BEADLE COUNTY COMMISSION ACTING AS THE BEADLE COUNTY BOARD OF ADJUSTMENT

APRIL 21, 2016

9:30 a.m.

The Board of Beadle County Commission acting as the Board of Beadle County Adjustment meet Thursday, April 21, 2016 with the following members present: Chair Benson, Vice Chair Hansen, and Mattke. Absent was Drake and Marcus.

Chair Benson began the meeting by explaining that Variance Request and Conditional Use Permits require a 2/3 vote, which is 4 of the 5 Board of Adjustment members, and with only 3 commissioners present, the Board would allow those present to be heard, however a vote will not be taken.

The Board heard from those present on the variance request of McGilvrey Oil Co. Inc to put 10 unit campground, located at All of Lots 1, 2, 7 & 8 Block 12 Wolsey Smiths Addition to the City of Wolsey.

Moved by Hansen, seconded by Mattke, motion carried to table decision until April 28, 2016 when enough commissioners will be present.

The Board heard from those present on the Conditional Use Permit of Devin Tschetter to put a mini storage unit located at Lot 1 Block 4, Hoskins 2nd Addition to the City of Wolsey.

Moved by Mattke, seconded by Hansen, motion carried to table decision until April 28, 2016 when enough commissioners will be present.

Moved by Mattke, seconded by Hansen, motion carried to adopt the following resolution:

RESOLUTION 04-02-16

“PLAT OF T.WENZ TRACT 1 IN THE NE ¼ AND SE 14 OF SEC 14, T 109 N., RGE. 62 W OF THE 5TH P.M., BEADLE COUNTY, SOUTH DAKOTA

On recommendation of the Beadle County Planning Commission: BE IT RESOLVED:

By the Board of Beadle County Commissioners that the plat of T. Wenz Tract 1 in the Northeast Quarter (NE ¼) and South East Quarter (SE ¼) of Section Fourteen (Sec. 14), Township One Hundred Nine North (Twp. 109 N.), Range Sixty-Two West (Rge 62 W.) of the Fifth Principal Meridian (5th P.M.), Beadle County, South Dakota as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

Moved by Mattke, seconded by Hansen, motion carried to approve moving permit of Chad Chenoweth to move a 10 x 20 portable shed with walk in door to Lot 14 & 15 Gross Addition Lake Byron.

Moved by Hansen, seconded by Mattke, motion carried to adopt the following resolution, pending payment of taxes:

RESOLUTION 04-03-16

“PLAT OF LOT 1 OF B.L. EDEN FIRST ADDITION IN THE NW ¼ OF SEC. 19, TWP 110 N., RGE. 61 W. OF THE 5th PM, BEADLE COUNTY, SOUTH DAKOTA

On recommendation of the Beadle County Planning Commission: BE IT RESOLVED:

By the Board of Beadle County Commissioners that the plat of Lot 1 of B.L. Eden First Addition in the Northwest Quarter (NW ¼) of Section Nineteen (Sec 19), Township One Hundred Ten North (Twp 110 N.), Range Sixty-One West (Rge. 61 W) of the Fifth Principal Meridian (5th P.M.), Beadle County, South Dakota as described above and drawn hereon be approved and accepted and the Auditor hereby is instructed to endorse on such plat a copy of this resolution and to certify the same.

Moved by Hansen, seconded by Mattke, motion carried to table decision until April 28, 2016 variance request of Andy G Gross to put in a 45 unit campground and convenience store at NW ¼ of SW ¼ and Lots 2 & 3 ex 10 ac in Otl 1 & 2 & HWY 23-113-61 Lake Byron Township.

Moved by Mattke, seconded by Hansen, motion carried to table decision until April 28, 2016 variance request of Mister GinCol’s Berry Patch for a 75 foot variance to plan berry producing bushes in order to produce a cash crop commodity located at N900’ of E1355’ of NE ¼ exc Lot H-1 13-109-62 Grant Township.
