INSTRUMENT OF APPOINTMENT OF CASUAL ACADEMIC STAFF (CA01) /

This advice is an “Instrument of Appointment” as prescribed in RMIT workplace agreements which stipulates the type of employment and informs the staff member of the terms of engagement at the time of the appointment in relation to; duties required; number of hours required; rate of pay for each class of duty required; and a statement that any additional duties required during the term will be paid for.

This advice is not a contract of employment between you and RMIT University.

Payment:

Casual staff members are paid via two methods, Ad Hoc or Regular:

·  An Ad Hoc casual is engaged on an ‘as needs’ basis and is advised of the hours they are required to work, as and when required. Approved hours actually worked will need to be submitted on a fortnightly basis.

·  A Regular casual is a staff member who is provided in advance with details of the hours they are required to work, including a specified commencement and end date of employment. Regular casual staff members will be paid each pay period in accordance with the work schedule initially submitted from your work area at the commencement of your employment. If any variations to scheduled work hours occur for any reason such as ill health or extra hours approved and worked, then you will be required to inform your supervisor of the changes.

The start and end dates and the number of hours to be worked provide you with an outline of duties. They are only an estimate and may be changed by RMIT University at any time according to the requirements of the University. It is noted that you will be paid for any additional duties required during this engagement.

Induction:

Please ensure that you have discussed your induction requirements with your supervisor, and that you have provided your supervisor with certified copies of any qualifications required by RMIT policy and any required current mandatory professional registrations.

All casual staff are required to apply University policies in their work, those who are employed on a regular and systematic basis for a period equivalent to one contact hour per week for one semester must complete the Occupational Health and Safety, Equal Opportunity and Privacy in the workplace online training modules within their first month of commencing employment with RMIT. These are found on the RMIT website at www.rmit.edu.au/staffinduction and www.rmit.edu.au/policies

New casual staff will be paid for up to five hours at the applicable rate for online, local and safety inductions and the successful completion of all mandatory online training modules. To claim payment, a casual staff member will need to complete the Casual induction completion form, attach a copy of the certificate for each module completed, submit it to their supervisor for approval and submit the approved form to Human Resources for payment.

Intellectual Property:

All rights to industrial and intellectual property (including but not limited to any idea, product, process, work, result, design or concept), produced by a member of staff in pursuance of the members Instrument of Appointment with RMIT, vest in the University. Terms and conditions of employment:

The terms and conditions of employment for casual staff members including information on superannuation entitlements are contained in the relevant workplace agreement/s, and RMIT University policies and procedures applying to your casual employment with RMIT University. Copies of these documents are available on the RMIT website at www.rmit.edu.au/humanresources

·  Casual Academic staff can be engaged to deliver a series of lectures, tutorials or demonstrations on a casual basis for a specified term or semester, or for a shorter period to deliver lectures, tutorials or demonstrations for part of a course or unit.

·  A casual staff member can be engaged to cover short term, irregular and generally unplanned or ad hoc vacancies.

·  All casual staff are engaged and paid by the hour, which includes a loading related to award based benefits, for which a casual staff member is not eligible, which includes leave and other similar entitlements.

·  A casual staff member shall not be required to work more than five consecutive hours without a meal break.

·  Each work period is a separate and distinct period of employment. Casual staff are engaged with no guarantee or expectation of work beyond the period of their current employment.

·  Casual staff are not entitled to payment for any public holidays unless they are required to work on such a day.

·  Casual staff are treated the same as continuing and fixed-term staff for the purposes of WorkCover and occupational health and safety.

It is a requirement of the Fair Work Act 2009 that employers provide a copy of the “Fair Work Information Sheet”. A copy is attached.

·  Unless agreement has been reached between the University and the casual academic staff member on remuneration in respect of producing the relevant work, or the research activity is funded by RMIT or is the result of a candidature at RMIT, the University will not::

a)  require a casual academic staff member to describe themselves as a staff member of the University in any publication, or refereed journal article written by the staff member, or in connection with any creative work of the staff member.

b)  include the publication, refereed journal article, or creative work of a casual academic staff member in the University’s profile for any institutional grants scheme allocation.

·  Casual staff members should keep a record of their hours worked and submit the details when requested.

·  Casual academic staff members engaged to lecture for the equivalent of a minimum of one contact hour per week for one semester:

a)  will be provided with a library card; outside hours access where and when required; an email account; appropriate network and intranet access; and an entry in the University’s web staff contact directory; until the start of the semester following the one for which they are engaged.

b)  will be invited to attend relevant College, Centre, School or workgroup meetings. Casual academic staff members will be paid for attendance at meetings where they are required or directed to attend.

c)  are entitled to apply for internally advertised University positions and participate in an application for internal funding opportunities, including grants and professional development funds.
