TENTATIVE ORDER

NPDES NO. CA0038750

RESCISSION OF WASTE DISCHARGE REQUIREMENTS FOR:

CS LANDS, INCORPORATED

SELBY WASTEWATER TREATMENT PLANT

SELBY, CONTRA COSTA COUNTY

The California Regional Water Quality Control Board, San Francisco Bay Region (hereinafter Board) finds that:

1.  NPDES Permit No. CA0038750, Order No. 98-037, permitted Wickland Oil Company to discharge an average dry weather flow of up to 0.023 million gallons per day (mgd) of treated domestic wastewater from a package plant that was to serve 16homes and the John Swett School District Administration building.

2.  CS Lands, Inc. acquired responsibility for complying with NPDES Permit No. CA0038750 (Order No. 98-037) on July 7, 2000.

3.  The purpose of the package plant permitted by Order No. 98-037 was to allow for closure of an existing sewage oxidation pond, thereby allowing remediation efforts of a nearby lead smelter to occur. However, the package plant was never constructed. To allow the sewage oxidation pond to be closed and to provide wastewater services, CS Lands intends to participate in constructing a sewer line to route domestic wastewater to Rodeo Sanitation District’s sewage collection system. Therefore, NPDES Permit No. CA0038750 is no longer necessary.

4.  The rescission of waste discharge requirements for this discharge is exempt from the provisions of Chapter 3 (commencing with Section 21000 of Division 13) of the Public Resources Code (CEQA) pursuant to section 13389 of the California Water Code.

5.  The Board has notified the above listed discharger and interested agencies and persons of its intent to rescind waste discharge requirements, and has provided them with an opportunity for a public hearing and an opportunity to submit their written views and recommendations.

6.  The Board, in a public meeting, heard and considered all comments pertaining to the rescission of waste discharge requirements for the above discharge.

IT IS HEREBY ORDERED that Order No. 98-037 is rescinded.
