FACILITY USE AGREEMENT

Parish facilities at ST. MATTHEW’S, Boyne City, ST. AUGUSTINE, Boyne Falls, and ST. JOHN NEPOMUCENE, may be used by active parishioners or for parish sponsored activities, or for approved community outreach groups. Special exceptions may be considered at the discretion of the Pastoral Council and Pastor/Pastoral Administrator.

Events may not be scheduled on Saturday’s, generally between 3:00 p.m. and 7:00 p.m. and Sunday’s before 1:00 p.m. or other times and dates when events may conflict with church functions or liturgies, except with prior approval of the Pastor/Pastoral Administrator.

An active parishioner is one who is registered and contributes to the support of the parish. The best evidence of such support is the use of weekly envelopes.

Community outreach (for example; Senior Citizens, Scouts, 4-H, TOPS, Garden Club, School, Community service groups, and other noon-profits) is exempt from the MCC liability insurance in this agreement.

TERMS:

1.Use of the facilities must be for activities consistent with the teachings and traditions of the Roman Catholic Church.

2.All activities or events not sponsored by the parish or considered approved community outreach groups will pay the insurance premium REQUIRED BY THE MICHIGAN CATHOLIC CONFERENCE no later than seven (7) business days before the start of the event. Call the parish office for current rates.

3.If the event takes place outside of regular business hours (currently 8:30 a.m. to 5:00 p.m. Monday through Friday), the user will pay $15.00 per hour for an on-duty CHURCH EMPLOYEE to oversee clean up and miscellaneous issues. This fee must be paid at the same time as the MCC insurance premium in advance of the event. If your estimated time runs over, you must pay the overseer the difference before you leave.

4.The building will be left as clean as you found it, mop and vacuum floors, clean tables, etc., as needed, including trash containers emptied into the dumpster or a cleaning charge will apply. No decorations are to be nailed, thumb tacked, stapled, glued, scotch taped (with the exception of masking tape) to any painted surface, wall dividers, ceiling tiles, etc. Unless waived, a cleaning deposit of $100.00 (one-half of which is refundable if all above criteria is met) is required with the completed application. All damages to the premises or other property of the parish caused by the user or guest or otherwise related to this use agreement shall be the responsibility of and paid by the user.

5.ALCOHOL is not allowed.

6.NO SMOKING is allowed anywhere in the building complex.

7.As responsible neighbors, sound level should not be audible outside the building, and all music must stop by 11:00 p.m.

8.During weekdays all events or activities must conclude no later than 10:00 p.m. During weekends all events or activities must conclude no later than midnight. Clean-up crews may take longer as needed to finish clean-up, before leaving.

9.If the facility is to be used for dancing purposes, the user is required to bring in a portable dance floor at their own expense to protect floors.

10.Users are asked to consider a donation for the use of the facility as follows:

Parishioners:$150.00

Community Outreach Groups:$200.00

11.Scheduling conflicts will be resolved by the Pastoral Council and Pastor/Pastoral Administrator.

12.If parish table linens are used, a charge of $3.00 per table cloth and $.50 per cloth napkin will be payable in advance to cover laundering expenses. Linens may not be taken out to be laundered by user.

13.Licensee and guests agree to hold harmless and indemnify the BISHOP OF THE DIOCESE OF GAYLORD, and ST. MATTHEW, Boyne City, ST. AUGUSTINE, Boyne Falls, and ST. JOHN NEPOMUCENE, Praga, and their successors, agents, assigns, representatives and employees (“Releasees”), from any and all losses, damages, attorney fees, expenses or other moneys expended by said Releasees resulting from claims or actions brought against said Releases which in any way, directly or indirectly, arise out of the use of said premises by Licensees.

14.Licensee shall obtain and maintain, at Licensee’s expense, insurance coverage for Licensee’s use of the Facilities for the event and the BISHOP OF THE DIOCESE OF GAYLORD and ST. MATTHEW, Boyne City, ST. AUGUSTINE, Boyne Falls, and ST. JOHN NEPOMUCENE, Praga, as additional insureds with minimum limits of liability of $1,000,000.00 each occurrence for bodily injuries and property damage. Licensee must provide proof of insurance prior to the date of the Event. Said insurance requirements shall not negate or otherwise limit Licensee’s indemnification obligations set forth above.

ACCESS:

The facilities will be available for decorating the afternoon preceding the day of use. This assumes it is not required to accommodate a church function. No tape or tacks may be used on walls.
