BYLAWNO:2-2016

BEINGABYLAWOFTHEVILLAGE OF EMPRESS,INTHEPROVINCEOFALBERTAIN RESPECT TO THE WATER UTILITY SYSTEM.

WHEREAS, pursuant to section 3 of the Municipal Government Act, R.S.A. 2000, c.

M-26, thepurposes of a municipality are to provide services, facilities and other things that

are necessary ordesirable for all or a part of the municipality;

AND WHEREASthe Municipal Government Act (R.S.A. 2000, c. M-26) authorizes a

municipality to operate awater system as a public utility for the purpose of supplying and

distributing water;

AND WHEREAS, pursuant to section 7(g) of the Municipal Government Act, Village of

Empress Council may pass bylaws respecting public utilities;

NOW THEREFOREtheCouncilofthe Village of Empressdulyassembledhereby

enactsasfollows:

1.ThisBylawmaybecitedastheWaterServiceBylawoftheVillage of Empress.WherethetermsofthisBylawconflictwiththeprovisionsofanyotherBylawoftheVillage of Empress,thisBylawshallprevail.

2.DEFINITIONS

InthisBylawunlessthecontextotherwiserequires:

(a) / “Backflow”meansthereversalofflowofanywater,wastewater,orany otherliquid,chemical,orsubstancebackintothewaterworkssystem.
(b) / "Village"meanstheMunicipalCorporationofEmpress,ortheareacontainedwithintheboundarythereof,asthecontextrequires.
(c) / "Consumer"includesanypersonwhohascontractedwiththeVillageforthepurchaseofwaterfromthewaterworkssystem.
(d) / “Cross Connection”meansanytemporary,permanentor potentialconnection
ofanypiping,fixture,fitting,container,orapplianceto thewaterworkssystem
whichmayallowwater,wastewater,oranyotherliquid,chemical,orsubstance
toenterthewaterworkssystem. Thisincludes,but isnotlimitedto, swivelor
changeoverdevices,removablesections,jumperconnectionsandbypassarrangements.
(e) / “Crossconnectioncontroldevice”meansadeviceormethodthatpreventsbackflow.
(f) / "EnvironmentallyInappropriate"whenusedtodescribeauseorflowofwater
meansauseorflowofwaterthatresultsinaquantityofwater.
(i)soakingintotheground,

(ii)enteringtheVillage'sdomesticsewersystem,or

(iii)escapinginanymannerfromthepropertyuponwhichtheuseorflowofwateroriginates,

inexcessofthequantityrequiredforanecessaryordesirabledomestic,commercial,industrialorpublicpurpose.
(g) / “CAO”meanstheVillageemployeeholdingthepositionofChief Administrative Officer of theVillage of Empress,andincludesanyotherVillageemployeetheCAOauthorizestoperformanydutiesor exerciseanypowersoftheCAOassetout inthisBylaw.
(h) / "Owner"meansthe person holding title to the property.
(i) / “Testablecrossconnectioncontroldevice”meansacrossconnectioncontroldevicewhichiscapableofbeinginspectedandtestedinaccordance
withtheNationalPlumbingCodeofCanada2010,asamendedorreplaced.
(k) / "WaterWorksSystem"meansthewaterdistributionsystemownedandoperated
bytheVillage of Empressandallaccessoriesandappurtenancesthereto.
(l) / “RemoteReadingDevice”meansanyVillagedeviceconnectedtoawatermetertoprovidemeterinformationand/orconsumptioninformationtotheVillage.
3. / ADMINISTRATION-CONTROL
TheCAO,subjecttothecontrolofVillageCouncil,shallhavechargeofall
thevariouspropertiesandworksrequiredforthesupplyofwatertotheVillageandits
inhabitants.
(a) / Apersonappointedasabylawenforcementofficer,includinganypeaceofficer,RCMPorspecialconstable,oranyotherpersonappointedby theVillage
toenforcecompliancewiththisBylawhastheauthoritytodoanythings andissueanycharges,summons,ticketsorordersasmaybenecessaryfor
carryingouttheprovisionsofthisBylaw.
(b) / TheCAOmayhavethewatershutofftothepremisesofanyowner
orconsumerinfringinganyoftherulesandregulationsoramendmentsthereto
madebytheVillage.

4.EXTENSIONOFMAINS

NoextensionofmainsshallbeconstructedexceptasmaybeauthorizedfromtimetotimebyVillageCouncil.

5.INTERRUPTIONSOFSERVICE

TheCAOisherebyauthorizedto:

(a) / Orderthatthewaterbeshutoffwithoutnoticeforsuchlengthoftimeasmaybenecessarytopermittheconstructionorrepairstothewaterworkssystem.
(b) / Incasesoffiresoraconflagration,toshutoffthewaterwithoutnoticeinanypartoftheVillageasrequired.Noconsumerorconsumersshallhaveaclaimagainst theVillagefornon-supplyofwater, whetheritbecausedbywaterstoppage pursuanttothissectionorbyfrozenmains,breakdownofmachinery,powerinterruptionsorothermechanicalfailuresormalfunction,unlesssuchnon-supply ofwaterisshowntobedirectlyduetothenegligenceoftheVillageorits employees.
(c) / Damages
Inallcaseswhereanypressurevesselorequipmentissuppliedwithwaterfrom
thewaterworkssystem,theVillageshallnotberesponsiblefordamagetosuchvesselorequipment,personorpremiseswhenthereisfailureofthewatersupplyduetoanycausewhatsoever,evenwherenonoticeisgiven.Nodeductionfromthe waterbillsshallbemadeinconsequencethereof.

6.TEMPORARILYRESTRICTEDUSEOFWATER

WaterrestrictionsinallorpartoftheVillagemaybesetoutduringanyperiodfixedbyCouncilbyresolutionandafteroneadvertisementintheOyen Echo, and/or notification on water bills.

7.EMERGENCYRESTRICTIONSANDPROHIBITIONS

(a) / TheCAOmayatanytimemakeordersrestrictingtheuseofwatereitherbyallconsumersorbyanyparticularclassofconsumersandeither
throughouttheVillageorinanyparticularareaorareasoftheVillage.Theordermayspecifythatsuchrestricteduseofwatershallapplyduringsuchhoursofanydayofthe weekasmaybespecifiedintheorder.
(b)
(c) / NopersonshalluseanywaterfromthewaterworkssystemincontraventionofthetermsofanyordermadebytheCAOunderthissection.
TheCAOshalltakesuchstepsasdeemednecessarytopublicizethetermsofanordermadepursuanttothisandtheprecedingsection.

8.WATERCHARGES

(a) / AconsumersuppliedwithwaterthatismeteredshallpaytheClass“A”ratessetoutinSection1ofSchedule"A".
(b) / Whereverlawnandgardenstand-pipesareplacedonpremises,thesaidstand-pipesshallbeplacedonthesaidpremisesnotlessthantwelvefeetfromthe
propertylinethereof.
(c) / Separatelawnorgardenservicesonvacantgardenlotsorbuilt-onlotsshallonlybepermitted ifequippedwithawatermeterinstalled in suitablepitorbox
tobeconstructedbytheownerandconformingtoSection32(MeterChambers).

9.UNAUTHORIZEDUSEOFWATER

(a) / Noownershalllend,sellordisposeofthewatersuppliedbythewaterworkssystem,or giveaway orpermitthesametobetakenorcarriedaway or used
orapplyittotheuseorbenefitofothersortoanyotherthanhis,herortheirown
useorbenefitorshallincreasethesupplyofwaterbeyondthatagreedforwiththeVillage.
(b) / Noownerorotherpersonshalldoorallowtobedoneanyactorthingthatresultsinanenvironmentallyinappropriateuseorflowofwaterfrom theVillage’s WaterWorksSystem,irrespectiveofwhethertheownerorotherpersonis responsible to pay for the water that is used or allowed to flow in anenvironmentallyinappropriatemanner.

10.HYDRANTSANDVALVES

(a)
(b) / Nopersonshall open,closeor interferewithanyhydrantorvalveofthewaterworkssystemwithoutthepermissionoftheCAO.
TheCAOmaypermitwatertobetakenfromahydrantduring
constructionorotherwise,providedthat:
(i) / AdepositintheamountassetoutinSchedule"A"isleftwiththe
CAO and a HydrantPermit is issuedforaperiodofsixty(60)days;
(ii) / HydrantPermitsmayberenewedundertheinitialdepositforadditional
sixty(60)dayperiodsuponadvicetotheWaterDepartment.Nodeposit
willberefundedonHydrantPermitsexceedingthesixty(60)dayperiod;
(iii) / Watertakenfromthehydrantmaybemeasuredbyametersupplied
bytheCAOandshallbechargedfor at theratesset forth inthisBylaw;
(iv) / Minimumchargefortheuseofafirehydrantshallbesetforthin Schedule"A".

11.SERVICECONNECTIONS–GENERAL

(a)
(b) / Normally,onlyoneserviceconnectionperlotshallbepermitted.
For lots other than single family residences, the CAO may authorizemorethanoneserviceconnection.
(c) / The size of the serviceshall be determined in accordancewith the provisionsofthePlumbingandDrainageregulationsoftheDepartmentofHealthofthe
ProvinceofAlberta.
(d) / Theserviceshall berunfromthemaintothepropertylineintheshortestway
possible.
(e) / Whenanybuildingcanbeservedfromthestreetoravenue,theCAOmaydecidewhetherthebuildingwillbe suppliedwithwaterfrom the street
orfromtheavenue.
12. / NEWSERVICELINESINPRIVATEPROPERTY
The WaterDepartmentoftheVillageofEmpressmay,attheowner'srequestandexpense,installthewaterservicefromthepropertylinetoabuildingorapointdesignatedbytheowner.

13.APPLICATIONFORNEWSERVICECONNECTIONS

(a) / Anypersonrequiringwaterservicefromthe waterworkssystemshallapplytotheVillage officeandrequestthathispremisesbe connectedtothesaidsystem. Theownerorhisauthorizedagentatthetimeof makinganapplicationforawaterserviceconnectionisrequiredtopaytotheVillage, inadvance,anamountequalto:
(i)the costofthewater service connectionasdeterminedbytheCAO;or
(ii)theestimatedcostofthe waterserviceconnectionascalculatedbythe
CAOsubjecttoarefundorfurtherpaymentdepending on theactualcostwhentheworkiscompleted.
(b) / TheownerorhisauthorizedagentshallprovidetheCAOwithasiteplanonwhichthesizeandlocationoftherequiredservicesareshown.Thisappliestorowhousing, eachfour-suiteorlargerapartmentbuilding and everycommercialandindustrialbuilding.
(c) / Theexpenseofinstallinganyserviceconnectiontoasub-dividedlotoraparcel
ofland,orportionsofsame,shallbebornebytheapplicant.
14. / PLUMBERSANDPLUMBINGCONTRACTORS
Allpersonsdoinganyworkorserviceuponaprivateserviceortheplumbingsystem
attachedtheretoshallcomplywiththeprovisionsofTheSafetyCodesActR.S.A.2000,
asmaybeamendedfromtimetotime,ChapterS-0.5,allregulationspassedpursuant
15. / theretoandanyBylawsoftheVillage applicablethereto.
NOUNAUTHORIZEDTAPPING
NopersonwithoutthepriorauthorityfromtheCAOshalltapormakeany connectionorcommunicationwhatsoeverwithanyofthepublicmainsinthe streets,
avenuesorinthelanes.
16. / DISCONNECTIONOFSERVICE-SERVICEKILL
NopermitforthedemolitionorremovalofabuildingshallbeissuedbytheVillagenor shallanypersoncause,permitorallowtobedemolishedorremovedabuilding connectedtoawatermainuntiltherehasbeenpaidtotheVillagethefeefordisconnecting theVillageserviceatthewatermainasprovidedforinSchedule"A".Notwithstandingthe foregoing,theCAOmayincircumstanceswhichheconsidersappropriate, permittheservicetoremainconnectedtothewatermain.

17.SERVICECONNECTIONS-MAINTENANCE

TheVillageshallberesponsibleforthemaintenanceofthewatermainsandalltheconnectionsfromthemaintothepropertylinewiththeexceptionofthoseconnectionsusedforlawnservicesandprivate fireservicesandwiththeexceptionofthoselimitationscontainedinparagraph15.

18.INSTALLATIONOFSERVICES

(a) / Thewaterservicepipefromthemaintothepropertylineshallbeofcopper,castiron,orothermaterialapprovedbytheCAOandconnectedby fittings and
materialsapprovedbytheCAO,andsuchwaterservice pipeshallbelaid at
leastseven(7)feetbelowthesurfaceofthegroundifinclay andnine(9)feet
ifingravelatanypointbetweenthepropertylineandthehouse.
(b) / Thereshallbeplacedoneachwaterservicepipeacorporationvalveatornearthepropertyline,forthepurposeofturningonthewatersupplyorshuttingitoff.
Overthecorporationvalvethereshallbeplacedametalliccorporationvalvebox
ofapprovedpattern.Thedownstreamedgeofthecorporationvalvesoplaced
shallbethelimitofVillageresponsibilitywithrespecttotheinstallation.
(c) / Themainshut-offvalveshallbelocatedimmediatelyinsidethebuilding
(d) / OperationofCorporationValve (Curb Stop)
Nopersonshallinanywayinterferewithacorporationvalvewhether located on Villageor private property.Wheneverwaterhasbeenturnedoff,nopersonwhoisnotdulyauthorizedby theCAOshallturnitonagain.
(e) / The owner of the property shall be responsible for ensuring that the corporation valve (curb stop) is accessible at all times and not covered over by dirt, grass, landscaping, paving or driveways and shall notify the Village should the cover become damaged, broken or lost.
(f) / Curb stops that are inoperable due to damage or negligence by the property owner shall be repaired or replaced at the property owner’s expense.
(g) / BoosterPumps
Nopersonshalluseanyboostingdeviceonanywaterserviceunlesstheuseof
theboostingdevicehasbeenapprovedbytheCAOandthedeviceislocatedonthedownstreamsideofawatermeter.
(h) / BranchLines
Nopersonshall installbranchsupplylines,outletsorfixturesontheupstream
sideofawatermeterormainshut-offvalve.
19. / APPLICATIONFORLARGERSERVICESFROMMAINTOPROPERTYLINE
AnypersonwishingtohavealargerserviceshallapplytotheCAO andrequest
thatalargerservicebeinstalled. Theownerorhis authorizedagent shallsignthe
propertyapplicationformprovidedforthatpurposeand makethe requireddeposit. If,
intheopinionoftheCAO,theexisting service isduefor replacement,the applicant
willberequiredafterinstallationtopayallthecostslesshisdepositforthedifferenceinmaterialcostsbetweenthenewandthe existingpipe size. If, intheopinion ofthe
CAO,theexistingserviceisin goodcondition, the applicantwillbe requiredafter
installationtopayallthecostsless hisdeposit fortheinstallationincludingsurfacerestoration.

20.APPLICATIONFORSERVICERENEWAL/REPAIRINPRIVATEPROPERTY

AnyownerwishingtheVillagetorenew/repairaservicelocatedinprivatepropertyshallapplytotheVillageandrequestthatsuchinstallationbemade.Theownerorhisauthorizedagentshallsign:

(a) / adeclarationstatingthathehasnotbeenabletogetaplumbingcontractortodothework;
(b) / theproperapplicationformandprovidethedepositrequiredbytheCAO.
Aftertheinstallationiscompleted,hewillhavetopaythedifference
betweenhisdepositandtheactualinstallationcost.

21.FROZENSERVICES

(a) / TheVillageshallnotthawaprivateserviceorplumbingsystemunlesstheconsumershallfirsthavesignedanacknowledgementrecognizingthatthawing maybeinherentlydangeroustopropertyincludingtheprivateserviceor plumbingsystemandmaycausedamagetoelectricalsystemsortheoutbreakof fireandwaivinganyclaimagainsttheVillageforanysuchdamagewhatsoever exceptdamagecausedbythenegligenceoftheVillage. The rate for this service is set out in Schedule “A”
(b) / Iftheconsumerelectstoleaveawatertapopentopreventfreeze-ups,regularwatermeterchargeswillapply.

22.SERVICE CALLOUTS

(a)The Village of Empress, upon receiving a request for service to a water line will make arrangements to have a village employee attend to service the line. Rates for these services are set out in schedule “A” Prior to the commencement of any work, the owner shall sign an application for service and release of liability. Schedule “B”

(b)Should the problem be identified as originating on town property, the service fee shall be waived, and arrangements shall be made to fix the line. Should the problem be identified as originating on private property, Section 20 shall then apply.

23.METERS-GENERAL

(a) / ExceptwhereotherwiseprovidedinthisBylaw,allwater suppliedpursuant tothisBylawshallbemeasuredbyameterofadesignandcapacity approved by
theCAO.Shouldameter,whileonthepropertyoftheconsumer,be damaged
ordestroyed,thecostofrepairingorreplacingthemeter,asprovidedforinSchedule"A",shallbepaidbytheconsumer.
(i) / Subject toClause(c)(iii),onemeterwillbesupplied by theVillagefreeofchargetotheconsumerforeachwaterserviceconnectionwhichisnota lawnservice,fireprotectionservice,ora metermeasuringa combined flowoffireprotectionandconsumerdemand.
(ii) / AllwatermetersinstalledbytheVillageshallatalltimesbethepropertyof theVillage.
(iii) / Anymeteredwaterserviceinusebeforeor aftertheenactment ofthis Bylawshallremainameteredwaterservice.
(iv) / Noperson,otherthananemployeeoftheVillage ora personauthorized inwriting bytheCAO, shallinstall,test,remove,repair,replaceordisconnectawatermeter
(v) / EveryConsumershallallowtheVillage,includinganyofitsemployees, agentsor contractors,toenter onorintheConsumer’spremisesat all reasonabletimesforthepurposeofinstalling,testing,reading,removing, repairing,replacingordisconnectingawatermeter.
(vi) / TheCAOmaydirectthatthewaterservicestoanyConsumer beshutoffiftheConsumerrefusestoallowtheVillageaccesstothe Consumer’s premisesforthepurposeofinstalling,testing,reading, removing,repairing,replacingordisconnectingawatermeter.

(vii)Consumers shall immediately notify the CAO of anybreakage,

stoppageorirregularityinawatermeter.

(viii) TheVillageshallnotberesponsibleforanydamagetobuildings,orpropertyoccasionedbyorinthecourseoftheinstallation,maintenance,repairordisconnectionofanywatermeterprovidedthatreasonablecarehasbeentakenbytheemployeesoragentsoftheVillageinthecourseofsuchinstallation,maintenance,repairordisconnection.

(b)Ifbuildingsorpremisesrequiretwoormoremeters,theownershallbebilledseparatelyforwaterusedthrougheachmeter.

(c)MeterSize

Thesizeofthewatermetershallbedeterminedasfollows:

(i)Iftheinternaldiameteroftheserviceis25mmorless,a16mmx20mmmetershallbeused.

(ii)Iftheinternaldiameteroftheserviceexceeds25mm,thesizeofthemetershallbeonesizesmallerthanthesizeoftheservice.

(iii)A20mmor25mmmeterforaresidentialwater servicewillbe suppliedandinstalledin premisesbyTheVillageattherequestof theownerof thepremisesanduponpaymentofthechargesetoutinSchedule"A".

Undernocircumstancesshallameterlargerinsizethanthewaterservicebesuppliedandinstalled.

(iv)Iftheserviceisacombinedservice(tosupplywaterforfireprotectionaswellaswaterforotherpurposes),theinternaldiameteroftheservicebranchtobeusedforotherpurposesshalldeterminethemetersizeassetoutinSub-sections(i)and(ii)ofthisSection.

(d) Exceptwhereotherwise providedinthisBylaw,noownerorotherperson shalldoorallowtobedoneanyactorthingthatresultsinauseorflowofwaterfromtheVillage'sWaterWorksSystemthatisnotmeasuredbyawatermeterofadesignandcapacityapprovedbytheCAO.

(e)IftheCAO becomesawareofanyuseor flow ofwaterthat isnotmeasuredbyawatermeterofadesignandcapacityapprovedbytheCAOandthatdoesnotfallwithinaspecificexceptiontothegeneralrequirementofwatermeteringassetforthinSub-section(a)ofthisSection,the CAOmaytakeallnecessarystepstostopthatuseorflowofwateruntil:

(i)awatermeterhasbeeninstalledpursuanttotheprovisionsofthisBylaw;

and

(ii)anapplicationfor waterservicehasbeenmadeinaccordance withtheprovisionsofthisBylaw.

24.PROTECTIONOFMETERS

Aconsumerisresponsibleforthesafekeepingofthewatermeterandanyremotereadingdevicethatmaybeinstalledwiththewatermeterontheconsumer'sproperty.Aconsumershallprotectthewatermeterandconnectingvalvesandpipesfromfreezing,excessiveheat,overheatingofwater,externalandinternaldamageofanykindoranyotherthingwhichmayaffecttheoperationorreadingofawatermeterandshallpaythecostof repairingor replacinganywater meteringfacilitysuppliedandinstalledbytheVillage thatmay bedamagedfromtheforegoingcausesoranyothercauseswithintheconsumer'scontrol.

25.INSTALLATIONRESPONSIBILITY

(a)
(b) / Themainshut-offvalveshallbelocatedimmediatelyinsidethebuilding.
Theownerofeverybuildingshallmakeprovisionfortheinstallationofmetersas
(c) / requiredbytheVillage’swater bylaw
WatermetersshallbelocatedatthepointatwhichawaterservicepipeentersthepremisesunlesstheCAOdirectsinwritingthatanotherlocation beused.
(d) / Theownerofabuildingshall,atitsexpenseensurethattheVillagehasaccesstoallrelatedpipingwhenameterisinstalled.
(e) / Iftheownerofacommercialbuildingrequirestwometersandthereisonlyone water service,thecostofthesecondwatermetershallbetheresponsibilityofthe owner.
(f) / Itshallbetheowner'sresponsibilitytoprovidesuchsupportforthemeterasmay berequiredbytheCAO.
(g) / MeterssuppliedbytheVillagebeingunder50mminsizeshallbeinstalledby theVillage.
(h) / Meters50mmandlargershallbesuppliedbytheVillagelessflanges.Installationshallbetheresponsibilityoftheconsumer.
(i) / RemoteReadingDevices
(i)TheVillageshallsupplyandinstallaremote-readingdeviceinallnewpremisesatnocosttotheconsumer.
(ii)Aremote-readingdevicemustbeinstalledinexistingpremisesasdeterminedbytheCAO.
(iii)Everywatermeterandremote-readingdeviceshallbeinstalledina
mannerreadilyaccessibletoemployeesandagentsoftheVillage.
(iv)Allremote-readingdevicessuppliedandinstalledbytheVillageshallatalltimes be the propertyof the Village,notwithstanding the factthata consumermayhavepaidaninstallationfeeoranyotherchargefor havingaremote-readingdeviceinstalled.
26. / RELOCATINGMETERS
If the CAO is dissatisfied with the location of any meter due toalterationstothebuilding,hemayrequirethatthemeterbemovedtoadifferentlocation.
Anyexpenseinrelocatingthemetershallbebornebytheowneroroccupier.

27.READINGOFMETERS

Everyownerandoccupierofpremisesconnectedtothewaterworkssystemshallprovidefreeandconvenientaccesstohispremisesatallreasonabletimesforthepurposeofreadingmeters.IntheeventthatameterreaderemployedbytheVillageisunabletoobtainaccesstothepremises,thewaterconsumptionwillbeestimated.Ifnoreadingisobtainedattheendofthenextbillingperiod,theowneroroccupierwillberequiredtoleaveakeyattheofficeoftheCAOorotherwisemakesuitablearrangementsforregularbi-monthlyreadings.IftheowneroroccupierfailstocomplywiththerequestoftheVillage,thewaterservicemaybedisconnectedwithoutfurthernotice.

28.UNDERGROUNDSPRINKLERSYSTEMS

(a)Priorto installation, the ownerorhis agent shall applyto the Village

Officeforapermit.

(b)Allresidentialandcommerciallawnandgardensprinklersystemsregardlessofthesizeoftheservice,mustbemetered.

(c)Allmetersforasprinklersystemshallrequire,attheowner'sexpense,avalvewithin300mmoneithersideofthemeter.

(d)AnyowneroroccupierofpropertywithintheVillagemaypurchaseoutrightfromtheVillageaseparatemetertomeasurewaterusedforlawnorgarden.Theconsumerisresponsibleforanyrepairstothesaidmeter.

29.CROSSCONNECTIONSANDBACKFLOWPREVENTION

(a)Nopersonshallconnect,causetobeconnected,orallowtoremainconnectedtothewatersystemanypiping,fixture,fitting,containerorappliance,inamannerwhich,underanycircumstances,mayallowwater,wastewateroranyotherliquid,chemicalorsubstancetoenterthe watersystem.

(b)ForthepurposesofpreventingacrossconnectionasprohibitedinSection29(a),theCAOmayrequireanyconsumertoinstallatestablecrossconnectioncontroldeviceordevices.

(c)AtthetimeofinstallationandthereafterasrequiredbytheCAO,everyconsumerrequiredbyanyAct,regulationorcodeorbytheCAOpursuanttoSection29toinstallatestablecrossconnectioncontroldeviceordevicesshall:

(i)ensurethatthetestablecrossconnectioncontroldeviceordevicesinstalledareinspectedandtested;and

(ii)reporttheresultsoftheinspectionandtestingontheformprescribedbytheCAOtotheCAOwithinthetimeframespecifiedbytheCAO

(d)EveryconsumerrequiredbytheCAOpursuanttoSection29toinstallatestablecrossconnectioncontroldeviceordevicesshallinstallonlytestablecrossconnectioncontroldeviceordevicesapprovedbytheCAO.

(e)EveryconsumerrequiredbythisSectiontoensurethattestablecrossconnectioncontroldeviceordevicesinstalledareinspectedandtestedshallensurethatonlypersonsapprovedbytheCAO inspectandtestthetestablecrossconnectioncontroldeviceordevices.Inapprovingpersonstoinspectandtestcrossconnectioncontroldevices,theCAO maytakeintoconsiderationthefollowingqualifications:

  1. acertificatefromanaccreditedorganizationasaCertifiedBackflowPreventionDeviceTester;
  2. acalibrationcertificatefortestequipment;
  3. anothertradeorprofessionalqualification(e.g.PlumbingCertificate,SprinklerFitterCertificate,etc.);and
  4. liabilityinsurancecoverage.

(f)IfaconsumerfailstohaveatestablecrossconnectioncontroldeviceordevicesinspectedortestedorfailstoreporttheresultsoftheinspectionortestingtotheCAO:

  1. theCAO maynotifytheconsumerthatthetestablecrossconnectioncontroldeviceordevicesmustbeinspectedandtestedanda testreportmustbesubmittedtotheCAO withinthetime framespecifiedbytheCAO;and
  2. theVillagemaydiscontinueprovidingwater servicetotheconsumeruntiltheconsumerhasthetestablecrossconnectioncontroldeviceordevicesinspectedandtestedandtheconsumersubmitsareportwithresultssatisfactorytotheCAO.

(g)EveryconsumershalldisplayanuptodateinformationrecordcardissuedbytheCAO onorimmediatelyadjacenttothetestable crossconnectioncontroldeviceordevices.

  1. ForthepurposeofverifyingthatSection29iscompliedwith,everyconsumershall,attherequestoftheCAO andwithinthetimeframespecifiedbytheCAO,providesuchinformationasmaybereasonablyrequiredbytheCAO,includinginformationrequiredbyasurveyontheformprescribedbytheCAO
  1. Forthepurpose of ensuring thatSection29iscompliedwith, the Villagemaycarryoutaninspectionofanylandorstructure.

(a)TheCAO may issueawritten orderiftheCAO believes,onreasonableandprobablegrounds,thatSection29iscontravened.ThewrittenordershallbeinaformprescribedbytheCAO and:

  1. shall setoutwhattheconsumerisrequiredtodoor stopdoingtocomplywithSection29;
  1. maydirect the consumerto,withoutlimitation,install,maintain, alter, repairorreplaceortestatestablecrossconnectioncontroldeviceordevicesandmay

directthesiteorsitesatwhichthecrossconnectioncontroldeviceordevicesshallbeinstalled,maintained,altered,repaired,replacedortested;and

  1. shallsetoutareasonabletimewithinwhichtheconsumermustcomplywiththewrittenorder.

(b)IfaconsumertowhomawrittenorderisissuedunderSection31failstocomplywiththewrittenorder,theVillagemaydiscontinueprovidingwaterservicetotheconsumeruntiltheconsumercomplieswiththewrittenordertothesatisfactionoftheCAO

(c)IftheVillagehasdiscontinuedwaterservicetoaconsumerunderSection31(b)orSection29(f)ii,nopersonshallcausethewaterservicetobeturnedonwithoutauthorizationoftheCAO.

(d)Anycostsordamages,direct,indirectorconsequential,arisingoutof:

(i)complyingwithanyrequirementunderSection29 or 31;or

(ii)thediscontinuanceofwaterservicetoaconsumer,includinganycostsordamages,direct,indirectorconsequential,arisingoutofthewaterservicebeingturnedonagain,shallbeatthesoleexpenseoftheconsumer.

32.METERCHAMBERS

(a)Wheremeterscannotbecontainedinanexistingbuilding,theconsumershallsupply,athisownexpense,anundergroundmeterchamberwhichshallbe
approvedbytheCAO.Themeterchambermaybeconstructedby
theVillageandtheconsumerbilledfor theexpenseincurred.Fornewbuildings, meterchamberswillonlybeallowedsubjecttoapprovaloftheCAO.
(b)Undergroundmeter chambersshall bekeptingoodrepair by theowner.Ifanowner,afterreceivingnoticefromtheCAO,neglectstorepairor improve
his meter chamber, then the CAOshall cause the necessary repairs
tobemadeandtheownershallbeliableforthecostofsuch repairs.
33. / TAMPERINGWITHMETERS
Nopersonshalltamperinanywaywithameterorremote-readingdevice.
34. / TESTINGOFMETERS
Whenever requested by a consumer, the meter shall be removed and tested.
If,ontesting,itis foundthat themeterregisterswithinthree percent (%)ofthewater
passingthroughsame,themetershallbedeemedtobemeasuringcorrectly.If,however,themeterisfoundtoregisteragreaterorlesseramountthansaidpercentage,
theCAO shalladdordeductfromtheamountas registered bysaidmetersuchsum
thatthebalancewillproperlyrepresentthewater deliveredthroughsaidmeterfor
aperiodnotexceedingsix(6)months. Whena consumerrequestsametertestand suchmeterisfoundtobewithinthreepercent(%)accurate,thatconsumer shall
bebilledatarateassetoutinSchedule"A".Asaregular maintenanceservice,meters
shallberemovedandtestedbytheVillagewithoutchargeasdeemedappropriatebytheCAO.

35.DETERMININGCONSUMPTIONWHENMETERINOPERATIVE

When meters have failed to register, the following methods shall be used fordeterminingconsumption.

(a)Ifthesameorsimilarconditionsprevail,consumptionshallbeestimatedonthebasisoftheconsumptionduringthesamemonthintheprecedingyear.

(b)Ifthesameorsimilarconditionsdonotprevail,afairestimateshallbesetbytheCAO.

(c)TheratesappliedshallbethoseineffectforthattypeofserviceduringthemonthsinquestioninaccordancewithSchedule"A"attachedhereto.

36. / REMOVINGMETERSANDVILLAGEEQUIPMENT
WhenanyownerdiscontinuestheuseofwaterservicesfurnishedbytheVillageortheVillage lawfullyrefusestocontinueanylongertosupplythesame,theCAO,orany
personauthorizedby himmayatallreasonabletimes,enterthepremisesinorupon whichsuchownerwassuppliedwithwaterservicesandmayremovemeters,pipesor
otherthingsthatarethepropertyoftheVillage.
37. / TEMPORARYUSEOFWATERPRIORTOMETERINSTALLATION
Whenanyownerorcontractorrequireswaterduringconstructionpriortoawatermeter
beinginstalled,theCAO maypermitatemporaryuseofwaterprovidedthat adeposit
inanamountassetoutinSchedule"A"isleftwiththeCAO anda TemporaryWaterUse
PermitwillbeissuedbytheWaterDepartment.Watersupplied pursuanttoa
TemporaryWaterUsePermitwillbechargedattheClass"B"ratesetoutin Section2
ofSchedule"A".
  1. WATERSERVICEDISCONNECTIONS

(a)AconsumerwishingtodiscontinueawaterserviceshalladvisetheUtilitiesBillingDepartmentandsignoff.

(b)Any consumer requesting a temporary disconnect for water shall pay a servicecharge for such disconnection and a further service charge for the reconnection, both in the amounts set out in Schedule "A".

(c)Any consumer requesting a temporary disconnect for water due to an emergency such as a water break or major leak between the town shut off and the water meter shall pay a servicecharge for such disconnection and a further service charge for the reconnection, both in the amounts set out in Schedule "A".

(d)Appointments for connections and disconnections requests shall be made at the town office.

  1. APPLICATIONFORWATERSERVICE

(a) / ContractforWaterServices
Anypropertydesiring tobesuppliedwithwaterservicebytheVillageshallsign
requirean application by the owneronaformprovidedbytheVillage officeandpayment ofthefeesetoutinSchedule"A".ThesaidapplicationwhenacceptedbytheCAO,shall beacontractbetweensuchpersonandtheVillagebywhichsaidpersonagreesto beboundbyalltheprovisionsofthisBylaworanyotherBylaworregulationsof theVillageinconnectionwiththesupplyofwaterbytheVillagetosuchperson. The saidcontractshallnotbetransferrable.
(b) / ApersonwhohascontractedwiththeVillagetoreceiveandpayforasupply ofwaterfrom theVillage'sWaterWorksSystemisdeemed tohavecontracted to receivewaterthatismeasuredby,andbilledonthebasisof,awatermeter, irrespectiveofwhetherthepersoncontractedtoreceiveandpayforawater supplyonsomeotherbasisatthetimethecontractwasmade.
  1. COLLECTION

(a)AllchargesandratespayableunderthisBylawshallbepaidtotheVillage officeandthecollectionofalldisbursementsconnectedwiththeoperationofthewaterworksandsupervisionofbooksofaccountsshallbeundertheimmediatecontrolanddirectionoftheCAO.

(b)TheUtilitiesDepartment shallbepromptlynotifiedofallconnectionsmadeorpermitsgrantedorofanydiscontinuanceofwaterservicesothattheproperchargesorallowancesmaybemadeagainstortoanypersonorpersonsliabletopayforthewaterconsumedorwhoisentitledtoarefundwherethesupplyofwaterisdiscontinued.

  1. WATERRATES

(a)Accountsforwaterserviceshallbeforwarded bi-monthlytotheconsumerandshallbepayableattheVillage officeandsuchotherplacesasmaybedesignatedbythe CAO.

(b)ForwardingAccounts

Accountsshallbedeemedtobesufficientlyforwardediftheyareleftonthepropertyoriftheyaremailedbyordinarymailtotheconsumeratthemunicipaladdressoftheproperty.

(c)Water rates shall be set out in schedule “A”

42.PENALTY

As set out in Schedule “A”.

43.ENFORCINGPAYMENT

Schedule“A”;and

(2)If the consumer requests that the consumer’s water supply bereconnected,theconsumershallpaythereconnectionservicechargeset

outinSchedule“A”.

44. / APPOINTMENTCANCELLATIONS
IfanappointmentisscheduledfortheCAOoranyotheremployeeoragentoftheVillagetoattendatthepremisesofanownerwithrespecttoanymatterrelating
tothisBylaw,theownershallpaythechargesetoutinSchedule"A"intheeventthathe
failstoattendatthepremisesattheappointedtime.

45.OFFENCES,PENALTIESANDVIOLATIONTAGPROCEDURE

1)topayafineofnotlessthan$100.00andnotmorethan$2,500.00;or

2)tobeimprisonedforaperiodofnotlessthanthreedaysindefaultofpaymentofthefinewithinthetimeforpaymentallowedbytheCourt.

(b) / AnEnforcementOfficerappointedunderSection3ofthisBylawmay,inlieuofservingcourtprocess undertheProvincialOffencesProcedureActforanallegedcontraventionofthis Bylaw,serveupontheallegedoffenderataginaformprescribedbytheVillage's CAO,specifyingthenatureoftheallegedcontraventionandstatingthat theVillagewillacceptpaymentof$100.00attheVillage office within sevendaysof thedateofserviceofthetag,inlieuofprosecution.
46. / SEVERANCE
ItistheintentionofVillageCouncilthatifanyprovisionofthisBylawisdeclaredinvalid for any reasonbyaCourt ofcompetent jurisdictionthenallother provisionsof thisBylawshallremainvalidandenforceable.
47. / BylawNo.9-2015 and any amendmentsareherebyrepealed.
48. / ThisBylawshallcomeintoforceretroactive to the1stdayofJanuary2016.
