Notice is hereby given that on December 23, 2015, Bryan R. and Odelia R. Delgado, P.O. Box 741, Reserve, New Mexico 87830, filed application GSF-2789-1 into GSF-4361-1 with the State Engineer for permit to Change Point of Diversion and Place of Use of Underground Waters in the Gila-San Francisco Underground Water Basin to change from existing Reserve area well GSF-2789 located in the SW¼NE¼SW¼ of Section 12, Township 7 South, Range 19 West, N.M.P.M. for an amount of water not to exceed 3.0 acre-feet per annum on land located in Pt. SW¼NE¼SW¼ of Section 12, Township 7 South, Range 19 West, N.M.P.M. for domestic and stock purposes and commence the use of existing Reserve area well GSF4361-POD1 drilled to a depth of 345 feet and constructed with a 4.0 inch casing located at a Latitude of 33° 38’ 57.3” North and Longitude of 108° 47’ 9.3” West located in the SW¼NE¼SE¼ of Section 34, Township 7 South, Range 19 West, N.M.P.M. and river sump pump SP-5092 to be used as an additional point of diversion located at a point in the N½SE¼ of Section 34, Township 7 South, Range 19 West, N.M.P.M. for an amount of water not to exceed 3.0 acre-feet per annum on land located in Pt. SE¼ of Section 34, Township 7 South, Range 19 West, N.M.P.M. for domestic and stock purposes. The property described in this application is located near the Lower Frisco Plaza in Reserve, New Mexico in Catron County.

Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (objection must be legible, signed, and include the writer’s complete name, phone number and mailing address). The objection to the approval of the application must be based on: (1)Impairment; if impairment, you must specifically identify your water rights; and/or (2)Public Welfare/Conservation of Water; if public welfare or conservation of water within the state of New Mexico, you must show how you will be substantially and specifically affected. The written protest must be filed, in triplicate, with the State Engineer, P.O. Box 844, Deming, NM 88031, within ten (10) days after the date of the last publication of this Notice. Facsimiles will be accepted as a valid protest as long as the hard copy is hand-delivered or mailed and postmarked within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protests can be faxed to the OSE at 575-546-2290. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with the provisions of Chapter 72 NMSA 1978.
