CLUB CONSTITUTION/RULES 2015

1a.The Club shall be known as the Capel St. Mary & Little Wenham Bowls Club.

1b.The main purposes of the Club are to provide facilities for, promote and encourage

community participation in the amateur sport of Bowls in Capel St. Mary & Little

Wenham.

2a.Membership of the Club shall be open to anyone interested in the sport on application regardless of sex, age, disability, ethnicity, nationality, sexual orientation, religion or other beliefs. However, limitation of membership according to available facilities is allowable on a non-discriminatory basis.

2b.The Club may have different classes of membership and subscription on a non-discriminatory and fair basis. The Club will keep subscriptions at levels that will not pose a significant obstacle to people participating.

2cApplications for membership shall be considered by the Club Committee. The ClubCommittee may refuse membershiponly for a good cause such as conduct or character likely to bring the Club or sport into disrepute. Any appeal against refusal must be made in writing to the Chairman and be put to the members for a final decision.

2dMisconduct of members likely to bring the Club or sport into disrepute will be dealt with in accordance with the Club’s Code of Conduct. Should it be decided that the member’s conduct is sufficiently serious to warrant removal of membership the decision can only be taken by the Club Management Committee. Any appeal against removal must then be made to the members.

3a.The joining fee, annual subscription and match fees will be as determined each year at the AGM. No reduction in the joining fee or other annual subscription shall be allowed for applications received after the beginning of the year, which will run from 1st October to 30th September in the following year,unless otherwise agreed by the Management Committee. All annual subscriptions shall be payable by 31st October or later application for new membership

3b.The property and funds of the Club cannot be used for the direct or indirect private benefit of members other than as reasonably allowed by the Rules and all surplus income or profits shall be reinvested in the Club.

4.The Annual General Meeting (AGM) shall be held in October of each year.

5. The President shall be elected at a properly constituted General Meeting, other than the AGM, and shall normally serve for a term of 3 years.

6.The Committee shall be elected annually at the AGM and shall consist of the Principal Officers of the Club with such other members as are elected.

7.The Principal Officers of the Club shall be the President, The Chairman, The Secretary, The Treasurer, The Club Captain, The Site Co-ordinator(or Greenkeeper), The Social Secretary, The Competition Secretary and the Playing Field Representativewho shall all be elected annually at the AGM.

8.A complete list of all current members shall be displayed at the Pavilion or Clubhouse. The Secretary to forward lists of the membership to Federation, Association and League Secretaries as appropriate.

9.All matches to be played under English Bowling Federation or Bowls England Rules as amended by the ‘domestic’ rules of the Leagues and Competitions entered.

10.All persons entering upon the Green shall wear approved flat-soled footwear.

11.The selection of a team or teams to represent the Club shall be made by the Club Captain or the Team Captain as appropriate.

12.Financial expenditure at any time on behalf of the Club must be subject to the authority of 3 or more Principal Officers.

13.Members’ guests shall be permitted to play on the Green in informal roll-ups (but not in league matches nor in club social matches or competitions)on payment of a fee the amount of which shall be determined by the Committee from time to time.

14. A General Meeting of the Club shall be properly constituted if all members are notified in writing at least seven days beforehand of the date and location of the meeting and a Quorum is achieved.

15. At a General Meeting a Quorum shall exist if there are present not less than fifteen members who shall include at least two Principal Officers, except that no amendment to these rules can be made unless there are present at least 50% of the total club membership including at least 5 Principal Officers.

16. A Committee Meeting shall be properly constituted if a proper and reasonable endeavour is made to notify all Committee Members of the time and location of the meeting and a Quorum is achieved.

17. At a Committee Meeting a Quorum shall exist if there are present at least 5 Committee Members including at least 3 Principal Officers, except that no financial matters may be determined unless there are present at least 5 Committee Members including 4 Principal Officers of whom one must be the Treasurer or his proxy.

18.Winding up the Club

a.The members may vote to wind up the Club if not less than two-thirds (2/3rds) of those present and voting support that proposal at a properly convened meeting.

b.The Committee will then be responsible for the orderly winding up of the Club’s affairs.

c.After settling all liabilities of the Club, the Committee shall dispose of the net assets remaining to one or more of the following:

(1) To another club with similar sports purposes which is a registered Charity and/or

(2) To another club with similar sports purposes which is registered CASC and/or

(3) To the Club’s governing body for use by them for related community sports

19.No addition or alteration to these rules shall be made except at a properly constituted General Meeting of the Club members (see rules 14 & 15) and then only when carried by a two-thirds (2/3rds) majority of those present.

20.The Committee, in a properly constituted meeting (see Rule 16) shall be the final arbiter of these rules in any case of dispute.

21. A copy of these rules shall be displayed at all times in the Pavilion or Clubhouse and a copy shall be made available to any new member on request.

22. It is a duty of each member to be aware of these rules in so far as they affect the member.
