Expungement

Expungement is the process of legally striking out records or information in files relating to criminal charges. State laws, which vary by state, govern the expungement of criminal records. Expungement of records usually requires a formal request for expungement by the subject person of the records. States laws vary regarding when a request for expungement may be made and what records, i.e., records of arrest, fingerprints, etc., may be expunged. Local laws should be consulted to determine what requirements apply to expungement in your state.

Whether or not to grant an Order of Expungement is within the discretion of the Court, upon a showing of good cause. If an expungement is sought in another court, or additional assistance is needed with this process, you may seek such assistance from private legal counsel.

Information needed to begin an expungement process through the court:

  1. Criminal Action number and/or Docket Number of the matter(s) which you are seeking to have expunged.
  2. These can usually be obtained by a simple visit to the court customer service window.
  3. Copies of any charging documents and or judgments or disposition paperwork received in the case.
  4. Depending on how far back the court records are available;these can usually be obtained by a simple visit to the court customer service window with a written request for said documents that includes the case and docket number and any other identifying information associating the defendant to the case such as date of birth, date of offense etc.
  5. There may be a small records check fee associated with this request.
  6. A completed and notarized petition requesting the court to enter an Order of Expungement.
  7. Your notarized document will be considered by the court to be a sworn statement subject to penalty of perjury should it contain false statements.
  8. Your statement should include
  9. A brief and concise request to the court for expungement and include specific reasons why your request is being made to the court.
  10. A request for a hearing on the matter.
  11. Your notarized signature and the date filed with the court.
  12. Accurate contact information for the court to be able to contact you with your assigned court date.
  13. A completed and signed Request for Setting.
  14. The Notice of Setting portion of this request will be completed by the Court, if the Petition for Expungement is approved to move forward with a hearing.

Following completion of the paperwork:

  1. Make two copies of the paperwork.
  1. The original is to be filed with the court.
  2. A copy must be delivered to the City Attorney either via hand delivery or USPS at 200 N. David. Casper, WY 82601
  3. Maintain a copy for your records

What happens next?

  1. Within 7 to 10 business days the court will send, via USPS, notification of either the court date set for the hearing or an order denying the petition. The correspondence will be sent to the address provided on the petition.
