The stated amounts include U.S. Governmental filing fees, search fees, and routine disbursements such as online service provider fees, local courier charges, and photocopy, long-distance telephone, postage and fax costs. Trademark prosecution costs can vary from under $250.00 to over $2,500.00. Because of the often subjective nature of the U.S. Patent and Trademark Office examination procedure, as well as the at times inconsistent interpretation of federal rules, regulations, case precedent and official guidelines by individual Trademark Examiners, it is impossible to anticipate the length of time or amount of effort and research to be required for any given application. Thus, prosecution costs for tasks not described above, including docketing, will be assessed on an “actual time spent” basis, at our Hourly Rates (set forth below). Trademark litigation, including instituting and/or defending opposition, cancellation or civil action proceedings will also be billed on an “actual time spent” basis, at our Hourly Rates. Estimates of costs for such proceedings will be made available, on a case-by-case basis, upon request.
Discounts may be offered based upon volume of business involved. We endeavor to utilize the individual at the firm who is most able effectively to handle a particular matter at the least cost. Our 2009 Hourly Rates are:
