In the reference memo vide cited above, it was requested to submit the objections with regards to proposed final seniority list and informed that it was prepared in compliance to the honorable High Court Orders W.P.No.1264/2009, W.P.No.2189/2009 and W.P.No.12788/2011.
2. In this connection, it is to submit that proposed final seniority list is nothing seemslike forwarding some section of Assistant Engineers to higher ranks by affectingother section of Assistant Engineers as in it has not followed any base regulation and conceded extraneous things altering regulations into considerations.
3. The previous proposed revised seniority which was prepared as per B.P.Ms.No.354, dt.12-12-94 vide memo no. CGM (HRD & TRng)/DS (P)/AS(P)/PO. Reg.(T&NT)/38/2010,dt.06-02-2010 communicated is seem suddenly under darknessand the reasons for such actions is not known.Also, it is observed that the present proposed final seniority is arbitrary and erroneous to the best of my knowledge and conviction. The following facts shall witness the proposed final seniority list an arbitrary and erroneous.
i)I am at the rank of 170 in the present proposed final seniority list previously I was there at the rank of 144 in the revised seniority list.

iii)It is observed that most of the above candidates have been appointed from the vacancies arisen as 10% Quota, consequent to the Direct Recruitment 2005 on contract basis vide T.O.O. (CGM/HRD & Trg.) Ms. No.231, Dt: 01.02.2005andT.O.O. (CGM/HRD & Trg.) Ms. No.21, Dt: 26.04.2005.
iv)It is relevant to submit that prior to 1994 ,the employees working as sub-Overseers, Asst.Supervisor and O&M Establishment who acquired the requisite qualification have to appear for the test for direct recruitment to the Assistant Engineer Category and they are treated as Direct Recruits for all purposes as per A.P.S.E.B Service Regulations, part-III. Afterwards, at the request of Diploma Engineers, A.P.S.E.B issued Proceeding No.354,dt.12-12-1994 amending the said regulations as follows:
a)Direct Recruitment
b)By transfer from graduate Sub-Engineers with minimum of 4 years service in the category of Sub-Engineer,Asst. Supervisor,Sub-Overseers,Lineman,Tester, etc subject to the following conditions:
- Such recruitment from among Graduate Sub-Engineers shall be limited to 10% of vacancies at the time of each recruitment
- They are not entitled for any service weightage
- They have to take lowest rank as on the date of appointment below the junior most Assistant Engineer/Trainee as on the date.
Therefore, it is clear from the above that derived Assistant engineers existence shall be on only while exercising B.P.Ms.No.354, dt.12-12-1994 without which there were no vacancies for their appointment.
v)It is pertinent to submit that, In APSEB, the recruitment has taken place for graduate engineers in the cadre of Assistant Engineer who were designated as Assistant Engineer/Trainee between the years 1986 and 1998.Duing Post reforms, in APTRANSCO and DISCOMS recruitment was done on contract basis between the years 2002 and 2005.Except for appointment on contract basis, all other provisions for service regulations are followed at the time of recruitment and during their service. Therefore, the direct recruitment made is also traceable to provisions contained in Regulation 6(a) of Service Regulations Part-III. While the notification for recruitment to the post of Assistant Engineer(Electrical) on yearly contract basis,applications are invited by prescribing the notification in daily newspapers both in English and local languages. The candidates were selected through a written examination. While filling up of the said posts by direct recruitment, simultaneously recruitment by transfer was undertaken from among the eligible Graduate Sub-Engineers. The said procedure is in conformity with the Service Regulations Part-III, which was amended by B.P.Ms.No.354, dt.12-12-1994.From the above, it is clear that the only Assistant Engineer Nomenclature has been changed.
vi)From the above, it is clear that the seniority has been finalized by conceding ridiculous things as realties so as to benefit some section of Assistant Engineers and it has not have any base and prepared without following the Regulation 26 of A.P.S.E.B Board Service Regulations Part-II, which states the seniority and is detailed below.
a)The Seniority of a person in class is service, category or grade shall, unless he has been reduced to a lower rank as a punishment, be determined by the rank obtained by him in the list of approved candidates drawn up by the Board or other appointing authority as the case may be.
b)The Rank they have to be placed is duly as per B.P.Ms.No.354, dt.12-12-94 i.e they had to be junior most to the Assistant Engineer appointed in the Direct Recruitment.
vii)Where the regulation has to be followed scrupulously while finalizing the seniority list it is observed the omission and also I am unable understand the reasons for preparing contrary seniority list in APTRANSCO to the APCPDCL while both APTRANSCO and APCPDCL has been following same A.P.S.E.B Service regulations in the service matters.
viii)From pre-Para 3(vii), it is clear that the proposed final seniority list has been prepared either wrong interpretation of regulations or extraneously. Therefore, the exercised regulation may be clarified.
ix)A.P.Transco ordered vide Memo.No.CGM(HRD&Trng)/DS(P)/AS(P) /PO.Reg.(T&NT)/248/10,dt.16-04-2011 that the seniority of the employees whose services have been transferred and absorbed into APTRANSCO as per the T.O.OMs.No.35,dt.13-05-2005 shall be fixed with reference to their date of appointment in the later (transferee) company irrespective of their status(i.e Approved Probationer/Probationer/emergency) in their earlier company as ordered in the said T.O.O and shall be followed scrupulously.
x) It is observed that pre-Para 3(ix) orders were not followed scrupulously as some of the Assistant Engineers have taken higher rank than the then Assistant Engineer (Contract) as on that date.
4. Further, I am unable to raise the objections absolutely as the information available in the Memo cited is not complete enough. Hence, it is requested to arrange to provide the following additional information pertaining to AEs/Electrical to enable me to raise the absolute objections on the seniority list of AEs/Electrical.
- Community.
- Date of Joining as AE on Yearly Contract Basis.
c.Date of Regular Appointment/Date of Joining.
d.Mode of Appointment Viz: Direct Recruitment/Appointmentby Transfer/Request Transferfrom other Company/Conversion from AAE.
e.Date of Completion of Probation.
f.Remarks column duly indicating the Appointment/Promotional orders, unauthorized absence, Long Leave, Disciplinary cases pending or EOL etc.
g.Date of passing the B.E/B.Tech in case of AEs who were appointed by transfer from Sub-Engineer
5. In view of the above, it is requested to arrange the additional information at the earliest and the above submitted objections may be considered for cancelingthe proposed seniority list that was prepared without following A.P.S.E.B regulations and to appeal to finalize the seniority laterafresh duly as per the B.P.Ms.No.354, dt.12-12-1994 in the submitted matter and after further objections, if any with the additional information.
