AN ORDINANCE AMENDING SECTION 1042.115 OF THE CODIFIED ORDINANCES OF THE CITY WITH REGARD TO SANITARY SEWER USER FEES TO REFLECT THE CHANGE FROM QUARTERLY COLLECTIONS TO MONTHLY COLLECTION BY CLEVELAND DIVISION OF WATER.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF OLMSTED FALLS, CUYAHOGA COUNTY, OHIO, THAT:

SECTION 1. Section 1042.115 of the Codified Ordinances regarding Sanitary Sewer User Fees is hereby amended to read as follows: (new material appears like THIS: deleted material appears likethis):

Billing Charge:Any and all service charges imposed by the Division of Water, City of Cleveland for billing and collecting of such charge on behalf of the City of Olmsted Falls based upon a per connection per billing period charge.

Volume Charge:Eight Dollars and Forty-Two Cents ($8.42) per One Thousand

(1,000) cubic feet of water consumption as and for the local charge for operation, maintenance, replacement and repair of sanitary sewers and storm sewers with a minimum charge per MONTHLY billing cycle of Eight Dollars and Forty-Two Cents ($8.42) TWO DOLLARS AND EIGHTY-ONE CENTS ($2.81).

The System:If any user of the sanitary sewer system is granted approval pursuant to the necessary requirements of the Northeast Ohio Regional Sewer District for the district sewer service charges based on usage of the system under a non-user/ non-discharge status then such user shall have the volume charge set forth hereinabove adjusted in the same manner as that granted by the Northeast Ohio Regional Sewer District to such user.

of the System:If any user of the sanitary sewer system is granted approval pursuant to the necessary requirements of the Northeast Ohio Regional Sewer District for the district summer residential sprinkling user charges program then such user shall have the volume charge set forth hereinabove adjusted in the same manner as that granted by the Northeast Ohio Regional Sewer District to such user.

SECTION 2. All prior Ordinances inconsistent with this Ordinance in whole or in part are repealed to the extent necessary to avoid conflict with this Ordinance.

SECTION 3. This Council finds and determines that all formal actions of this Council relating to the adoption of this Ordinance have been taken at open meetings of this Council; and that deliberations of this Council and of its committees, resulting in such formal action, took place in meetings open to the public, in compliance with all statutory requirements including the requirements of Section 121.22 of the Ohio Revised Code.

SECTION 4.This Ordinance shall take effect at the earliest time allowed by law.
