MINUTES OF THE PARISH COUNCIL MEETING HELD ON WEDNESDAY THE 28TH JANUARY 2015 AT THE PAVILION MEETING ROOM, BLACK NOTLEY AT 7.30 PM.

1932/15 APOLOGIES FOR ABSENCE.

Apologies received from Councillor James Abbott.

1933/15 DECLARATION OF INTERESTS.

Item number 9 Operating License - Personal interest was declared by Cllrs Smith, Martin, Pedder and Jiggins.

1934/15 PUBLIC QUESTION TIME.

2 members of the public present & Cllr T Cunningham.

Mr Scott Leyman (member of the BNCA) spoke as an individual concerning proposals and a petition to make changes to the running of the Community Centre. It was suggested Mr Leyman should take his concerns to the committee of BNCA to discuss this. Cllr Hunt, as Parish Council representative on the BNCA, said she was happy to assist in a meeting if required.

The tree which had fallen into Cokers Peace meadow from Bulford Mill woods has been chopped down, but the wood still needs to be removed and fence repaired, Cllr Cousins to take a look with Andrew Adair and report back.

1935/15 REPORT FROM COUNTY COUNCILLOR AND DISTRICT COUNCILLORS.

Cllr Cunningham reported that currently the financial budgets are being discussed, he confirmed Braintree District Council will have 0% increase on the Council tax bill. (Mi funding is still available to Parish Councils.)

1936/15 MINUTES OF THE MEETING ON THE 10TH DECEMBER 2014.

1937/15 CLERKS REPORT.

Update on the Councillor vacancy a gentleman has expressed an interest in this vacancy and the Clerk will invite him to the February meeting.

Further to the recent letter received from Anglian water regarding blocked culverts and maintenance of Snakey Lane; it was agreed the Clerk should write to the Environment Agency.

1938/15 CORRESPONDENCE.

*  Email received from a resident about the roundabout at the top of Mary Ruck Way.

*  Action: Write to highways again advise we have been approached by resident who was advised by yourself (ECC) that this particular roundabout is a roundabout. We would like to know their opinion is this a roundabout or a decorative feature please; clarify as received opposing opinion in the past.

* Email received from the Rural Community Council of Essex (RCCE), to ask us to join the campaign to call on the Secretary of State for Environment, Food and Rural Affairs not to withdraw funding for the ACRE Network of Rural Community Councils (RCCs).

It has been confirmed that the funding will not be withdrawn.

1939/15 NEW PROPOSED LOCATION OF BUS STOP – SUGGESTED BY ECC.

A site visit took place last week, Moria from ECC suggested a bespoke shelter at the

bus stop itself, or opposite on the grass verge outside of the old shop. It was agreed to

ask her to write to residents at both suggested sites. Agenda item for February.

1940/15 PLAYING FIELD UPDATE –

The Clerk advised the Parish Council that due to health reasons Andrew Adair would

be doing less heavy work and will be giving up the strimming contract; the Clerk is in the

process of obtaining quotes for this work.

1941/15 HIGHWAY ISSUES.

* Essex County Council letter regarding ‘Where are the flood problems in your area –

top 3 priorities’. It was agreed to response with the following 3 locations:-

Cornstones Church the water runs down through the car park into Brain Valley

Avenue. Snakey Lane culvert onto Witham Road. John Ray Gardens – Witham Road

junction.

* Operating License Application to run 6 Lorries and 6 Trailers from the Essex County

Council Depot, Bakers Lane Black Notley CM77 8QS. Jay Prince trading as Essex

Freight Terminal Ltd, 208 Lakes Road, Innovation Centre, Lakes Road, Braintree,

Essex, CM7 3AN. We had been advised by The Traffic Commissioner we could not

object as a parish council, not owning land nearby. We have re-sent similar letter to

BDC and Highways. We also sent a letter to the Traffic Commissioner expressing our

concern about the number of HGV’s on unsuitable roads in the Parish.

B) SETTING OF THE PRECEPT.

It was agreed to add into the precept £1,000 for memorial cleaning, Allotments £4,000,

duck pond clearance £5,000, land renovation £4,000 if the lawn mower needs replacing

in the future this will come from reserves. A show of hands was done regarding setting

money aside for the skate park it was agreed we will not precept money for this project

at this time. It was proposed to precept £48,000.

C) CIRCULATION OF ACTUAL TO BUDGET SPENDING.

1943/15 PLANNING.

14/01605/MMA Application to vary a condition relating to approved application 03/02140/FUL (Drawings amended to include doors to dining room, conservatory roof, chimney stack and brick external walls) - Proposed demolition of existing garage outbuilding and erection of rear single storey dining room, conservatory and hobbies workshop. Tinkers Dell, 205 London Road, Black Notley, CM778QG. No objection.

14/01591/FUL Erection of single storey rear extension. 10 Mary Ruck Way, Black Notley, CM77 8RA. No objection to an extension but this plan does take up a large amount of what is a very small garden and we feel this should be taken into consideration.The neighbour has reservations as to the closeness of the extension to their boundary to allow for future maintenance.

15/00036/FUL Erection of 2 no. dwellings. 11 Dewlands, Black Notley, CM77 8LW.

Being visited tomorrow, by the sub committee.

Letter from Braintree District Council – Call for Sites 2014. Various sites have been put forward by applicants. Black Notley Great Notley and Cressing ward proposal was discussed, 13 sites have been indicated with in Black Notley Parish.

1944/15 BAKERS LANE POND CLEARANCE.
Discussed during the Precept item, the Clerk to look into some funding possibly from the Environment agency, The Clerk to speak to Braintree District Council ref Section 106 money see what amount is available to us. The Clerk to speak to Dunmow Town Council and Finchingfield Parish Council both who have ponds and may be able to give us some advise.
1945/15 OPEN SPACE ACTION PLAN - Update for 2015 – Consultation. Nothing has changed on this document for Black Notley.
1946/15 QUOTES FOR RE-FURBISHMENT OF THE WAR MEMORIAL.
It was agreed to precept £1,000 for this but the Clerk to find out if funding is available for this.
1947/15 UPDATE ON THE ALLOTMENTS.
Meeting to be arranged when its been confirmed we can now Manage the allotments.
The meeting was closed to the Press and Public under the Public Bodies (Admission to Meetings) Act 1960.
1948/15 REPORT FROM THE PERSONNEL COMMITTEE.
Further to recent information regarding payscales and allowances received from the National Association of Local Councils and the Essex Association of Local Councils it was agreed to reward a 2.2% pay rise; recommended for all staff, to be back dated to the 1st January 2015.
