ofadoption,ordatethat legal custodyisgranted.
d.The leaveshall run concurrentlywith,and becountedas, regular FMLA leave(iftheemployeeiseligibleforFMLA leave).
e.Employeeeligibilityisdependentuponsixmonthsofcontinuous, full-timeemployment (32hoursperweekor more).Part-time,seasonal,andprobationary employeesarenot eligibleforPaidFamilyLeave.
f.Ifan employeehasShortTermDisability insurance,PaidFamily Leavewillbetreated aspaidsickleave sothatemployeesmaynot receivepaidShortTerm Disability benefitsandPaidFamilyLeaveforthesametimeperiod.
g.A total of30PaidFamily Leavedaysmaybe taken.PaidFamily Leavecommencesonthefirst date leave is takenandmustbeconcluded nolater than twelve (12) monthsfrom thatdate. AnyPaidFamilyLeave nottakenduring thetwelve month periodjustdescribedshall notcarryover to anysubsequentFMLA yearorneedfor leave.
h.Forspouseswho arebothemployed byMetro,asdiscussedatSec. I(6) oftheMetroFMLAHandbook,eachspouseshall be entitledtothirty(30)daysofPaidFamily Leave.
i.TheTennesseeMaternityLeave Act,TN CodeSec.4-21-408,shallapplytoPaidFamilyLeave.Anemployeemaybeginchildbirthor bondingleave byusingPaidFamilyLeaveforthirty(30)daysandmayfollowsuch leave byusingregular FMLAleave(paid orunpaiddependingontheirindividual accrued leavebalances).Thecombinedleavejustdescribedmaynotexceed 12workweeksofleavepursuanttothe FMLA.The employee maythen usean additional 4 weeks of paid orunpaidleave,provided theyaredeterminedeligible totakeleaveundertheTennesseeMaternityLeave Act.
