BILL OF LADING GUARANTEE
TYPE THE FOLLOWING GUARANTEE ON YOUR LETTERHEAD AND FORWARD SAME TO US IN LIEU OF ORIGINAL BILL OF LADING

We claim to be the owners of the said merchandise but are unable to produce the original Bill of Lading therefore, and assert that the Bill of Lading has not been negotiated, sold or transferred, request delivery of the said merchandise without production of the original Bill of Lading.
In consideration of releasing or delivering the said merchandise we hereby indemnify you and each of you against all claims and/or demands which may be made against you or any of you in respect of the under mentioned goods and to hold you harmless from any and all consequences that may arise by your granting release of this cargo without presentation of the original Bill of Lading and acting thereon, including losses, damages, costs or any other expense which you or any of you may sustain or incur by reason of this indemnity or in any way relating thereto. If any proceedings be instituted against you or any of you from time to time in respect of the said goods, we further undertake to provide you with sufficient funds to defend the same and to meet any proved claims, and, if called upon, undertake at any time whitest the said goods are in our hands to deliver the same to you. We further undertake that the shippers, Underwriters of these goods or any other party shall be informed of this Indemnity should a claim in respect of these goods be made upon them. As we are unable to product and surrender the original Bill of Lading therefore, and assert that said B/L has not been sold or transferred in any way. Delivery is requested of the said merchandise without presentation of this original Bill of Lading.
Now therefore, in consideration of your releasing the said merchandise to:
The undersigned their successors and assignees guarantee and promise that immediate steps will be taken to produce this original B/L cover the said merchandise as mentioned and to present same when received and this guarantee will be cancelled. We agree to pay and reimburse you any sum or sums of money, costs, charges, demurrage and expenses which you may pay, sustain, incur, and may be put to in consequence of your releasing the said merchandise. We agree to hold you harmless from all actions and suits which may arise in consequence of the release of these goods with out surrendering of the original B/L. We also agree that if and when the original Bill of Lading is in our possession we will send same to you at once.
