ARTICLEII: AUTHORITY

(A)ThelegalauthorityfortheestablishmentandadministrationoftheState Mental Health PlanningCounciliscoveredinSections1911,1912,1913,1914(actualestablishmentparagraph)and1915,STATEMENTALHEALTHPLANNINGCOUNCIL,StatePlanforComprehensiveCommunityMentalHealthforcertainindividualsunderTitleII-BLOCKGRANTSTOSTATESREGARDINGMENTALHEALTHANDSUBSTANCEABUSE-SECTION201;ESTABLISHMENTOFSEPARATEBLOCKGRANTSREGARDINGMENTALHEALTH,PartBofTitleXIXofthePublicHealthServiceAct(42)UnitedStatesCode300xetseq.asamended,alsodescribedasPublicLaw102-321,theADAMHAReorganizationActasamended.

(B)Conformancewithapplicablefederalandstatelawsandrulesasamended. Thesebylawsmustconformtofederalandstatelawsandrulesasamended. Whereinconsistenciesarediscoveredorcreatedthroughlegislationorrulemaking,federalorstatelawsandrulestakeprecedence.

ARTICLEIII: PURPOSE

(A)DutiesunderFederalLaw: AfundingagreementforagrantunderSection1911ofPublicLaw102-321isthatthestateinvolvedwillestablishandmaintainaState Mental Health PlanningCouncilinaccordancewiththeconditionsdescribedinSection1914. Underthissection,thedutiesoftheCouncilare:

(1)ToreviewplansprovidedtotheCouncilpursuanttoSection1915(a)bythestateinvolvedandtosubmittothestateinvolvedanyrecommendationsoftheCouncilformodificationstotheplans.

(2)Toserveasanadvocateforadultswithseriousmentalillness,childrenwithsevereemotionaldisturbanceorotherindividualswithmentalillnessesoremotionalproblems.

(3)Tomonitor,review,andevaluate,atleastonceannually,theallocationandadequacyofmentalhealthserviceswithinthestate.

(B)Inaddition,thepurposeoftheCouncil SMHPCshallbetoprovideleadershipinthedevelopmentandimplementationoftheStateComprehensiveServicePlan(anorganized,community-basedsystemofservices)andtoadvocatethatpersonsservedbythatsystemachievetheirhighestattainabledegreeofindependence,productivityandintegrationintocommunitylifeandreceivequalityhealthservices.

ARTICLEIV: ACTIVITIES

Theactivitiesshallinclude,butnotbelimitedto,thefollowing:

(A)Advising: TheState Mental Health PlanningCouncilshalladvisetheDepartmentofChildrenandFamilies(DCF)onallaspectsofthedevelopment,implementationandmodificationofanynecessarystateorfederalcomprehensivementalhealthplans.Thismayincludefunding,coordinationofservices,qualityassuranceandpolicymattersrelatingtoDCFandanyotherentityinvolvedinmeetingtheneedsofindividualswithseriousmentalillness,seriousemotionaldisturbanceorco-occurringorsubstanceabusedisorders.

(B)MonitoringandEvaluation: TheState Mental Health Planning Councilshall,onacontinuingbasis,review,monitorandevaluatetheimplementationoftheStateComprehensiveServicesPlanandservicesysteminFlorida,provideforamethodtoevaluatethequalityofthatservice,andreviewtheallocationandusageofCommunityMentalHealthandSubstanceAbuseBlockGrantfunds.

(C)Reporting:TheState Mental Health PlanningCouncilshalltransmititscommentsandreportstotheGovernorofFlorida,DCFandtheCenterforMentalHealthServicesasrequiredbythestateandfederalstatutesgoverningitsactivities.

(D)Coordinating:TheState Mental Health PlanningCouncilshalladviseDCFtoachievegreatercoordinationofplanningandservicedeliveryeffortsamongthevariousagenciesinvolvedintheservicedeliverynetworkandshallcontinuallyworkforneededsystemexpansionandhighestqualityservice.

(E)Advocacy: TheState Mental Health PlanningCouncilshallserveasanadvocateforallindividualsneedingbehavioralhealthserviceswithinthestate.

(F)TheCouncilwilldevelopayearlyplantofulfillitspurpose.Inaddition,theCouncilwilldevelopaslateofadvocacyissuespriortoeachlegislativesession.

ARTICLEV: MEMBERSHIP

(A)TheauthorityforthemembersoftheState Mental Health PlanningCouncilflowsthroughthePresidentoftheUnitedStatestotheSecretaryofthefederalagencytheU.S.DepartmentofHealthandHumanServices. FurtherauthoritycomesfromtheU.S.Congressthroughtheblockgrants,andcontinuestotheGovernoroftheStateofFlorida,delegatedtotheSecretaryoftheDepartmentofChildrenandFamiliesoftheStateofFlorida.TheSecretaryhasdesignatedtheDCFDirectorofSubstanceAbuseandMentalHealthasthepersontoappointtheCouncilmembers.TheDirectorshallappointmembersfromthenomineessubmittedinaccordancewithArticleV,section(E).

(B)MembersoftheState Mental Health PlanningCouncilshallbeappointedfromamongtheresidentsofthestatewithconsiderationforreasonablegeographicandculturaldiversityrepresentationfromtheentirestate.

(C)The State Mental Health Planning Councilmembershipshallbeinaccordancewithrequirementssetoutinfederalandstatestatutesasamended.

(1)FederalLaw-AconditionforaCouncilisthattheCouncilistobecomposedofresidentsofthestate,includingrepresentativesof-

(a)Theprincipalstateagencieswithrespectto-

(i)Mentalhealth,health,education,vocationalrehabilitation,criminaljustice,housing,andsocialservices,and

(ii)ThedevelopmentoftheplansubmittedpursuanttoTitleXIXoftheSocialSecurityAct.

Representativesoftheprinciplestateagenciesareexemptfromtermlimitsandmaydesignateanalternatepersonorpersonstoattendmeetingsandvoteontheirbehalf.

(b)Publicandprivateentitiesconcernedwiththeneed,planning,operation,fundinganduseofbehavioralhealthservicesandrelatedsupportservices;

(c)Adultswithseriousmentalhealthillnesseswhoarereceiving(orhavereceived)mentalhealthservices;andadultswhoarereceivingorhavereceivedservicesforsubstanceabusedisorders;and;

(d)Thefamiliesofsuchadultsorfamiliesofchildrenwithemotionaldisturbance,co-occurringorsubstanceabusedisorders.

(2)CERTAINREQUIREMENTS-Aconditionundersubsection(a)ofSection1914ofPublicLaw102-321foraCouncilisthat

(a)WithrespecttothemembershipoftheCouncil,theratioofparentsofchildrentoothermembersoftheCouncilissufficienttoprovideadequaterepresentationofsuchchildreninthedeliberationsoftheCouncil;

(b)Notlessthan50percentofthemembersoftheCouncilareindividualswhoarenotstateemployeesorprovidersofservices.

(D)TheCouncilmayconsistofupto45members.

(E)ThereshallbeatleastonerepresentativefromeachoftheDCFcircuitsandregionsontheCouncil.Thirteenofthefifteen(87%)circuits/regionsthatareappointedCouncilmembersshallbeconsumersand/orfamilymembers.Throughattrition,fouroftheserepresentativeswillbeparents/guardiansofchildrenundertheageof18.Aparentmemberwho’schildreachesage19whiletheparentisstillamemberofgoodstanding,mayremainontheCounciluntilthechildreachesage22.

WheneveraCouncilmembershippositionbecomesvacant,staffwillnotifythechairoftheMembershipCommitteeofthevacancyandtheMembershipCommitteewillfindoneormoresuitablereplacementsandsubmitthenamesofthosecandidatestotheCouncil.TheCouncilwill,assoonaspossible,selectonecandidatefromthelistandsubmitthatnametotheDCFDirectorforfinalapproval.ThecandidatewillbecomeaCouncilmemberwhentheDirectorgivesfinalapproval.

(F)ThereshallbeonememberrepresentingtheNationalAllianceonMentalIllness.

(G)Thereshallbefourparents/guardiansofchildrenundertheageof18whoarereceivingorhaverequiredbehavioralhealthservices.

(H)Thereshallbeonememberrepresentingthe Florida Statewide Advocacy Council Disability Rights Florida.

(I)ThereshallbeonememberrepresentingtheFloridaCouncilforCommunityMentalHealth,Inc.

(J)ThereshallbeonememberrepresentingMentalHealthAmericaFlorida.

(K)ThereshallbeonememberrepresentingtheDepressionandBipolarSupportAllianceFlorida – DBSAFlorida.L) There shall be one member representing the Florida Peer N

(L)Thereshallbeonememberrepresentinga statewide organization focusing on children’s behavioralhealth issues

(M)ThereshallbeonememberrepresentingtheFloridaAlcoholandDrugAbuseAssociation

(N)the Florida Federation of Families for Children’s Mental HealthN)RepresentativesofprincipalstateagenciesaretobeappointedbytheFloridaDCFDirectorfromnominationssubmittedbythestateagencies. Theseagenciesshallinclude:AgencyforHealthCareAdministration(AHCA),DepartmentofCorrections(DOC),DepartmentofEducation(DOE),DepartmentofEducation-DivisionofVocationalRehabilitation(DOEVR),DepartmentofElderAffairs(DOEA),FloridaHousingFinanceCorporation(FHFC),DepartmentofHealth(DOH),DepartmentofJuvenileJustice(DJJ),DCFFamilySafetyProgram/OfficeofChildWelfareandCommunityBasedCare, DCFStateSubstanceAbuseandMentalHealthProgramOffice,andDCFOfficeofConsumerandFamilyAffairs.

(O) (N)One(1)youthrepresentativeshallserveasfullmemberofthePlanningCouncil. Youthshallbedefinedasapersonthatisbetweentheageof18and26whohasexperienceasbehavioralhealthconsumer.Theprocessofappointmenttotheplanningcouncilwillbethesameasanyothermembershipapplication,aslongasthecriteriaforyouthhasbeensatisfiedwiththeexceptionofthefollowing:

(1) Youthage:18-26inordertoensuretheirsuccessfulplacementontheCouncilwillbementoredbyanexperiencedcouncilmembertoensurethattheywillbeabletounderstandtheirroleasamember,ensurethattheirexpertisewillbefullyutilizedonthecouncilandthattheirvoicewillrepresentnotonlytheirownstrugglesbutthevaststrugglesoftheyouthpopulation.Theyouthrepresentativeisexpectedto:

(a)Attendcouncilmeetingsregularly

(b)Serveoncommitteesandsubcommittees

(c)Contributetothechildren’ssectionoftheBlockGrant

(d)Providecurrentreportsfromregionorcircuitrepresented

(P) (O)CouncilmembersshallattendaminimumoftwoCouncilmeetingsoutoffoureachyear. Attendanceviaconferencecallisacceptable. TheywillberequiredtonotifytheCouncilChairpersonwhentheyareunabletoattendameeting.

(Q) (P)AnymemberdesiringtoresignfromtheCouncilshallsubmithisorherresignationtotheChairpersonoftheCouncilinwriting.

(R) (Q)MembersshallserveontheCouncilwithoutcompensation,exceptthatmembersordesigneesshallbereimbursedfortravelexpensesassetforthintheAdministrativeRulesofFlorida.Reimbursementforotherexpenses;e.g.,attendantcareservices,interpretiveservices,telephone,postage,etc.,necessarytoallowforparticipationandfulfillmentofCouncilresponsibilitybyCouncilmembersshallbecoordinatedwithandapprovedbyDCF.TheCouncil(withDCFapproval),maygrantanexceptiontothisrulebasedonadeterminationthattheexceptionisintheCouncil’sbestinterestandisneededtoallowittoconductitsregulatorybusiness.

(S) (R)Membersshallserveforatermofthreeyears.Nomembershallservemorethanthreeconsecutivetermsandfourtotaltermsoveralifetime.

(T) (S)Anindividualwhobecomesamembershallimmediatelybeentitledtovote.

(U) (T)MembersoftheCouncilarerequiredtoactivelyparticipateononebutnotmorethantwostandingcommittees.Ifacommitteememberisnotparticipating,thechairofthatcommitteemayrequesttheirremovalfromthatcommitteeandseekareplacementthroughtheCouncilChairperson.

ARTICLEVI:MEETINGS

(A)ThetimeandplaceofmeetingsshallbedecideduponbythePlanning CouncilortheChairpersonincooperationwithDCFstaff.NoticeofmeetingsandproposedagendasmaybesenttothelastknownaddressofallmembersofthePlanning Councilatleastfifteendayspriortotheregularmeetingsifthememberdoesnothaveanemailaddressotherwisenoticeshallbeforwardedtomembersbyemail.Inaddition,advancenoticeofmeetingsandagendas(ifavailable)shallbepostedtothewebsiteatthesametimetheyareemailed. MembersareresponsibleforcontactingtheChairpersonorassignedDCFstaffiftheyareunawareofmeetingschedules.

(B)Specialmeetings,includingteleconferences,maybecalledbytheChairpersonandmustbecalledwithinfifteendaysofreceiptofaformalrequestbyamajorityofmembers.Fifteenworkingdaysnoticemustbeprovidedforspecialmeetings.

(C)Decisionsshallbemadebyasimplemajorityofmemberspresentwiththevotingbeingdonebyvoice,hand,orwrittenballot.

ARTICLEVII:QUORUM

Aquorumshallbethenumberofmemberspresent,providedthatatleasthalfofthosemembersareneitherstateemployeesnorprovidersofservices.

ARTICLEVIII: OFFICERS

(A)OfficersoftheCouncilshallbeaChairperson,themostrecentpastChairperson(ifstillamember),aVice-Chairperson,aSecretary,andaTreasurer. OfficersshallalsobemembersoftheExecutiveCommittee,whichmaybereducedorenlargedasdecidedbytheCouncil. Noofficershallserveinthesameofficeformorethantwoconsecutiveterms,atermbeingtwoyears.ExceptforbeingamemberoftheExecutiveCommittee,noofficershallholdmorethanoneofficeatatime.

(B)TheChairpersonshallpresideatallmeetingsoftheCouncilandperformallsuchdutiesrelativetotheoffice.TheChairperson,infurtheringthepurposeandactivitiesoftheCouncil,mayrepresenttheCouncilwithotherorganizations,atpublicmeetingsandconferences,ormaydesignateaCouncilmemberastheCouncil’srepresentative.TheChairpersonshallappointaParliamentarianfromtheCouncilmembership.TheParliamentarianshallretaintherighttovoteasaCouncilmember.TheChairpersonortheChairperson’sdesigneeshallbetheauthorizedspokespersonfortheCouncil.

(C)TheVice-ChairpersonshallactaschairpersonintheabsenceoftheChairperson. Intheeventofresignation,incapacity,ordeathoftheChairperson,theVice-ChairpersonshallserveasChairpersonuntiltheCouncilelectsanewChairperson.TheVice-ChairpersonshallperformotherdutiesasmaybeassignedbytheChairperson.

(D)TheSecretaryshallberesponsibleforassuringthatminutesofmeetings,attendancerecords,officialcorrespondenceandtransactionsoftheCouncilareprepared,andmaintained.IntheeventtheChairpersonandVice-Chairpersonareabsent,theSecretaryshallpreside.

(E)TheTreasurershallberesponsibleforannuallypreparingandoverseeingthebudgetinconjunctionwiththecommitteechairsforoperationsofthecouncil.TheproposedbudgetwillbesubmittedtotheExecutiveCommitteeandthentothecouncilforapprovalnotlaterthanthefirstquarterlymeetingforthenewfiscalyear.TheTreasurershallmonitorallfundsreceivedbyorallocatedtothePlanningCouncilinaccordancewiththerules/proceduresasestablishedbytheCouncilandDCF.TheTreasurershallreportonthefinancialstatusoftheCouncilateachregularlyscheduledmeeting.TheTreasurershallmaintaincouncilfinancialreportsandbepreparedtopresentstatuswhenrequested.

ARTICLEIX: COMMITTEES

(A)TheCouncilshallhavenecessarystandingcommitteestoadequatelyconducttheaffairsoftheCouncil.

(1)ThereshallbeanExecutiveCommitteecomprisedoftheChairperson,Vice-Chairperson,Secretary,TreasurerandthepastpresidingChairpersonoftheCouncil. ThecommitteeshallhavethedutyofactingonemergencymattersarisingbetweenregularmeetingsoftheCouncil. ThiscommitteeshallalsomakespecificrecommendationstotheCouncilinordertocontinueand/orimprovetheeffectivenessoftheCouncilinfulfillingitsresponsibilities.

(2)ThereshallbeaMembershipCommittee.Thiscommittee’sresponsibilityistorecruitandnominatenewmemberstoserveontheCouncil.Thecommitteewillalsoorientallnewmemberswithregardtoresponsibilities,duties,andprocedures,andshallcontinuetoprovideongoingtrainingtotheCouncil.

(3)ThereshallbeaLegislativeAdvocacyCommittee.Thiscommittee'sresponsibilityistohelpfulfillthefederalrequirementfortheCouncilof"advocatingforadultswithseriousmentalillnessandchildrenwithseriousemotionaldisturbanceormentalillnessandallpersonswithco-occurringdisordersorsubstanceabusedisorders.."TheCommitteeisresponsibleforfacilitatingaccesstolegislatorstoprovideinput,feedbackandinformationdesignedtoeducatelegislatorswhoareinvolvedinthedecision-makingprocessrelativetoissuesandconcerns.TheCommitteewillalsoprovidetechnicalassistancetoCouncilmembersinthefollowingways:(1)maintaincollaborativerelationshipswithproviders,advocacygroups,andDCFagencyrepresentativesinordertoconveyconsistentandrelevantinformationregardingmentalhealthissuesthatneedtobeaddressed;(2)conductregulartrainingsessionsatappropriatelytimedCouncilmeetingsonhowtoapproach/contactlegislators;(3)providesampleletters,talkingpoints,andotherhelpfultoolstoCouncilmembers;and(4)encourageCouncilmemberstomeetwithlocallegislatorswhentheLegislatureisnotinsession.

(4)ThereshallbeaMonitoringCommittee. Thiscommittee’sresponsibilityisdirectlyrelatedtothefederalrequirementforthecouncilof
“MonitoringandevaluatingtheallocationandadequacyofmentalhealthserviceswithinFlorida.” TheCommitteeshallalsoincludetheallocationandadequacyofsubstanceabuseserviceswithinFloridaintheirassignedareaofresponsibility.Councilmembersprovideuniqueperspectivesandexperiencesdeterminingthedegreeofsatisfactiontheconsumersandfamilieshavewithservicesprovidedbythepublicservicesystem.Thegoalofthisgroupistoenhanceexistingmonitoringprocedureswithconsumerandfamilyinvolvement.

(5)ThereshallbeaBlockGrantReviewCommittee.Thiscommittee’sresponsibilityistotrackallapplicationprocessesandactions,andreviewtheBlockGrantApplicationprovidedtotheCouncilpursuanttosection3004-4(a)ofthistitlebyDCFandtosubmittoDCFanyrecommendationsoftheCouncilformodificationstotheapplication.

(6)ThereshallbeaChildrenandFamiliesCommittee.Thiscommitteewilladvocateandaddressareasofconcernregardingchildrenandfamilies.

(7)ThereshallbeaNominatingCommittee.ThiscommitteewillconsistofaChairperson,andonepersonfromatleastfouroftheappointmentcategories,whichincludesaCircuitRepresentative,SEDParent,ProviderorAdvocacyandStateAgencyrepresentative.

(B)CommitteemembersshallbeappointedfromtheCouncilmembershipbytheChairperson,takingintoconsiderationrequestsbytheCouncilmembershiptoparticipateinspecificcommittees.

(C)TheChairpersonmayappointadhoccommitteememberswhoarenotCouncilmembers,providedthatnon-councilmembersshallnotparticipateinCouncilvoting.

(D)TheChairpersonshallbeamemberofallcommittees.

(E)TheChairpersonmayformadditionalcommitteesastheneedarises.

ARTICLEX:NOMINATIONSANDELECTIONS

(A)Officersshallbeelectedbi-annuallybyCouncilmembersatthefirstregularquarterlymeetingofthecalendaryear.Alltermsshallbefortwoyears. NewlyelectedofficersshalltakeofficeimmediatelyuponadjournmentofthePlanningCouncilmeeting.

(B)NominationsforCouncilofficesshallbemadetotheNominatingCommitteeatanytimethroughouttheyearupto45dayspriortothefirstquarterlymeeting. Membersmaynominateanothermemberandmembersmayself-nominate.

(C)Nolaterthan30dayspriortothemeetingatwhichelectionsaretobeheld,aslateofcandidatesconsistingofalleligiblecandidatesshallbeforwardedtoCouncilMembersalongwithabriefletterfromeachcandidatestatingthattheywishtorunforoffice,whichofficetheyseek,andincludesabriefparagraphastowhytheywishtoserveinthisoffice.AbriefbiographyorresumeshallbeprovidedbyeachcandidateandshallbeincludedalongwiththeslateandlettersinthepackettoCouncilmembers.

(D)Allmemberspresentshallbeallowedtovote.Allofficersshallbeelectedbyamajorityvoteofthoseinattendance.

(E)Votingshallbedonebywrittenballot.ThenameofthevotingCouncilmembershallnotbewrittenordisplayedontheballot.

(F)TheballotsaretoconsistofpiecesofpaperofconsistentsizeandcoloruponwhichtheCouncilmemberselectionsarehandwritten. BallotsshallbecollectedandcountedbypersonschosenforthistaskbyDCFwhoshallnotbeemployeesoftheStatePlanningOffice. Theyshallimmediatelytabulatetheresultsandannouncetheresults.

(G)Intheeventofatie,theelectionshallbedeterminedbythetossofacoin,tobecarriedoutbypersonsdesignatedtocollectandtabulateballots.Iftherearemorethantwonomineesforanyoffice,theonereceivingthefewestvotesshallbeeliminatedduringeachroundofvotingnecessaryuntilonlytwonomineesremain. Iftherearetwocandidatestied,andanothercandidatewithmorethaneitherofthetwo,thetwo-waytieshallbedeterminedbythetossofacoin.

(H)Intheeventanofficercannotcarryouttheirtermofoffice,thevacancyshallbe filledbyamajorityvoteofthoseinattendanceatthenextCouncilmeetingafter thevacancyoccurs.Allnominationsshallbefromthefloor,eitherbymembers nominatingothermemberswhoarepresent,orbyself-nomination.Officersso electedshallbeeligibleforelectiontothatofficeforthenextfullterm.

ARTICLEXI: PARLIAMENTARYAUTHORITY

CouncilmeetingsshallbeconductedinaccordancewiththerulescontainedinthecurrenteditionofROBERT’SRULESOFORDERNEWLYREVISEDinallcasesinwhichtheyareapplicableprovidedthattheyareconsistentwiththesebylawsandanyspecialrulestheCouncilmayadopt.

ARTICLEXII: AMENDMENTOFBYLAWS

CouncilbylawsmaybeamendedatanymeetingoftheCouncilbyasimplemajorityvoteoftheCouncilmembershipwhoarepresentinpersonorbytelephone,exceptthatifaproposedamendment(s)hasnotbeendistributedtoallCouncilmembersatleastthirtydayspriortothedateofthemeeting,suchamendmentrequiresa2/3favorablevote.

ARTICLEXIII: CONFLICTOFINTEREST

Amemberwhoisanindividual,employee,officer,ordirectorofany:firm,corporation,department,facilityoragencyshallabstainfromvotingonCouncilmatterswhichpresentaconflictofinterest,e.g.fundingtoaprograminwhichtheyareasalariedemployeeoramemberofthegoverningoradvisoryboard.Arecordofabstentionsshallbepartoftheminutes.

ARTICLEXIV: DESIGNATEDSTATEAGENCY

TheCouncilshallbeassignedtotheDepartmentofChildrenandFamilies(DCF)oftheStateofFlorida.

ARTICLEXV: COUNCILSTAFF

TheDepartmentofChildrenandFamilies(DCF)oftheStateofFloridashallprovidetechnicalassistanceandstaffsupporttotheState Mental Health Planning Council.
