BOARD OF ADJUSTMENT

MINUTES OF PUBLIC HEARING

HELD JULY 17, 2013

The Board of Adjustment for the City of Olmos Park, Texas held a public hearing at 4:30 p.m. on July 17, 2013, at City Hall. Members present were Melissa Phillips, Richard Specia, Lee Sandoloski, Sandra Hornberger and Dr. Carl Raba. Administrative Staff present were Celia DeLeon, City Secretary; James Raby, Building Official and Fire Chief Surber. Also present were Clare and Donald Duffin, 214 East Hermosa Drive; Greg Smith, Don McDonald Architects and Lauren Dibberto, Don McDonald Architects.

Chairman Melissa Phillips called the meeting to order at 4:30 p.m. and announced a quorum was present.

Administer Oaths of Office to re-appointed Board Members Melissa Phillips, Sandra Hornberger, Lee Sandoloski and newly appointed member Dorothy Jo Weiss.

City Secretary administered Oath of Office to re-appointed Board members Melissa Phillips, Sandra Hornberger, Lee Sandoloski and newly appointed member Dorothy Jo Weiss.

Elect Chairman and Vice-Chairman.

Sandra Hornberger nominated Melissa Phillips to serve as Chairman of the Board. Richard Specia seconded the nomination. The vote in favor of the nominations was unanimous by all Board members present.

Sandra Hornberger nominated Richard Specia as Vice-Chairman of the Board. Dr. Carl Raba seconded the nomination. The vote in favor of the nomination was unanimous by all Board members present.

Select two members to serve as alternates

Dr. Carl Raba and Lee Sandoloski were designated to serve as alternates.

Set time and day for regular meetings.

The Board agreed to schedule the Board meetings on the second Wednesday of each month at 4:30 p.m.

Approve minutes of meeting held May 15, 2013

Richard Specia moved to approve the minutes for meeting held May 15, 2013 as submitted. Sandra Hornberger seconded the motion. The vote in favor of the motion was unanimous by all Board members present.

Consider and take possible action on a request from Clare and Donald Duffin, 214 East Hermosa Drive, AKA CB5700 BLK8 LOT4 for a variance from City Code section [40-42(2)], side yard setback requirements and City Code section [40-42-(1)], rear yard setback requirements.

Clare and Donald Duffin propose to extend the existing garage by four feet, encroaching into the side yard setback 2.5 feet and build a bedroom addition to the southwest corner of the home, which would encroach into the rear yard setback by 2.5 feet.

The Board received letters in support of the variance request by:

Kathleen Gunn, 100 Alameda Circle

Dr. Carl Raba stated that there are two issues here, the garage and the personal experience of not getting a family vehicle into the garage. He said a 1920’s garage in a 1920’s residence is certainly a non-functional garage and a hardship. When you look into trying to move the new bedroom addition 18 feet towards heritage tree and I take a look at the orientation of the residence on an unusual lot, if added parallel to both of the property line it would fit very easily. Therefore, the hardship being the placement of the home on the lot and heritage tree, I move to approve the variance requested. Richard Specia seconded the motion. The vote in favor of the motion was unanimous by all Board members present.

There was no other business and the meeting adjourned at 4:47 p.m.
