STATEMENT OF WORK

DEPARTMENT OF STATE

BUREAU OF COMMISSION, ELECTIONS, AND LEGISLATION

FOR THE

EXAMINATION, REEXAMINATION AND APPROVAL

OF ELECTRONIC VOTING SYSTEMS

  1. General Information

The Secretary of the Commonwealth desires the assistance of professional and specialized services in the performance of his statutory duties with respect to the examination, reexamination, and approval of electronic voting systems pursuant to Section 1105-A of the Pennsylvania Election Code, at 25 P.S. § 3031.5.

  1. Statement of Work

The Contractor shall assist the Secretary of the Commonwealth in the performance of his statutory duties with respect to the examination, reexamination and approval of electronic voting systems pursuant to Sections 1105-A and 1107-A of the Pennsylvania Election Code at 25 P.S. § 3031.5 & § 3031.7. Specifically, the Contractor shall assist the Secretary of the Commonwealth in the following, as and when requested by:

  1. Examining and/or reexamining electronic voting systems to ensure that the systems comply with the requirements for electronic voting systems delineated in Section 1107-A of the Election Code at 25 P.S. § 3031.7, including the Pennsylvania Method at 25 P.S. §3031.7(3), and:
  2. Examining and/or reexamining electronic voting systems in accordance with any testing standards developed by the Secretary or at his direction.
  3. Preparing a report for the Secretary which shall:

(1)Include specific test cases and test cases results that will demonstrate the examiner tested the system against the standards in the Election Code and any testing standards developed by the Secretary;

(2)Contain the Contractor’s recommendation regarding whether the system examined can be safely used by voters at elections;

(3)Contain the Contractor’s conclusion about whether the system meets all of the requirements specified in Section 1107-A of the Election Code and the testing standards developed by the Secretary;

(4)Documents the results of all the test casesand provides recommendations regarding modifications or conditions to certification;

(5)Be submitted to the Secretary within thirty (30) days after the date of the examination.

  1. Drafting or editing forms and other required documents;
  2. Reviewing source code or other computer code related to the voting system;
  3. Reviewing documents submitted by vendors and identifying system specifications and other elements of system documentation that require clarification or additional explanation;
  4. Reviewing and evaluating electronic voting systems reports; and
  5. Providing expert or fact testimony, if required, in regard to any work performed under this Statement of Work.
  1. Qualifications

In order to qualify, the Contractor shall meet the requirements set out in either Subsections A, B, C and D (noted below), or Subsections A, B, and C, or Subsections A, B, and D. Please note that Subsection E is not a mandatory requirement, but highly desired.

  1. Possess a BS degree in Engineering, or BA in Computer Science or equivalent field with a higher level degree highly desirable;
  2. Possess experience in evaluating computer systems hardware and software to a specific set of requirements, rendering recommendations and procedures as a result of these reviews;
  3. Possess demonstrable expert knowledge of computer systems hardware and software and experience in evaluating system components and system integration to optimal standards. Specific expertise in electronic voting systems or other mission critical and sensitive computer systems highly desirable. This knowledge must be demonstrated within the resume, CV or other document;
  4. Possess demonstrable knowledge preventing, identifying and mitigating vulnerabilities and other security risks in mission critical and sensitive computer systems both hardware and software. This knowledge must be demonstrated within the resume, CV or other document;
  5. Certification in the computer science discipline highly desired.
  1. Confidentiality Provision

The Contractor agrees that he/she will not posses, obtain, or acquire, either directly or indirectly, a pecuniary interest in or any contract with, any business entity involved in the development, manufacture, marketing, or sale of electronic voting system equipment, hardware or software or in any components thereof, during the pendency of this contract. Prior to performing an examination of any electronic voting system, the Contractor shall sign and submit the attached Consultant Confidentiality Statement to the Secretary of the Commonwealth through the Bureau of Commissions, Elections and Legislation.

Notwithstanding the provisions of any Confidentiality Statement, it is understood and agreed that Consultant performs similar electronic voting system examination services for other federal, state or local governments, and must at all time remain free to disclose to any such jurisdiction anything he or she may learn during the performance of services under this Statement of Work that relates to the use or certifiability of a voting system in such jurisdiction. Conversely, the Department expects that the examiner will share any information learned as a result of work in other jurisdictions that is relevant to the testing performed for the Commonwealth pursuant to this Statement of Work, especially any flaws, anomalies, security risks or other relevant information.

  1. Quote Format

The quote from the Contractor shall list the hourly rate to be charged. Travel, lodging, and subsistence costs will be paid in accordance with the Commonwealth’s Management Directive.

  1. Payment
  1. Payment for professional services shall be based on the hourly rate as set forth in the contractors quote and can be invoiced on a monthly basis. The Contractor shall invoice the Department for the actual number of hours worked. A final payment will only be made after a final report has been properly completed and approved by the Secretary of the Commonwealth.
  2. All invoices must be submitted within ninety (90) days of the work being performed. Otherwise, the Department of State will not be responsible for this payment.
