Mayor Bruce Brown called the regular meeting of the City Council to order. Present were Councilmen Milford Ashworth, Tom Litherland, and Steve Zoellner. City Clerk, Margaret Hazlett and City Attorney Lee Phillips also present. Councilman Chris Hazlett was absent. Minutes for the October 18, 2017 Regular meeting were approved as written.

PUBLIC COMMENT:

Tim Braun, current President of CC-V School Board stated he has had a lot of calls and requests to clarify the redistricting plan that was put on the ballot. Basically, what they’re doing is they have seats that are impossible to fill. As it is, everything comes into Cripple Creek. They are trying to redistrict the board fairly and currently have one seat from Cripple Creek, one seat from Victor-Goldfield area and the rest at-large. This will give more people the opportunity to serve in their districts. This will not take effect until the next election if it passes Councilman Zoellner thanked Mr. Braun for the clarification. No further comments.

CITY ADMINISTRATOR REPORT:

City Administrator, Ray DuBois, stated Cripple Creek Parks and Recreation had a very successful Trunk or Treat at Park & Rec last night. Also impressed with the number of businesses along Bennett Avenue that were participating in trick-or-treat by having people out front handing out candy. He also had several people come by his home. Butte Theater: had the Toxic Avenger close out October 28th. Attendance for that show was not as good as other fall shows in the past, but still did ok. Right now the Butte is preparing for the Christmas show which will be Angel of the Christmas Mine, set to begin November 24th and run through December 30th. Events: Steve Kitzman, director of marketing and events gave an update on the 2nd Annual Cripple Creek Zombie Scavenger Hunt held on October 28th. Steve stated, “fun was had by all.” He states it is a fun and growing event, which is starting to gather steam. Last year they had 13 teams and this year they grew to 18 teams. They had a new scoring system which made it much easier, which was an app-based scoring system. It’s a great event because it pulled in all the businesses in town. All the stores submitted clues and provided gift baskets for a raffle drawing for the teams. The three casinos down in the 200 block, Triple Crown, Century and Broncos all contributed money, food and beer and came up with $1,750.00 for prize money. First place won $1,000; 2nd place won $500 and 3rd place won $250. All in cash. Good community effort and the only event the city does currently that actually made money. Several people from Denver to Pueblo came specifically for this event and it’s a younger crowd of 20s, 30s and 40-year-olds. In three hours the teams have to find clues that encompasses all of Cripple Creek and even outside to Heritage Center, out to the donkeys and the cemetery. Next year they hope to be doing a referral program. This year they got some kinks worked out on the judging and they had over 1200 photos generated from those teams in those three hours. Steve also wanted to give an update on the Distillery Event they had on the calendar for November 4th. That event is being postponed and restructured. The casinos did not want to do it at this time, and it is based heavily on their participation. They are looking at doing that event later in the year, possibly late spring or end of May and thinking of combining it with some other event. Mr. DuBois stated the Fourth Annual Sidewalk Sale, will be held on November 4th. Since it is now November 1st, Mr. DuBois to give thanks to Michelle Rozell, who was a driving force in organizing the efforts for October Arts Month. He also thanked Ellen Moore and Renee Mueller for setting up the displays and actually manning the displays. The City is trying to figure out some way to promote local art, until we can set up something more organized. There is an idea to display local art here in City Hall upstairs. Teller Co Road 1 Realignment/Upgrade and Sidewalk Projects held the ribbon cutting ceremony out there this afternoon. Some people have questioned the sidewalk on “C” Street and that street is part of the 5K and 10K program with Parks & Rec and that is also the truck route. So, that’s the reason for that. This whole project actually began in 2011 and just complete this year in 2017, for the price the city paid it was a heck of a deal. Hwy 67 Paving Project: Ray deferred to someone who has actually driven on it since he had not been on it for a while. Steve Kitzman stated that it is almost done although the weather held them up a bit. They are working near Gillette Flats paving southbound toward Cripple Creek. They are continuing on from Hwy 61 (Four Mile) towards Cripple Creek today. They are running a few days behind because of the cold temperatures. Fall Trash Drop-Off Days at Public Works: Steve DiCamillo gave a summary of how that event went. Steve D. stated it went very well. They did their average for the fall pick up. In the Spring they do 12-15 dumpsters and in the Fall they do 10-12 and this year they did 10. The guys tried something different this year having people come through the gate and controlling traffic through there and it went very smooth for them. It was not as congested as in years past. Mayor Brown stated he really appreciated the guys working on their days off during the weekend. Councilman Litherland stated that the traffic control went great and the public works guys did a great job. Reminder for Forest Edge Dental of Cripple Creek, is open for business and currently open on Mondays. They have an open-house coming up this Friday from 3:00pm to 6:00 pm. Also, Edge Rehab and Wellness Center continues to offer Occupational therapy and Physical therapy services out there. Also, we have an agenda item tonight that will lead to a medical practice out there. Mountain View Adventure Park: Work is progressing nicely. Hike & Bike Trail: The construction plans are being finalized. That was originally agenda item #2 tonight to award a bid, but based on internal discussions and commitments the City will be doing, if not all of it, nearly all of it in-house. There has been a lot of good cooperation in-house with that between Parks & Recreation and Public Works. Disc Golf Course the tee boxes and baskets are being installed. Playground Structure: are being installed. Dog Park is nearly completed. Connie is working with the Bureau of Land Management to finalize some legal right-of-way issues. That’s all for Ray’s report.

FINANCE DIRECTOR REPORT:

Finance Director, Paul Harris, stated he has an item on the agenda.

Prior to starting the agenda Mayor Brown stated that Councilmen Milford Ashworth and Steve Zoellner both wanted to say a few words to council and the audience.

Mr. Ashworth wanted to thank the citizens of Ward 4 and the entire city for allowing him to represent them for the last 8 years. It’s been a pleasure and he felt they have made quite a few accomplishments. Mr. Zoellner stated he would like to echo Mr. Ashworth’s expressions and indicated it has been a long, fast 8 years. He personally wanted to thank all the citizens that put up with him for the past 8 years. He also wanted to thank Council, Mayor Brown and the Clerk’s office for all the help they have given. Also, last week he thanked all the Department Heads and believes we have a great city working together. It’s been a privilege and honor to serve the citizens of Cripple Creek.

REQUEST APPROVAL OF LEASE AND LOAN DOCUMENTS BETWEEN CITY OF CRIPPLE CREEK AND MATT BROWN, OWNER OF LOMA VISTA MEDICAL CENTER; PAUL HARRIS AND CAROL STOTTS; Paul and Carol stated they were excited to announce that we will have a full-fledged experienced medical doctor practicing in our medical plaza facility. Dr. Reid was not available this evening, so Paul gave a brief bio of Dr. Reid to council. Dr. Reid moved to Colorado with his parents in 1961. Dr. Reid was in the U.S. Marine Corps and served in Vietnam from 1967-68. Dr. Reid attended medical school at the University of Maryland School of Medicine in Baltimore in 1977 and graduating with an M.D. degree in 1981. He has an extensive career in medicine in both Baltimore and Colorado. Dr. Reid has divided his practice almost equally between Emergency Medicine, including Urgent Care, and Primary Care Family Practice. He has been board certified in family medicine since 1990. Dr. Reid will actually be working for Matt Brown, owner of Loma Vista Medical Center and Loma Vista General and Family Practice, PC. At this time Paul turned it over to Carol Stotts to introduce Matt Brown to the council. Matt Brown is the CEO of several businesses, but important to us is that he is with Loma Vista Medical Center. With our rural capacity he will be able to utilize that as a federal designation to help with funds as well. Carol provided council with a letter of recommendation from the President of Pikes Peak Regional Hospital, Kimberly Monjesky. Matt Brown then spoke briefly. Matt explained why they designated this practice under the umbrella of Loma Vista. The reason is that Cripple Creek is considered a designated underserved community and he wanted to put it under that particular tax ID to be able to work into the future. He stated Dr. Reid has committed to at least five years with an additional five years optional. He stated that they will be utilizing a local resident in our community to help work in the office. He was referring to Kimberly Torres who was introduced by Matt. They are also intending to hire at least an additional four more people to assist in the practice. One of the immediate projects to begin with is to bring in a prescription drug dispensary. They plan on at least a 40-med dispensary at the facility. They will start taking Medicare and Medicaid right away and continue the process for getting Dr. Reid credentialed for other major insurances. They plan on opening the doors in two weeks upon the council’s approval. City Administrator Dubois asked for clarification on what insurances would be accepted and Matt stated that right now they accept all the major carriers and will be accepting carriers for workman’s compensation like Pinnacol. Normally, it takes 6-12 months and by going under Loma Vista they can speed up that process for Dr. Reid. He explained that with Medicare and Medicaid they will have to hold off on the billing until the credentials are completed which could be anywhere from 3-4 months. They will be open on Tuesdays, Thursdays and Fridays all day and open half-day on Saturdays. Paul Harris stated the first item for consideration by council is the lease agreement between the City and Loma Vista Medical Center and Loma Vista General and Family Practice. It is for the term of one (1) year, but it has four (4) years-worth of renewals on it. So, it’s a five-year package with both sides agreeing to that. No rent will be paid for the first six-and-a-half (6 ½) months. Exhibit A is an inventory list of the equipment the city is providing out there. The next document is a Promissory Note between the City and Matt Brown. The City is loaning Mr. Brown a hundred thousand dollars ($100,000.00) and that will be for five (5) years at two-and-a-half percent interest (2 ½%). The monthly payment once that kicks in in March of 2018 will be one thousand seven hundred seventy-four and 74/100 Dollars ($1,774.74). So, there is a five-year (5) lease agreement and a five-year (5) loan agreement and Dr. Reid has agreed to practice for five (5) years. The hundred thousand ($100,000) is helping stem the negative cash flow in the startup phase and Matt Brown and his firm are also putting up money. Once everything is up and running we will schedule an open-house for the community and council to come and meet Dr. Reid. Mr. Phillips advised that the documents are inter-related so there would only need to be one motion. The motion would be: To Approve the lease between the City of Cripple Creek and Loma Vista General and Family Practice, P.C., as well as Promissory Note payable to the City of Cripple Creek by Matt Brown. Motion as stated so moved by Councilman Ashworth, seconded by Zoellner and motion carried.

REQUEST APPROVAL TO AWARD TRAIL CONSTRUCTION FOR MOUNTAIN VIEW ADVENTURE PARK; CONNIE DODRILL

City Administrator, Ray DuBois, stated that the item was dropped from the agenda.

REQUEST APPROVAL OF CHANGE ORDER TO ALLOW ACCESS TO PROPERTIES ON SOUTHWEST SIDE OF TELLER 1 THROUGH GUARDRAIL; STEVE DICAMILLO

Mr. DiCamillo stated that in the packet there is a change-order for additional guardrail. When the original project was designed in 2011, as city administrator stated earlier, there was nothing out there. When this project began we had a property owner come forward and requested to put in a water line. The City overlooked putting in a hole in the guardrail to access his property. They will now have to remove a section of guardrail and put in the curved pieces that drop down into the property. Motion by Councilman Zoellner to approve the change order as presented; seconded by Litherland and motion carried.

ANNUAL REVIEW AND EVALUATION OF CITY ADMINISTRATOR RAY DuBOIS; CAROL STOTTS; Carol stated that Mayor Brown had executed Mr. DuBois’ performance evaluation on October 30th and based off the direction she received from city council it is her recommendation that the city provide Mr. DuBois a one-time payment for pay-for-performance in the amount of three and one-half (3 ½%) percent of his annual salary, as well as provide him the opportunity to receive the cost of living adjustment if/and when in the same manner that all other city staff receive.
