EXECUTIVE SESSION: The City Commission convened into Executive Session at 5:02 p.m. in accordance to Texas Government Code, Subchapter D, Section 551.072 – Deliberations regarding Real Property and Section 551.071 – Consultation with Attorney(s) to discuss:
· Leased property located at 1133 Price Road
· Legal issues in connection with granting a Specific Use Permit
RECONVENE: City Commission reconvene into open session at 5:30 p.m. with no action taken.
PRESENTATION:
Presentation of Certificate of Achievement for Excellence in Financial Reporting awarded to Robin Bailey, Finance Director by the Government Finance Officers Association of the United States and Canada for the City of Pampa’s Comprehensive Annual Financial Report (CAFR). Presentation was made by Shane Stokes, City Manager.
PUBLIC HEARING: The City Commission of the City of Pampa will conduct a Public Hearing at 5:30 p.m. on September 21, 2015 at City Hall, 200 W. Foster Street, 3rd Floor, Pampa, Texas. This will be a Public Hearing for the purpose of receiving public comments concerning the following request: Vincent Gerard and Associates, Inc. requests a Specific Use Permit at a 0.0517 acre lease area out of 130.40 acres deeded to Rusty Stevens, situated in Section 92, Block 3, I&GN RR Co. Survey, Gray County, Pampa, Texas. More specifically the lease site is located approximately 400 feet east and 300 feet north of the Intersection of 18th Avenue and Holly Lane. The applicant proposes to install a 180’ monopole cell phone tower for Verizon Wireless. This property is currently zoned A-Agricultural and currently does not allow a wireless structure without a Specific Use Permit for height and use. All interested parties are encouraged to attend this hearing. Public comments on the proposed specific use permit are welcomed and will be heard.

Mayor Pingel opened the Public Hearing at 5:45 p.m. Mayor Pingel asked Vincent Hüebinger, representative for Vincent Gerard and Associates, Inc. (Verizon) and Rusty Stevens to give his presentation on the proposed cell tower and request for Specific Use Permit. After Mr. Hüebinger’s power point presentation, he answered questions from the Commission. Mayor Pingel asked if there was anyone present who wanted to speak concerning the proposed Specific Use Permit; there being no one to speak a motion was made by Commissioner Dixon and Seconded by Commissioner Porter to closed the Public Hearing at 6:00 p.m., with each Commission Member voting AYE, the motion carried.

A motion was made by Commissioner Studebaker and Seconded by Commissioner Dixon to approve the minutes of the September 14, 2015 Public Hearings/Regular Commission Meeting as presented, with each Commission Member voting AYE, the motion carried.

AN ORDINANCE OF THE CITY OF PAMPA, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR THE LOCATION OF A MONOPOLE CELL TOWER UPON A 0.0517 ACRE LEASE AREA LOCATED WITHIN A 130.40 ACRE TRACT SITUATED IN SECTION 92, BLOCK 3, I&GN RR. CO. SURVEY, GRAY COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

A motion was made by Commissioner McLain and Seconded by Commissioner Studebaker to approve on first reading Ordinance No. 1646, an Ordinance of the City of Pampa granting a Specific Use Permit to Vincent Gerard and Associates, Inc. for the purpose of constructing a Verizon cell phone tower located near the Intersection of 18th Avenue and Holly Lane, with Mayor Pingel and Commissioners Studebaker, Dixon and McLain voting AYE and Commissioner Porter voting NAY, the motion carried.

4. Consider adopting on second and final reading Ordinance No. 1644, an Ordinance of the City of Pampa adopting its Operating Budget for the 2015-2016 fiscal year. This budget allows for the City of Pampa to continue providing effective public services, programs and assistance to Pampa residents for the upcoming year.

AN ORDINANCE MAKING APPROPRIATIONS FOR THE SUPPORT OF THE CITY OF PAMPA FISCAL YEAR BEGINNING OCTOBER 1, 2015, AND ENDING SEPTEMBER 30, 2016, APPROPRIATING MONEY TO A SINKING FUND TO PAY INTEREST AND PRINCIPAL DUE ON THE CITY’S INDEBTEDNESS; AND ADOPTING THE ANNUAL BUDGET OF THE CITY OF PAMPA FOR THE 2015-2016 FISCAL YEAR.
A motion was made by Commissioner Dixon and Seconded by Commissioner Porter to adopt on second and final reading Ordinance No. 1644, an Ordinance of the City of Pampa adopting its Operating Budget for the 2015-2016 fiscal year. This budget allows for the City of Pampa to continue providing effective public services, programs and assistance to Pampa residents for the upcoming year, with each Commission Member voting AYE, the motion carried.

5. Consider approving on first reading Ordinance No. 1645, an Ordinance of the City of Pampa setting a tax rate of $0.657175 per $100.00 valuation on taxable property for the 2015-2016 fiscal year and levying an Ad Valorem Tax Rate on all property subject to taxation within the City of Pampa.

AN ORDINANCE SETTING A TAX RATE OF $0.657175 ON EACH $100.00 VALUATION OF PROPERTY AND LEVYING AD VALOREM TAXES FOR USE AND SUPPORT OF THE MUNICIPAL GOVERNMENT OF THE CITY OF PAMPA FOR THE FISCAL YEAR OF 2015-2016; PROVIDING FOR APPORTIONING OF EACH LEVY FOR SPECIFIC PURPOSES; PROVIDING WHEN TAXES SHALL BECOME DUE AND WHEN SUCH TAXES SHALL BECOME DELINQUENT IF NOT PAID AND FOR PENALTY AND INTEREST; PROVIDING FOR SAVINGS AND SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION OF THE CAPTION HEREOF.
A motion was made by Commissioner Porter and Seconded by Commissioner Studebaker to approve on first reading Ordinance No. 1645, an Ordinance of the City of Pampa setting a tax rate of $0.657175 per $100.00 valuation on taxable property for the 2015-2016 fiscal year and levying an Ad Valorem Tax Rate on all property subject to taxation within the City of Pampa, with Mayor Pingel and Commissioners Studebaker, Porter and McLain voting AYE, and Commissioner Dixon voting NAY, the motion carried.

6. Consider approving on first reading Ordinance No. 1647, an Ordinance of the City of Pampa amending the revenues and appropriations for the support of the City of Pampa for the fiscal year beginning October 1, 2014 and ending September 30, 2015.

AN ORDINANCE AMENDING THE REVENUES AND APPROPRIATIONS FOR THE SUPPORT OF THE CITY OF PAMPA FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2014 ENDING SEPTEMBER 30, 2015. THIS AMENDMENT PROVIDES FOR EXPENSES RELATED TO POLICE INCIDENT, ANIMAL CONTROL SERVICES EXPENDITURES, WATER METER PROJECT AND DENTAL CLAIMS.
A motion was made by Commissioner McLain and Seconded by Commissioner Dixon to approve on first reading Ordinance No. 1647, an Ordinance of the City of Pampa amending the revenues and appropriations for the support of the City of Pampa for the fiscal year beginning October 1, 2014 and ending September 30, 2015, with each Commission Member voting AYE, the motion carried.

7. Consider authorizing the City Manager to enter into an amended Lease Agreement with Rig Fabrication and Repair, a Louisiana Company for property located at 1133 Price Road.
A motion was made by Commissioner Dixon and Seconded by Commissioner Studebaker to authorize the City Manager to enter into an amended Lease Agreement with Rig Fabrication and Repair for a six month period with a reduced rent rate of $2,000 per month. Amended Agreement will be effective October 1, 2015 through March 31, 2016, with each Commission Member voting AYE, the motion carried.
