Uniform/Equipment turn in- within 7days of the end of the season or deposit checks will be cashed.
2018 Bethel Blackhawks/GK Lacrosse Rental Agreement
In consideration of the terms and conditions of this Agreement and other good and valuable consideration, the receipt and adequacy of which are hereby acknowledged, the undersigned agree to rent the following lacrosse equipment Bethel Blackhawks/GK Lacrosse Club for the amount of $______for one lacrosse season (2018 Spring Season) and will return the equipment to Bethel Blackhawks/GK Lacrosse Club. The Bethel Blackhawks/GK Lacrosse Club will hold the Security Deposit and will return it to the renter when the equipment is returned. If the equipment is not returned within 7 days from the end of the Season, at the Bethel Blackhawks/GK Lacrosse Club discretion they may deposit the Security Deposit to either (a) be applied toward the cost of replacing the equipment, or (b) be applied toward additional rental rates as set forth in the Terms and Conditions of this Agreement. There will be no refunds of the rental amount after 7 days from pickup of the equipment.
The equipment is accepted by the undersigned AS-IS/WHERE-IS, together with all faults. Bethel Blackhawks/GK Lacrosse Club makes no representations or warranties of any kind as to the rented equipment, including, but not limited to, its fitness for a particular purpose.
The undersigned do hereby unconditionally and forever release and indemnify, and agree to defend and hold harmless, Bethel Blackhawks/GK Lacrosse Club, together with its board members, managers, members, employees, and affiliates, from and against any and all claims for personal injury (including death), property damage or any other claim, cause of action, damage or liability (including, but not limited to attorneys’ fees and litigation expenses) resulting from or arising out of the undersigned Player’s participation in the sport of lacrosse and/or use of the rental equipment.
The undersigned understand and accept the fact that sports participation, including lacrosse, involves risks of injury and bodily harm, including but not limited to, paralysis and death. These risks are voluntarily and knowingly assumed by the undersigned Player in connection with his or her use of the rented equipment.
TERMS AND CONDITIONS
1. The Player shall keep and maintain the rented equipment during the terms of the rental at his own cost and expense. He shall keep the equipment in a good state of repair, normal wear and tear excepted.
2. The Player shall pay the Bethel Blackhawks/GK Lacrosse Club full compensation for replacement and/or repair of any equipment which is not returned within seven (7) days from the end of the season or because it is lost or stolen or any equipment which is damaged and in need of repair to put it into the same condition it was in at the time of rental, normal wear and tear excepted. The Bethel Blackhawks/GK Lacrosse invoice for replacement or repair (less any Security Deposit applied) is conclusive as to the amount player shall pay under this paragraph for repair or replacement.
3. Player shall not permanently remove the equipment from the address of the player or the location shown herein as the place of use of the equipment without prior written approval of Bethel Blackhawks/GK Lacrosse Club. The player shall inform Bethel Blackhawks/GK Lacrosse Club upon demand of the address of player and the location of the equipment while it is in the player’s possession.
4. At the discretion of Bethel Blackhawks/GK Lacrosse Club, if Player fails to return the equipment within the appropriate timeframe, Bethel Blackhawks/GK Lacrosse Club may elect to assess to player a periodic or term rental of the equipment. If a periodic rental rate is charged by Bethel Blackhawks/GK Lacrosse Club, rental charges are billed to the player for each period or portions of the period from the time the equipment is delivered to player until its return. If a term rental rate is charged by Bethel Blackhawks/GK Lacrosse Club, rental charges are billed to the player for the full term even if the equipment is returned before the end of the term. If the equipment is not returned during or at the end of the term, then the rental charges shall continue on a full-term basis for any additional term or portion thereof until the equipment is returned.
5. No allowance will be made for any rented equipment or portion thereof which is claimed not to have been used. Acceptance of returned equipment by Bethel Blackhawks/GK Lacrosse Club does not constitute a waiver of any of the rights Bethel Blackhawks/Lacrosse Club has under the rental agreement.
6. If the player is in default of any of the terms and conditions of this agreement, Bethel Blackhawks/GK Lacrosse Club, and his agents, at the player’s risk, cost and expense may at any reasonable time enter the player’s premises where the rented equipment is stored or used at all time and recover the rented equipment.
7. The player shall not pledge or encumber the rented equipment in any way. The Company may terminate this agreement immediately upon the failure of player to make rental payments when due.
8. Bethel Blackhawks/GK Lacrosse Club makes no warranty of any kind regarding the rented equipment, except that Bethel Blackhawks/GK Lacrosse Club shall replace the equipment with identical or similar equipment if the equipment fails to operate in accordance with the manufacturer’s specifications and operation instructions. Such replacement shall be made as soon as practicable after player returns the non-conforming equipment.
9. Player indemnifies and holds Bethel Blackhawks/GK Lacrosse Club harmless for all injuries or damage of any kind for repossession and for all consequential and special damages for any claimed breach of warranty.
10. The player shall pay all reasonable attorney and other fees, the expenses and costs incurred by Bethel Blackhawks/GK Lacrosse Club in protection its rights under this rental agreement and for any action taken by Bethel Blackhawks Lacrosse Club to collect any amounts due Bethel Blackhawks/GK Lacrosse Club under this rental agreement. This Agreement shall be governed by and construed in accordance with the laws of the State of Washington.
11. These terms are accepted by the player upon delivery of the equipment to the player or the agent or other representative of player.

In the event the undersigned Player is a minor, the undersigned parent and/or legal guardian hereby verifies that they have the authority to enter into this Agreement on behalf of the Player and agrees to be bound by the terms and conditions of this Agreement. We have read and understand the terms of this Agreement and are voluntarily signing intending to be legally bound.

To keep equipment from getting too musty, families should clean it once every 2-3 weeks of use. Prior to returning it to Bethel Blackhawks/GK Lacrosse, all equipment MUST be cleaned as set forth below:
Shoulder pads, arm pads, gloves and goaliepads: Machine wash, cold water, on the delicate cycle, and then drip dry for at least 48 hours or tumble dry on low heat. Do not store equipment in bags when not is use – LET IT BREATHE!
Uniforms: Wash in cold water with mild detergent and or color safe bleach.Stains can be sprayed with laundry stain remover products.
Helmets: Completely remove any tape or stickers that were placed on the helmet after it was issued, and wipe clean inside and out with a wet cloth and mild detergent. Leave helmet wraps on the helmet, and do not remove it.
NOTE: Players that fail to clean equipment or the uniform before returning it must pay a $25 cleaning fee.
