Purpose

This document has been produced as a template to assist applicants in presenting their business model to lease Bentley Pavilion.

The template should be completed in full and MUST be submitted alongside any application made. Failure to supply a completed Business Plan with a tender will render it invalid and it will not be considered further.

Section 3 – Business Plan

01.  Governance (5%)

Applicants must be able to demonstrate good governance by operating through open and accountable processes, with adequate monitoring, evaluation and financial management systems and be able to provide copies of the accounts of the organisation to Doncaster Council on request. Please describe beneath how governance is managed by your business/group

02.  Community Involvement (25%)

Please outline your community involvement objectives/plans having due regard to the 4x key criteria outlined beneath:

-  How visitors to the park could increase and in particular make better use of the pavilion building.

-  Your proposals for the provision of a good quality café

-  How the pavilion will be open at appropriate times to service community need, and how space within the pavilion will be made available to hire by members of the local community

-  How readily available access to toilet facilities within the pavilion will be made available to users of the park at appropriate times

03.  Community Engagement (10%)

Please provide information to demonstrate that your business/group can engage in economic, environmental or social regeneration in Doncaster or be providing a service of community benefit in line with Doncaster’s core objectives.

This section of the submission should also provide evidence of local need and demand for the activities being proposed.

04.  Sustainability (10%)

Please demonstrate that you have established how much space is required to deliver the proposals being put forward, and how any surplus space or gaps in building utilisation can be used to maximise opportunities to ensure sustainability, for example through income generation for the hiring of space within the building and/or facilities therein by the hour. Applicants should be aware that the sub-letting of buildings occupied under a community lease is not permitted.

This section of the submission should also consider how the pavilion (which is already a visual focal point for the park) might in the future become functionally & financially central to the Park

05.  Property Management (5%)

This section of the submission should outline how the premises will be managed on a day to day basis. It should demonstrate a clear understanding of health and safety issues on the part of the group and cover compliance with legislation/statutory requirements arising from management of the physical asset subject to the lease.

06.  Community Cohesion (5%)

Please provide an outline of how your business/group will embrace diversity and work to improve community cohesion and reduce inequalities. Any proposed use of Doncaster Council’s land and property assets should ensure extensive reach into the community and be open to all.

Section 4 – Financial information (40%)

Rent payable

Commercial Lettings

The open market rent for the property (excluding outgoings and full repairing and insuring liabilities) has been assessed at £12,750 per annum. Tenders should be submitted with this baseline figure in mind

Community Lettings

Lease agreements shall be negotiated from a starting point of full market rental value. A discounting framework may be applied* based upon key areas that will include:

-  Expectation of the group to be responsible for all running costs including repairs, maintenance and insurance

-  Requirement for the group to invest in the building during the term of the lease

-  The turnover being generated by the registered charity.

-  Evidence of the benefits that the applicant will bring to the local community.

* Heritage Lottery funding of £2.4m was received for the Pavilion and Park renovation project. In addition to the requirement to apply for and achieve a Green Flag award for a minimum period of 7 years, the grant conditions state that any letting should be for approved purposes and at a full market rent. Any concessionary rental applied for will therefore be subject to HLF approval.

All applicants must provide financial information to support their submission including the following key elements:-

Revenue Costs

What money do you need for people, administration, service provision, promotion, fundraising, stock, premises running costs

Income generation strategy

Have you considered the commercial potential of the building, including wider use of the pavilion, potential concessions and any potential sponsorship opportunities

Financial prospect

Are your income generation ideas tried and tested or subject to risk

A rental proposal

To include the rental you would propose to pay to Doncaster Council for a lease of the premises and any associated information

Section 5 – Standard terms of agreement

The following are standard terms of agreement that are non-negotiable.

Landlord & Tenant Act

The agreement will be contracted out of Part II of the Landlord and Tenant Act 1954.

Repair and maintenance responsibilities

In all circumstances, the agreement will require the applicant to be responsible for the full cost of insuring, repairing, on-going maintenance and complying with all statutory requirements in relation to the asset leased for the duration of the agreement.

Lease covenants (Community Lettings)

All agreements will contain the necessary covenants to ensure that the applicant adheres to the principles and criteria of the community lettings policy.
