CITY COUNCIL MEETING

July 5, 2016

The Faulkton City Council met in regular session on July 5, 2016 in the City Hall meeting room with Finance Officer Emily Bauer and the following council members present: Linda Bartholomew, Sheilah Fischer, Dave Hadrick, Danny Ramsdell, Mark Toennies and Steve Wanner. Others present: Tim Bormann, Derek Barrios, Trevor Cramer, Roger Deiter, Brenda Facenelli, Jay Jahnig, Don Petersen, Jerod Raethz, Val Ramsdell, Kelly Toennies and Jerry Weyand. Mayor Slade Roseland called the meeting to order at 7:00 p.m. with all those present reciting the “Pledge of Allegiance”.

2016.7.92 Minutes: Councilman Wanner made the motion, seconded by Bartholomew, to approve the June 6, 2016 meeting and Special Meeting Minutes of June 27, 2016. Unanimous.

2016.7.93 Financial Report: Motion by Councilwoman Bartholomew, seconded by Fischer, to approve the financial report. Unanimous.

2016.7.94 Claims: The following bills were approved for payment on a motion by Councilman Hadrick seconded by Toennies. Unanimous. City Maintenance Report: Raethz said June was a busy month getting ready for the 4th, painting and fixing pot holes. They are still spraying for mosquitos and will be doing some hot mix this month.

Mayors Report: Mayor Roseland stated the 4th of July activities went very good. He thanked Linda Bartholomew for decorating the City Float and bringing a 1st place ribbon again this year. Roseland said the fireworks were also a huge success, with people from neighboring towns driving to Faulkton to watch them.

Old Business

2016.7.95 Faulkton Westside Addition: Trevor Cramer, Faulkton Area Economic Development Director, and Don Petersen, with Morgan Wheeler Law Office, presented the council with information on a Tax Incremental Financing (TIF) project. Petersen stated the FAEDC is asking for a $600,000 TIF. The Development Corporation would use the money to build streets, water/sewer infrastructure and drain the slough in the new Westside Addition. The TIF is a developer TIF, which the FAEDC has already procured a loan with favorable financing. The guarantee is made by the developer (FAEDC) who is responsible for the payments. Petersen stated “Even though the City has no risk of loss, under SD law the City must count the $600,000 TIF against their bonding limit.” Finance Officer, Bauer, was not sure what the City’s bonding limit is at this time. Bauer will determine the bonding limit and let Cramer know. Petersen said if the City’s bonding limit is not able to carry the TIF, they would pursue a different option with the County. After much discussion Councilman Hadrick motioned, seconded by Ramsdell to table the TIF Project Plan and the Covenants and Restrictions.

2016.7.96 Sewer Project: Motion was made by Councilman Wanner, seconded by Bartholomew, to allow the Mayor to sign a Letter of Agreement with Helms & Associates for the sewer project. Unanimous.

2016.7.97 Demolition Permit – Ordinance No. 39: Mayor Roseland read for its Second Reading Ordinance No. 39 entitled, “An Ordinance of the City of Faulkton, SD, Adding Chapter 3-4, Demolition Permits to the Faulkton City Ordinances.” Motion was made by Councilwoman Bartholomew, seconded by Toennies to approve, adopt and publish said ordinance. Unanimous.

New Business

Hospital Building Project: Jay Jahnig, Faulkton Area Medical Center Administer, thanked the council for putting him on the agenda, but the FAMC will not be needing to ask to close a street for the addition to the hospital.

2016.7.98 Resolution 2016-4 Court Fine Schedule: Mayor Roseland stated the only change made to the fine schedule was 6-4-4 Allowing Animal to Run/Nuisance. This will allow the sheriff’s department to write a ticket for dogs running and also barking. Motion was made by Councilman Toennies, seconded by Ramsdell, to adopt the following resolution. Unanimous.

RESOLUTION #2016-04

WHEREAS, the City of Faulkton requests that the Circuit Court set fines for certain violations of its Municipal Ordinances so as to allow such fines to be pursuant to the Court’s fine schedule rather than requiring an appearance in Court, and;

WHEREAS, the members of the Council have reviewed the ordinances and make this recommendation to the Court.

NOW THEREFORE, BE IT RESOLVED that the City Council hereby requests that violations of the following City of Faulkton Municipal Ordinances be made part of the Court’s fine schedule at the fines recommended herein or such other fine as the Court deems appropriate:

2016.7.99 Stop Signs: It was brought to the council’s attention there isn’t a stop sign at the west corner of 9th Avenue and Pearl Street. The council thought with that being a truck route a stop sign should be placed there instead of a yield sign. The Council also wants stop signs to replace the yield signs at the intersection of 9th Avenue and Oak Street. Motion made by Councilman Ramsdell, seconded by Bartholomew to add stop signs to the discussed intersections. Unanimous. No action was taken on the yield sign at 12th Avenue and Park Street.

Park & Swimming Pool: Councilwoman Fischer brought to the council’s attention a couple issues with the park and swimming pool. Fischer stated at the park there is playground equipment that has an opening that needs to be more secure for younger children. Raethz said he will either order a piece or have one made. Fischer also stated the zero entry part of the pool is very slippery and dangerous for both children and adults. Raethz said he would look into a couple different options for next year.

2016.7.100 Brown Bag Permit: Councilman Wanner moved, seconded by Ramsdell, to approve the following request for a “brown-bag” permit as per SDCL 35-1.5.3. Unanimous.

2016.7.101 Temporary Liquor License: Motion was made by Councilman Ramsdell, seconded by Toennies, to approve the following application for temporary liquor license. Unanimous.

OTHER BUSINESS

Other Business: A citizen voiced concern with a police matter. Mayor Roseland directed them to speak with the Sherriff’s Office or the State’s Attorney, Tim Bormann.

2016.7.102 Executive Session – Sewer Violation: Time: 7:52 p.m. Motion was made by Councilman Hadrick, seconded by Toennies, to go into executive session for litigation and/or personnel matters per SDCL 1-25-2.

Out of executive session at 8:08 p.m. Directed sewer violation to city attorney.

2016.7.103 Adjournment: There being no other business to come before the council, the meeting adjourned on a motion by Councilman Hadrick, seconded by Fischer. Motion carried. Time: 8:10 p.m.
