CHAPTER 8. PUBLIC PEACE, SAFETY & MORALS.
800.00. Disturbing the Peace. Every person who, without authority of law, shall willfully disturb any assembly or meeting not unlawful in its character, or the peace and quiet of any family or neighborhood, shall be guilty of a misdemeanor and may be punished as provided in these ordinances.
801.00. Offensive Conduct Prohibited. Any person who appears on a street or in public or an exposed place within the corporate limits of the City of New London dressed in a manner not becoming to his or her sex, or in any indecent or lewd dress, or who shall make any indecent exposure of his or her person, or shall commit any obscene or filthy act, or conduct themselves in any lewd, indecent, disorderly, immoral, profane or insulting manner, language or behavior, or shall exhibit, sell or offer to sell any indecent, obscene or lewd books, pictures, or other thing, shall exhibit or perform any indecent, immoral or lewd act or other representation, shall be guilty of a misdemeanor and shall be punished as provided for in these ordinances.
802.00. Vagrancy. Any of the following are vagrants and are guilty of a misdemeanor:
(1)A person, with ability to work, who is without lawful means of support, does not seek employment, and is not under 18 years of age.
(2)A person found in or loitering near any structure, vehicle, or private grounds who is there without the consent of the owner and is unable to account for being there.
(3)A prostitute who loiters on the streets or in a public place or in a place open to the public with intent to solicit for immoral purposes.
(4)A person who derives support in whole or in part from begging or as a fortune teller or similar imposter.
803.00. Discharge of Firearms Prohibited. No person shall discharge any firearm of any description or fire, explode or set off any other explosive instrument, substance or material within the limits of the City of New London, unless it is in the discharge of official duty prescribed by these ordinances or by the laws of the State of Minnesota, or upon written permission of the city council. No person except a law enforcement officer shall carry any gun, pistol or firearm unless it is dismounted or broken apart or carried in a case in such a manner that it cannot be discharged. This subdivision does not prevent the carrying of a handgun within the city under a permit subject to the restrictions imposed by law.
804.00. Fireworks.
804.01. Prohibitions. Except as otherwise provided in subdivision 2, it shall be unlawful for any person to offer for sale, sell, use or explode any fireworks, firecrackers, rockets, torpedoes or other explosive contrivances within the corporate limits of the City of New London. This ordinance shall not, however, apply to the keeping and storage of such merchandise for shipment outside the City of New London, provided a special permit for such storage has been issued by the city council.
804.02. Permit Required. Any person, group or organization desiring to use any fireworks or explosive contrivances to display within the city limits, shall make written application to the city clerk at least fifteen (15) days in advance of the date of the display. The city council, with the advice and consent of the fire chief shall then determine whether the operator of the display is competent and whether the display is of such a character and is to be so located, discharged or fired so that it will not be hazardous to property or endanger any person. Further, the proposed display shall conform to the rules and regulations of the state fire marshal. If the proposed display meets all of the foregoing criteria, the city clerk shall issue a permit for the display upon payment of any fee as may be determined by the city council.
804.03. Limitation of Permit. Permits granted pursuant to Subdivision 2, shall be lawful only for the display to which the permit relates.
804.04. Permits Non-Transferable. Permits granted pursuant to Subdivision 2 shall not be transferable.
804.05. Seizure Permitted. Fireworks or explosive contrivances used in violation of these ordinances may be seized by law enforcement officers and subsequently destroyed by said officers.
804.06. Penalty. The seizure of any fireworks or explosive contrivances by law enforcement officers shall not prevent any person who violates these fireworks provisions from being prosecuted as provided elsewhere in these ordinances.
805.00. Gambling.
805.01.Declaration of Policy. In order to promote the health, safety and welfare of
the citizens of the City of New London, it is necessary that measures relating to the licensing and conduct of lawful gambling within the City of New London be established. The council shall grant, suspend and revoke licenses subject to the applicable state laws and regulations relative to lawful gambling within the State of Minnesota
805.02. Provisions of State Law Adopted. Chapter 349 of Minnesota Statutes, as now exist or shall be hereinafter amended, as well as the adopted rules of the Charitable Gambling Control Board, as now exist or are hereinafter amended, are hereby adopted and made a part of this ordinance as if fully set out herein.
805.03. License Required. No person or organizations shall conduct lawful gambling as defined by the laws of the State of Minnesota without the required state license issued through the Charitable Gambling Control Board and as approved by the City of New London under the terms of this ordinance.
805.04. Application for License. Every application for a gambling license shall be verified and filed with the city clerk and shall be in compliance with the statutes and the rules governing same adopted by the State of Minnesota and Charitable Gambling Control Board.
805.05. Granting of Licenses. The City of New London shall investigate the facts set out in the application and do a background check on the applicant, making its recommendation to the city council based thereon concerning the applicant. After such investigation and recommendation, the city council shall act on the application in granting it or refusing it at its discretion.
805.06. Organizations Ineligible for License Approval. No license shall be approved as to any organization or person not eligible for such license under state law. Applicants must have their home office or base of operations within the city limits of the City of New London, and be an organization that serves the residents of the City of New London. If no organization, with its home office or base of operations within the city limits of the City of New London, is willing to apply, the city council may, at their discretion, approve an outside organization.
805.07. Conditions of License Approval. Every license shall be approved subject to the conditions in the following subdivisions and all other provisions of this ordinance and of any other applicable ordinance of the city or state law:
(1)Every licensee shall be responsible for the conduct of its place of operation as described in its license application. Any peace officer of the city shall have the unqualified right to enter, inspect and search such premises of the licensee during business hours in order to insure that said premises are conducted in compliance with this ordinance and applicable state laws and regulations.
(2)The premises within which lawful gambling may be conducted pursuant to this ordinance may be duly licensed for the sale of on-sale intoxicating or the sale of on-sale nonintoxicating liquor.
(3)All gambling operations conducted by the applicant must be managed by bona fide members of the organization applying for the license.
805.08. Revocation and Suspension of License. The city council may revoke or suspend any gambling license for violation of any provision or condition of this ordinance or any state law or rule incorporated herein, subject to the requirements and conditions as contained in said state law and applicable rules of the Charitable Gambling Control Board.
805.09. Penalty. Any person violating any provision of this ordinance shall be guilty of a misdemeanor and upon conviction, shall be punished by a fine of not more than $500.00 or imprisonment in the county jail for not more than 90 days, or both, plus the cost of prosecution in either case.
805.10. Severability. Should any section, subdivision, clause or other provision of this ordinance be held to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of this ordinance as a whole, or any part thereof, other than the part held to be invalid.
806.00. Billiards, Pool, Pinball Machines and Other Games of Amusement.
806.01. License Required. No person shall allow the operation of pinball machines, other gaming or electronic amusement devices, or a billiard, pool or pigeon hole table or allow such devices or tables to be kept on the premises of a business under his control and operation without first obtaining a license as hereinafter provided.
806.02. License. A person desiring a license under Subdivision 1 shall apply to the city clerk therefore and shall pay to the clerk as a fee the sum of ten dollars ($10.00) per annum for each and every pinball machine, gaming or electronic amusement device, billiard, pool or pigeon hole table kept for use in their place of business.
806.03. Transfer of License. Upon payment of the foregoing sum, the city clerk shall issue a license for a term of one (1) year from the date of its issuance. For cause shown and upon payment of one dollar ($1.00) to cover the cost thereof, such license may be transferred to another person or persons for the balance of the license year. Any such transfer shall be authorized only upon motion made to the city council and the council’s approval by a majority vote.
806.04. Restrictions. Any person who obtains a license as provided herein shall keep an orderly place and shall not permit any wagering with respect to the playing of any amusement machine, device or game.
806.05. Revocation. Any license issued pursuant to this chapter may be revoked by the city council if said council should find, following notice to the licensee and a hearing thereon, that the said licensee has not complied with the provisions of this ordinance.
807.00. Curfew.
807.01. Regulating Conduct of Minors. It shall be unlawful for any person under the age of eighteen (18) years to loiter or be in or upon the public street, highways, alleys, parks, playgrounds or other public places or private unsupervised places, or to ride in or park in a vehicle in any of the foregoing places in the City of New London between the hours of 10:00 p.m. and 6:00 a.m., of the following day provided, however, that the provisions of this section shall not apply to any such minor accompanied by his or her parent, guardian or other adult person having the care and custody of the minor, or when the minor is upon an errand directed by his or her parent, or any other adult person having the care and custody of the minor.
807.02. Regulating Conduct of Adults in Charge of Minors. It shall be unlawful for the parent, guardian or other adult person having the care and custody of a minor under the age of eighteen (18) years to permit such minor to violate the provisions of Subdivision 1.
807.03. School Night. The provisions of Subdivisions 1 and 2 shall not apply if the minor under the age of eighteen (18) is returning home after attending a school athletic, musical or social activity conducted for the benefit of its students provided, however, the limitation of Subdivisions 1 and 2 shall apply between the hours of 12:30 a.m. and 5:00 a.m.
808.00. Parties and Gatherings.
808.01. Noisy Gatherings Prohibited. No persons shall congregate because of or participate in any party or gathering of people from which noise emanates of sufficient volume or of such nature to disturb the peace, quiet or repose of other persons.
(1)No persons conduct at this gathering or party shall be as prescribed in Minnesota Statutes 609.72 (Disorderly Conduct).
(2)No person shall use a public address system, amplifier or power equipment, or otherwise make noise of a volume tending reasonably to arise alarm, anger or resentment in others in the surrounding area.
808.02. Police Disbursement. A law enforcement officer of Kandiyohi County may order any persons violating Section 1, other than the owner or tenant of the building or place where gathering occurs, to immediately disperse.
808.03. Responsibility of Owner or Tenant. The owner or tenant of the building or property, who has knowledge of a disturbance or gathering prohibited by Section 1 shall immediately abate the disturbance.
808.04. Penalty. Any person who violates any of the sections of this ordinance shall be guilty of a misdemeanor as that term is defined in Minnesota Statutes 609.
809.00. Unused Refrigerators. Whoever, being the owner or in possession or control, permits an unused refrigerator or other container, sufficiently large to retain any child and with doors which fasten automatically when closed, to be exposed and accessible to children, without removing the doors, lids, hinges, or latches, is guilty of a petty misdemeanor. Refrigerators and other container subject to this ordinance includes those with doors or lids that fasten by vacuum or magnetism.
