Focus: What every attorney should know about trusts (after the Davis Tax Committee (DTC)
The seminar is intended for every attorney (general, commercial, litigation, conveyancers, novice and specialist) having to advise clients in these tax uncertain times about trusts and related mattersIt is a follow-up on the very successful seminars of previous years but this one is different with many new important developments and will also focus on the final report on Estate Duty (& Trusts) by the Davis Tax Committee.

  • Beware of the seven grey areas in the trust law and its often invalidating consequences.
  • The most common errors with the creation, administration, amendment and termination of trusts. Which of these errors can be rectified and which not and if not, what then?
  • When is a trust really a sham and when is it merely abused by a trustee and when does it become the trustee’s alter ego? What are the common errors made with trusts and divorce proceedings and when is it important to join the trust as a party to the divorce?

EXPERT PRESENTER
Professor Willie van der Westhuizen is a regular speaker at seminars and conferences, both local and international. He is a director and practicing attorney at Millers Inc, George, specializing in Trust Law and Holistic Estate Planning, regularly doing legal audits on trustdeeds and holistic estate planning for all including restructured families.
He also serves as Extraordinary Professor in Private Law at the University of the Free Statewith specific instruction in Trusts as well as Estate Planning Law. He is co-author of “Wills and Trusts”, as wellas “Estate Planning and Fiduciary Services Guide” and “Butterworths Forms & Precedents:Estates” all three LexisNexis publications and has written and published numerous articles onTrust Law and related topics. For more than a decade and a half he has presented seminars and spoke at conferences onthese topics to lawyers, accountants and other advisers countrywide in the RSA and Namibia as well as off-shore.
He serves on the Law Society of SA Trusts and Estates Standing Committee and is a full member of the international UK-based Society of Trust and Estate Practitioners (STEP) and at a recent international STEP conference presented a lecture entitled “Bad trust clauses in the RSA and their consequences” and at their last conference in the RSA in April 2016 presented papers on “Cross-border holistic planning with Namibia” and “Trusts in Namibia” As a member of the International Bar Association he has delivered papers at IBA conferences in Strasbourg, New York and Hong Kong on such topics as "Restrictions on testamentary freedom", "Application possibilities of the trust in South Africa" and "Business trusts for privately owned businesses in South Africa.
