CHAPEL HILL WEST CONDOMINIUMS Construction/Remodeling Policy

All unit construction must be reported to the Management Office at least two weeks prior to the beginning of any scheduled construction or construction deliveries.

Unit Owners must complete and return a construction information form to the Management Office, accompanied by a $250.00 security deposit no later than one week prior to the beginning of any construction/repairs or deliveries (Forms are available at the Management Office). This is important to assure all safety measures are in place and conducted in a professional manner by properly licensed/certifiedindividuals. Restoring /repairing walls, joint compound, ceilings, flooring, floor tiles, plumbing facilities, insulation and the like may threaten the structural integrity of your unit, adjacent units and/or the building and may cause harmful contaminants to become airborne. Unit owners are responsible to inform contractors of the rules they must abide by. When the project is finished all materials are to be removed from the propertyin a safe mannerand not placed in the dumpsters. Contractors are not permitted to use the resident shopping carts for any reason.

The Town of Framingham requires a building permit for any structural alteration including but not limited to plumbing and electrical work. This includes cabinets and vanities. Accordingly, do-it-yourself projects are restricted to such remodeling projects as, painting and wallpapering. Contractors must possess appropriate license(s) and valid certifications as might be required by Massachusetts law. Failure to comply with Framingham/Massachusetts laws may result in substantial additional costs to you, resulting from code violations and/or Association fines. Copies of all required building permits, up to date insurance and other required certificates and contractor licenses must be given to the on sight Property Manager no later than one week prior to the beginning of any construction or construction deliveries.

The days and hours of operation for all contractors doing work in units is:

Monday through Friday, 8:00 a.m. – 5:00 p.m., Saturday, 8:00 a.m. -1:00 p.m.

No Holidays or Sundays

All work must be performed in the owner’s deeded unit or on the balconies and not in or on the common areas. Alterations of the balcony floors, walls, railings and ceilings, which are not part of the owner’s deeded property, are not permitted. Should your construction material be so large that it requires additional space for a short period, please see the Office Manager. Under no circumstance are construction materials or equipment to be left unattended in any common area even for a short period.

Owners as well as contractors are under the same restrictions except for quiet projects like painting. Sound travels in this building; we ask that you please be considerate with any noisy projects, whetherperformed by a contractor or by you.

Contractor’s vehicle(s) can be parked in the loading zone next to one of the parking garage ramps for fifteen (15) minutes to bring any materials and/or supplies up to the Unit. Please do not prop the doors open. Management has a door latch to be used to hold the side doors open during a move. Contractor’s personnel must always be present when the door is open. There is a $50 fine if it is not returned to the office. When finished unloading, the contractor’s vehicle must be moved to the parking area next to Long Term Parking (facing Route 9). Contractor’s vehicles are not be parked next to the building. These are designated spaces for residents and visitors only. Contractors must always check in with the office before beginning any work or making any deliveries. Construction materials or other items cannot be raised up to or lowered from the balconies.

Association’s Review of Work as Proposed. The Association shall have a right (at the Unit Owners expense), from time to time and as often as it deems necessary, (a) to review the Plans for

The Work and (b) to observe the Work to ensure that that the Work conforms to the approved Plans or Scope of Work and is otherwise in conformity with the requirements of this Agreement. The Unit Owner shall provide access to the Condo to the Manager of the building or any other person the Corporation may authorize. Such inspections may be made without notice to the Unit Owner(s) at any time when the Unit Owner(s), his/her representative, a permitted occupant or workers are present in the Condominium.

Adherence to Local, State and Federal Laws the Owner shall comply with all local, state and Federal laws, rules and regulations pertaining to asbestos and other hazardous material. Plans should provide for paint, dust and debris containment performed by an EPA licensed contractor using EPA standards.

Prohibited Construction Methods the Owner shall not interfere with the Building’s gas, electric, heating, air conditioning or plumbing system or any other Buildings system or service.

REQUIRED DOCUMENTS

The documents and/or other information listed on this page may be required by Chapel Hill West Management prior to any construction or remodeling projects. Failure to remit these documents may cause a delay in the commencement of your project, and potential fines if the project is started before these documents are received and approved by Management.

a)Detailed description of the planned project. ______Received

b)Copy of valid up to date Certificate of Insurance, which must include Chapel Hill West Condominiums as additionally insured ______Received

c)Valid Contractors License ______Received

d)Contractor Certifications as may be required by the EPA, DEP and OSHA for potential hazardous material removal, handling and disposal ______Received

e)Structural modifications i.e., removal and or relocation of walls, etc. must be approved by Management or the Board of Trusteesand must include a valid building permit from the Town of Framingham ______Received

Note: In most cases, the “Removal & Relocation of Walls”will require that you, as the home owner, have the areas to be disturbed tested for Potential Asbestos Containing Materials by a Certified Asbestos Inspector.Copies of the Inspectors Report and Lab Results are to be brought to the Management Office for review at least 1 week prior to the project start date. All costs related to Inspection, Laboratory Testing and potential Abatement and Disposal will be borne by the unit owner.
