REQUEST FOR BIDS
PREPARATION OF BIDS
Bids must be placed in a sealed envelope and marked:
Intercontinent Briefs for Laurel Crest
The name and address of the vendor must be marked on the sealed envelope.
DELIVERY OF BIDS
Bids must be received in the Cambria County Controller’s Office, Cambria County Courthouse, 200 South Center Street, Ebensburg, Pennsylvania, 15931, by 3:00 p.m., Tuesday, March 22, 2005.
Bids received after the stated date and time will be rejected.
OPENING OF BIDS
Bids will be opened at 10:00 a.m., Wednesday, March 23, 2005, in the Cambria County Commissioner's Board Meeting Room.
INQUIRIES AND ADDENDA
All inquiries should be directed to Tara N. Keilman, Cambria County Deputy Chief Clerk, Phone Number (814) 472-1602. Cambria County will not be responsible for any oral instructions.
ORIGINAL BID AND COPIES
The vendor must submit one original Bid and two (2) exact copies. The original bid must be marked on the front “ORIGINAL, as well as, the copies must be marked on their front “COPY”.
RESPONSIBILITY OF VENDOR TO MAKE NECESSARY INVESTIGATIONS
Before submitting a bid, each vendor shall make all investigations and examinations necessary to ascertain all conditions and requirements affecting the full performance of the contract. Ignorance of such conditions and requirements will not relieve the successful vendor from its obligations to comply in every detail with all provisions and requirements of the contract and will not be accepted as a basis for any claim whatsoever on the part of the successful vendor.
EXPENSES INCURRED IN PREPARING BID
Cambria County accepts no responsibility for any expense incurred by the vendor in the preparation and presentation of a bid and any such expenses are to be borne exclusively by the vendor.
BID BOND
An original bid bond in the amount of ten percent (10%) of the total bid must be submitted with the bid.
The bid bond must be in the form of a certified check, cashier’s check or bid bond with good and sufficient security. The payee in this instance shall be "County of Cambria, Pennsylvania."
Any bid received not containing an original bid bond will be rejected.
WITHDRAWL OF BID
No bid or any portion thereof may be withdrawn after the opening time on the opening date.
AWARD OF BID
The bid will be awarded to the lowest responsible compliant bidder.
NON-COLLUSION AFFIDAVIT
Each vendor is required to execute a Non-Collusion Affidavit.
Any bid received not containing a properly executed affidavit will be rejected.
TERMINATION NOTICE
Cambria County may immediately terminate this contract, without cause, with written notice.
RIGHT TO ACCEPT OR REJECT BIDS
Cambria County reserves the right to accept or reject any or all bids and to waive any informalities or irregularities in the bids received, and accept any bid which is deemed most favorable to the county.
CHOICE OF LAWS
This contract shall be adjudicated, governed, and controlled in all respects as to validity, construction, capacity, performance, or otherwise by the laws of the State of Pennsylvania.
EXCISE AND/OR TRANSPORTATION TAXES Deliveries against this contract must be free of excise or transportation taxes.
QUANTITIES
It shall be understood by all parties concerned that any contract established as a result of this request will not obligate Cambria County to receive any quantity in excess of actual requirements. Quantities shown are classified as estimates for bidding purposes.
TERM OF CONTRACT
The term of this contract is for one-(1) year, with the option to renew for additional one-(1) year terms, at the sole discretion of the Board of Commissioners.
MANUFACTURER'S TRADE NAME
The mention of any manufacturer's trade name is only for the purpose of designating a standard of quality and for no other purpose. The vendor must supply at no cost to Cambria County, samples of any item. Also, the vendor is required to state the name and grade of said item along with specifications in writing.
CRITERIA FOR AWARDING BID
The criteria for awarding this bid is:
1. a. Compliance with specifications
b. Acceptable performance of sample product tested by Laurel Crest.
2. Cost of product.

8. Successful bidder must have adequate stock available to provide shipments
within one week or less after receipt of order. If bidder fails to deliver within
one week after receipt of order, the county may terminate contract
immediately, with notice, and without recourse.
9. Orders will be placed on an as-needed basis.
10. Product shipped must be the same as sample product submitted at time of bid. If
product is not the same upon inspection of shipment, shipment will be
refused/returned at no charge to Laurel Crest and the county will terminate the
contract.
11. Bid will be awarded based on results of testing samples provided, and cost.
Bids that submit briefs that are unacceptable, as a result of testing, will be
rejected.
12. Samples must be submitted under separate cover letter, labeled on the envelope/box “INTERCONTINENT BRIEFS SAMPLE” by bid due date to:
