The regular meeting of the St. Louis Brownfield Task Force was called to order by Chairman Don Schurr on Monday, November 20, 2006 at 4:00 p.m.

Moved by McClintic, supported by Bessert, to approve the minutes of the October 16, 2006, meeting. All Ayes

Update Rowley Church Property

Building demolition is complete. 2 additional tanks were discovered. Have a change order from Bierlein Environmental in the amount of $7,700.00.

Moved by Bessert, supported by McClintic to approve Change Order No. 1 to Bierlein Environmental in the amount of $7,700.00 All Ayes. Motion Carried.

Railroad has affirmative obligation to clean up property. Dave VanHaaren will send a letter to the railroad regarding their obligation.

Assessment Grant Application for 2007 was discussed. Moved by McClintinc, supported by Brush to request council to approve Grant Application for 2007. All Ayes, Motion Carried.

Corner of Center and Mill (IGA Lot) Update

Project is complete. Removed 3 UST’s no signs of leakage. AKT will prepare a clean closure next week.

Great Lakes Petroleum Update

Sampling results are in. Clean site.

Budget Update:

Allocation of $1,817.29 Travel expense to Rowley Church demo.

Moved by Brush, Supported by McClintic to approve payment to AKT Peerless for UST Activity IGA Lot in the amount of $1,002.50. All Ayes. Motion Carried.

Moved by McClintic, supported by Bessert to approve payment to AKT Peerless for 1507 Virginia Street BEA in the amount of $1,510.86. All Ayes. Motion Carried.

Moved by Allen, supported by Brush, to approve the minutes of the September 18, 2006, meeting. All Ayes

Update Rowley Church Site

Members discussed demolition of the site. Railroad (RR) response was received and they require $900.00 for an access agreement. At the time of completion, $80,000 will have been spent to clean up their site. Phil Hansen will send a certified letter to RR informing them of the demolition date. It was the concensus of the committee to make recommendation to the City Council to authorize to proceed with demolition once letter is sent.

Moved by George, supported by Harold to make recommendations to the City Council for authorization to proceed with the demo of the Rowley Church site without an access agreement once certified letter is sent with date of demolition. All Ayes

Update Corner of North and Mill (IGA Lot Parcel)

Tank removal is tentively scheduled for October 23rd and 24th. Dave will confirm the dates and contact will be made with IGA and Department of Public Works. Once complete, limestone, sand & gravel will be placed on the site.

Update Great Lakes Petroleum

AKT has details worked out with Great Lakes Petroleum (GLP), John Byle. Sampling will begin Tuesday. AKT Peerless will do an updated Phase I and hope to have the BEA by the November meeting.

Update on Project Budget

IGA Parcel is expected to be under budget. Approximately $2,000.00 will be left. Approximately $1,900.00 will be available from the travel line item. Will not need budget amendments approved by EPA when it is less than 10% .

Approve Payment to AKT for Phase II activities at the IGA Parcel

Moved by Harold, supported by Julie to approve payment to AKT Peerless for September Phase II activities at the IGA lot in the amount of $4,850.10. All Ayes

Moved by Bessert, supported by Allen to approve the minutes of the August 21, 2006, meeting. All Ayes

Update – Rowley Church Site Access.

After numerous attempts to contact the railroad for site access, still have had no response from the railroad. City Manager McConkie will consult with City Attorney David Meyer for written opinion regarding access to the Rowley Church property. Moved by Kubin, supported by Bessert to have City Manager McConkie submit written opinion from city attorney to the City Council and secure approval to proceed with demolition.

Update – IGA Parcel-Acquisition, BEA and UST Removal.

Tank tests are complete. The property consists of a 3,000 gallon tank containing 1” product the rest water, a 2,000 gallon tank containing 1” product with the rest water and a 550 gallon tank containing 1” sludge. There will be additional costs of approximately $1,500, AKT will provide an updated proposal.

Update – Great Lakes Petroleum

There have been discussions between AKT and GLP Attorney, John Byl regarding differences of opinions on what testing is required. The project is moving forward.

Update – Project Budget

There has been no change in the budget since the August 21, 2006 meeting.

Moved by Melissa, supported by Harold to approve the minutes of the July 17, 2006, meeting. All Ayes

Update – Rowley Church Site Access.

No response from Railroad for City obtaining Title to property. Todd Cecil from the Railroad is supposed to be in Michigan late August, early September. D. VanHaaren will contact Mike Gifford, EPA and sent copy of report to DEQ. City Manager will contact Ben Hall, DEQ. Don Schurr will continue trying to get a response from the Railroad. In order to apply for a clean up grant in the fall, the current grant money has to be used/allocated and the city has to own the property.

Update IGA Phase II and UST Removal Costs.

D. Vanhaaren stated contamination was below tanks, approx. 20’. Around the tanks was clear, possibility tanks are dry. There are two tanks in right-of-way and one tank at the auto repair site. Phase II is complete. Next step is BEA. City Manager will present Council with proposal for tank removal in the amount of $8,159.50 September 5, 2006 plus AKT fees to coordinate and oversee project in the amount of $1,200.00 Moved by Melissa, supported by Bernie to request City Council approve the tank removal costs.

Great Lakes Petroleum BEA

Records have been sent to GLP Attorney, John Byl. Part of property will require a category S BEA, that will require to except out. The remaining property will have a Category N BEA. Estimated Geo Physical study will cost approx. $25,000.00. There is $21,000.00 grant money allotted for GLP project. The remaining $4,000.00 will be GLP responsibility.

Moved by Bernie, supported by Julie to approve payment to AKT for IGA Lot Phase II Site Investigation Activities for August in the amount of $4,867.44. All Ayes, Motion Carried.

Moved by Bernie, supported by Harold to approve the minutes of the June 19, 2006, meeting correcting the spelling of Bierlein. All Ayes

Update – Rowley Church Property Demolition

Bids are in, notified Bierlein access agreement was needed from Railroad before demolition can begin. Don Schurr has made several attempts to contact Todd Cecil and have had no response. Will continue trying. Phil Hansen will contact Attorney David Meyer to see what other options we have for demolition if an access agreement isn’t obtained.

Update - IGA Lot

Geothermol study showed possibly four UST’s. Dave VanHaaren will revise Sampling Plan for approval from Mike Gifford, EPA, then Phase II sampling can begin. City Manager inquired as to what point the City should take possession. Dave VanHaaren stated possession should not take place until tanks are removed. City Manager will get City Council approval to purchase contingent upon tank removal. Dave VanHaaren estimated tank removal cost to be 8,000 – 15,000 probably closer to $15,000 for all four tanks. Dave VanHaaren will get quotes and check into possible Refined Petroleum Grant through the State for tank removal.

Update – Great Lakes Petroleum

Great Lakes Petroleum (GLP) currently leases their property. Plans are to purchase the property along with the vacant City Lot and the DMH Property. They have requested the remaining grant money be used for assessment of the properties. Dave VanHaaren will bring cost estimates to next meeting.

Moved by Bernie, supported by Harold to approve to allegate remaining grant funds for GLP with the understanding that GLP is responsible for anything over and above the grant funds that are left after other commitments are met by the City.

Update – Rowley Church Property Demolition

The bid from National Environmental Services was received for $29,0900.00 plus $3.00 per gallon over 300 gallons for liquid removal.

The bid from Bierlein was received for $29,200.00 plus .92 per gallon over 300 gallons for liquid removal.

Dave VanHaaren recommended Bielein be hired for demolition but would like them to remove the concrete and bring in gravel instead of crushing the concrete on site.

Moved by George, supported by Bernie to approve to award the demolition bid to Bierline and for Don Schurr to contact Todd Cecil from the Rail Road on the property transfer and an access agreement. All Ayes

Update – IGA Phase II

Phase II has begun. Sampling Plan will be sent this week to Mike Gifford. Property purchase request will be presented to City Council and the July 5th meeting. By the end of June, AKT will know if there is a tank at the site. Will have DPW cone and tape the area so work can be performed by AKT. Dave will give 2 day notice prior to work being started.

Update – Great Lakes Petroleum

Dave has sent copies of Phase I, Phase II and CMI closeout documents to Jeff Plott’s attorney.

Budget Update

Budget includes demolition of Rowley Church, sampling Plan asbestos and tank removal. $21,400 left of Grant Funds after Phase II at IGA lot and Great Lakes Petroleum Phase I.

Planning and Discussion of future targeted sites for EPA Assessment and Cleanup Grant Applications for Fall 2006

Can apply for $200,000 clean up grant for Rowley Church, $200,000 clean up grant for IGA lot, $200,000 Hazardous Substance Grant, and $200,000 Petroleum Substance Grant.
