Bronco Oil Company d.b.a. Northern Energy v Clawson Tank Company, MDEQ, et al

At a hearing on May 3, 2007, the Court dismissed Thomas H. Buttrick, Hazardous Materials Storage Inspector, with prejudice. The Court also ordered the remaining defendants into mediation to resolve remaining claims against the remaining defendants.

On February 23, 2006, Bronco Oil Company (Bronco) filed a complaint against the Clawson Tank Company, the Michigan Department of Environmental Quality (DEQ), Thomas H. Buttrick, Oscar W. Larson Company, Robert Fisher, and Steel Tank Insurance Company in the 46th Circuit Trial Court (Court), Otsego County, Michigan. Bronco Oil Company alleges that plaintiffs caused Bronco harm in a matter related to the alleged failure of an underground storage tank. The complaint asks the court to award damages and such other further relief that the court deems just and equitable. On April18, 2006, the Court heard arguments regarding the State Defendants’ Motion to Dismiss. The Court dismissed the DEQ without prejudice because the Court does not have jurisdiction over the DEQ in this matter but did not dismiss the remaining defendants.
