TITLE:Amendments to Zoning Regulations; Penalty

PURPOSE:To adopt amendments to Zoning Regulations; Penalty,of the City Code of the City of Monticello.

WHEREAS, the Administration Department and the Police Department of Monticello City have a desire to streamline the burden of zoning violation enforcement while maintaining law and order within the city limits, and

WHEREAS, the City Council desires a clear process for zoning violation enforcement which helps to maintain law and order, and

WHEREAS, the City Council has expressed a desire to avoid the process of court, if possible, to minimize the cost of enforcement and prosecution for the tax paying citizens,

NOW, THEREFORE, be it ordained by the Monticello City Council:

Title 10-1-8, of the Zoning Regulations; Penalty, Section A.,of the City Code of Monticello is hereby amended as follows:

10-1-8: Penalty:

A.Classified: Any person, including but not limited to, in violation of the land use ordinance, firm, or corporation, whether as principal, agent, employee, or otherwise, who shall erect, construct or reconstruct any building which involves structural alterations or which involves an increase in floor area without first obtaining a permit therefor from the zoning administrator, or any person, firm or corporation, whether as principal, agent, or employee or otherwise, who shall change the use of any building or other structure or use of any land within the city in violation of the provisions of this title, shall be issued a violation fee, as set forth in the Consolidated Fee Schedule, by resolution of the Monticello City Council. If the fee is unpaid as set forth in the Consolidated Fee Schedule, the violator shall be guilty of a class C misdemeanor for noncompliance and, upon conviction thereof, shall be punishable by fine.

B. FAILURE TO COMPLY; ABATEMENT BY CITY:If any owner, occupant or other person having an interest in land described in such notice of decision, to whom the notice was given, shall fail or neglect to conform to the requirements thereof relating to the eradication, destruction or removal of such weeds, garbage, refuse, objects or structures, the City Manager may employ all necessary measures to cause such objectionable nuisance or condition to be removed or destroyed and to collect any expenses incurred from said owner, occupant, or other reasonable party.

  1. Each Day Separate Offense: Such person, firm or corporation violating this title or any part thereof shall be deemed to be guilty of a separate offense for each and every day during which such violation is committed, continued or permitted by such person, firm or corporation and shall be punishable as provided by law as a separate offense.

This ordinance shall become effective June 14, 2016.
